Can You Buy A Land With Only Tax Declaration In The Philippines?

    A tax declaration is not a proof of ownership. It is only a proof of possession.
    A tax declaration is a document that a land is declared in the assessor's office of the town where it can be found for the payment of real property tax but it cannot be called a title under the Torrens title system.
    While tax declarations and receipts are not conclusive evidence of ownership and do not prove title to the land, nevertheless, when coupled with actual possession, they constitute evidence of great weight and can be the basis of a claim of ownership through prescription.
    I know there are a lot of buyers that are interested in buying lands that only has tax declaration but it is best to have it titled first.
    There are two methods of land registration:
    Judicial Proceeding and Administrative Proceeding.
    1. The Judicial proceeding is where you need to file a petition for court registration. It may either be voluntary where it is instituted by the applicant under the provisions of Act 496 or PD 1529 or the Property Registration Decree.
    2. The second method of land registration is thru Administrative Proceeding - this is a procedure where there is no need to go through the court. What you need is to file an application for “Homestead Patent” to the DENR and the registration of this patent will be the basis for issuing Original Certificate of Title pursuant to Commonwealth Act 141 or “THE PUBLIC LAND ACT”
    But if you are willing to take the risk and not wait for the land to be titled and just accept the tax declaration as proof of ownership here are the 7 steps you can do:
    1. Choose a licensed real estate broker/real estate salesperson and if necessary, hire a lawyer especially if you’re dealing with a big amount of money.
    2. Do your due diligence. Never purchased and untitled property without inspecting it first. Compare it with the photos and documents issue by the seller.
    3. Proceed with the municipal tax assessor. Ask for get a copy of the tax declaration directly from them and compare it against the one presented by the "seller."
    4. Secure a copy of the map, if there are, from the Land Management Bureau under DENR so you would know exactly what the boundaries are. This will validate your ocular inspection.
    5 Check the Registry of Deeds to see if there is really no title. If there is an existing title, then at least you have done your due diligence and avoided being scammed.
    6. Inspect the chain of ownership by tracing the property back to the person named in the Property Tax Map. The most important thing is to see that they are the legal heirs of the named owner- being his/her son/daughter. Hiring a lawyer to do this can also help a lot. Because even there is just a single heir that refuses to sell the property, this will be a serious problem.
    7 Surveying the property by a licensed surveyor. You must make sure that the property’s metes and bounds are properly described in the Deed of Sale.

    Okay sana to kasi complete info. Very helpful. Kaso sana tagalog since Pinoy naman tayo and the process mention mostly applicable lang saten kasi iba nmn ang law sa English speaking country. Just my one cent. Para mas makatulong sa iba lalo na yung hindi pamilyar sa real estate. Anyways, thanks for this content.

May tanong po ako gusto sana ibenta ng nanay ko ang lupa nya may mga papers po sya na hawak (ctc,latest tax declaration, indvidual title kasi na sub duvide na sa aming mag kakapatid na ma rerelease na by next year January po) sa ctc name ng nanay namin naka lagay tapos kami ang heirs or co owners na naka indicate sa likod ng ctc. At sa latest tax declaration naman name ng nanay ko at kaming 4 na magkakapatid. Kaso d namin ma ebenta kasi may nag claclaim ng lupa na binenta daw sa kanila ng isang tao na d namin kaano ano or kilala at hawak lang nila ay tax declaration at nong nag trace kami e cancelled na yong naka name sa tax dec which is yong nagbenta sa kanila since 1988 pa. Ang tanong ko po atty if mabenta po namin ang lupang eto hindi po ba kami makukulong kasi po mapera ang nag cla claim tinatakot kami na kakasuhan daw kami dahil nagbenta kami ng lupa na di sa amin pero amin yon kasi si nanay ang nagbabayad ng tax may ctc sya at updated na ang tax declaration which is under na sa aming mga pangalan. If magkaso po sila may habol po ba sila or mananalo po ba sila gamit ang pera nila or kami po na may mga papers na hawak pero walang pera.     Hello po! I only have question Sir, what if the case is different anf maybe a bit complicated. The owner of the land sold it to 3 different persons, is it ok po na they didn't transfer the title to those new owners but still at the old owner at Ang meron lang sila ay SPA.. Then those 3 people trying to sell it again.. Ang question po sana is kung ok Lang ba na SPA Lang meron sila not really the title in their names Tapos ibenta nila sa iba? Was it legal? Then Sabi nila instead na itransfer pa sa name nun 3 bago may ari yun lupa, direct transfer na dun sa huling pinagbebentahàn.. Kahit Sino po May alam pede magcomment.. Thank you

      Ang pinaka unang nag register ng DOAS sa tatlong napagbentahan ang siyang may claim sa lupa. Kailangan ilipat muna ang titulo sa magbebenta. Pero kung may SPA siya galing sa tunay na may-ari, puwede naman. Basta basahin mo lang kung ano ang nakasulat at ipinapagawa sa kanta sa SPA. Dahil baka may SPA nga di naman stated na ibenta n'ya ang lupa. Then the transaction will be void. So kung maraming napagbentahan, ang pinaka may karapatan d'yan ay kung sino ang unang makaregister ng DOAS sa RD

    I thought owning a land would be a good investment. But after your video, it sounds like land doesnt seem to appreciate, rather, it would all be offset by all the taxes? I seem to be confused, can you please clarify how land value appreciates with all those taxes?

