    Great information Jerika, I was not aware Lush had this patent. Please note, Lush's patent actually expires in 2031 - 20 years from the date of application in the US, not from the date of approval. We applied for a patent on a product and it took 7 years to get the patent approved, which left us 13 more years. You are protected once you apply and can claim Patent Pending, which is why the 20 years starts at application.

    I'm not going to lie. Patent's like Lush's really annoy me. I know Lush is NOT the first person/company to do this. They are just the first people to file for a patent. It reminds me of wood wicks for candles. There is a patent on those too. I don't understand how companies can be granted patents for things that have existed long before they even existed. A wood wick is literally just a piece of wood. There is nothing special about it. They literally have a patent for wood, that grows everywhere. I am going to go file for a patent on oxygen and start suing everyone.

    Thank you so much for this great, time saving tip on using the bag! I've been making teensy cube embeds, and it is time consuming. I've used your embed recipe since yours is tried and true using this technique. After I bagged "the goods" I went a little further and scored about 1/2" sections using a pastry scraper, in hopes that my "chunks" break off slightly uniform...which I'm probably reaching too high of expectations, but we shall see! THANKS AGAIN, Sweet Jerika, for this! You deserve ALL THE THINGS! 🙏

    I am happy that you brought up the patent info. We see these bath bombs made so prevalently in our community that many wouldn't even realize that there was a patent. I had it in my mind that any inside mix that is different from the outside mix does indeed create a two layer bath bomb. I have studied the patent info but it usually leaves me more confused than when I started. Ha. I know the Lucky Break Consulting article specifies two different citric acid ratios. However, reading the patent, it does seem that not only are they looking at baking soda and citric acid ratios (in a rather wide percentage range that is the same for the first and the second mixture), but also that the second mixture includes cream of tartar, fragrance, surfactant, etc.. So that leaves me questioning whether the patent goes beyond just the baking soda to citric acid ratio since the second mix specifies that it has the added ingredients. We know that even though the ratios of baking soda and citric may be the same in both mixes, that the absence of the extra stuff we use (oils, SLSa, kaolin, etc,) will indeed cause the inside mix to effervescence at a speed different than the outside mix. The use of SLSa alone causes the mix to slow down the effervescence. So would seem that it still applies. The Lucky Break Consulting people are assuming that we are simply making single layered bath bombs and so those are not an infringement of the patent. I had several people call me out on a video last year where I used a regular mini bomb inside a regular bigger bomb because it also could be considered a two layer bath bomb...but it was still the exact same recipe down to the oils, slsa, etc.). I think it’s just easier for me to