      Madugo lang process ng tax dec..pero if you are willing to take rhe risk at napatituluhan ito..magandang investment na sya (high risk, high income)

      When you buy a property, make sure the land title and tax dec are transferred to the seller. If the seller did not transfer it from the previous buyer, your in a hole specially if it was bought from a real property estate. The BIR penalty will skyrocket depending on the date when real estate notarized the deed of sale. It's called KABOOM.

      Hi maam. Tax dec is proof na updated ang tax payment ng lot po. Its paid annually. Baka behind na sila sa payment at ikaw ang sasalo on top sa payment mo sa property po.

    I am a bit confused about your claims. As far as I can tell, titles are pretty much only in the cities. I have almost never heard of a farm lot/agricultural lot being titled. As you mention, titles are in the cities, such as Manila or Metro Cebu, but anywhere else, which is a HUGE portion of the Philippines, tax declarations are still the only way to go. Just travel 2 hours from Metro Cebu and you will have a hard time finding titled lots. Lastly, I feel that your recommendation are lacking a lot of details. For example, you never mentioned all the required papers or steps to transfer a tax declaration. Wouldn't that be the absolute most important thing? To make sure you get all the required papers from the seller? You also never mentioned that you should check that all taxes has been paid, tax clearance etc. Sorry, but I feel this video is very incomplete. It sounds like you only need to care about those couple of steps that you mention and then everything is fine, which is far from the truth. Many, many, many more things to consider.

      i agree, the video is lacking in info but most of the properties in the Philippines are titled,we have properties that are located in provinces about 5 hours, and the other one is 10 hours from metro manila and it's all titled. buying properties that are only tax declaration is not recommended at all, maybe cheaper but save yourself from headache, just buy a titled one that you can check from LRA who the real owner is

      Hello sir. As far as i know, if the property is "abandoned", meaning they are not paying taxes, the government will claim it. If titled yan sir is baka yung mga heirs ang mag claim one day.

    Meron kasi kaming nabiling lupa portion lng po around 2000 sq mtr isa sa mga anak ng may ari bali share niya sa lupa bininta nya sa tita ko thru extrajudicial from the original owner to heirs then 1 heir to tita ko then tita ko to us. TAX DECLARATION LNG PO iyong total na lupa around 4hec under the name po ng original owner. Meron na pong CAR iyong tita ko para sa 2000 sq mtr na portiong nabili nya and na umpisahan na niyang e process para magkaroon ng title SANA kaso di niya na ituloy noong year 2000 pa po iyon. Meron po cya subdivision plan kaso di nya na process ito sa DENR di pa na pa approve,may CAR na po iyong 2000 sq mtr kaso paso ata daw, Iyong tax naman updated namn po ang tax ng buong lupa. Meron din CAR iyong buong lupa.
    Gusto ko sanang asikasohin para meron na pong papil ano po gagawin ko ano ano na lng mga hakbang ginawa ko Nag pa resurvey po ako sa lupa ngayon and waiting for printing, na check na rin po namin iyong history ng lupa ok naman po, and nakakuha na rin po kami ng Certificate of no title kasi na check na rin namin na wala pa naka file ng title.
    Ano kaya advise niyo sa akin

    A relative is selling a lot of 10.5 hectare that is only tax declared and all the tax had already been paid lately. I can't afford the 10.5 hectares but my relative agreed to sell me only 1 hectare. What are the steps should we do all the way to titling the lot? What's the seller's responsibility (and the documents needed to be given to the buyer)? What's the buyer's responsibility?

    ang totoo kaya. walang nag ppaatyloy e process ang pa title, dahil sobrang pahirapan pag process. corrupt lahat ng nmaahala or mga nkaa upo sa pag process ng title. kung anu anu requirement pinapakuha. tapos nag bagal pa processo.. mag 2 years nlaang pag process ko. until now di pa tapos. lage mabagal mga department

      @@andi6986 yung mismo naka upo kung san kukunin mo mga requirement para mag process ng tittle maam. cila po mismo ang maka pag pa delay. base on my experience lang po. ig gusto ka mapabilis hanap ka ng ahente na may mga connection sa mga department ng pagkuha ng mga requirements for tittle. medyu mabilis kunti. pero yun nga lang mapagasto ka. depende sa usapan nyo magkanu singil, pero ingat maraming mga scammer na agent mag process ng tittle. pag naka bayad kana kahit kalahati sa usapan nyo. e block kana. na experience ko rin.

      Hi John, the best proof of ownership is always the certificate of land title. There are properties na tax dec lng ung hawak and you need to careful about that. Deed of sale dapat sir ung first step sa pag bili ng property at notarized.

      Nabili nyo na po ba? Kung titled sa ibang tao, then sya ang tunay na may-ari at pwede kayong paalisin. Kung naverify mo na wala pa talagang title, gobyerno ang may-ari. Di naman basta basta nagpapaalis ang gobyerno maliban na lang kung gagawing kalsada, public school or hospital, palengke, etc.

      Lahat po na nakabele nang lupa tax declaration lang po ang pinaghahawahan namin.
      Sa alam kulang po ang may ari talaga nang lupa nayan magulang nila. pero wala na po sila.
      tapos ang nag binta isa sa tagamana nang lupa.

    you need to make sure first the land classification of the property you are selling if you are buying untitled properties. you cannot sell forestland or timberland properties because its illegal.

      Check the status of the property at the CENRO office in antipolo. If its alienable and disposable then you can apply for title.
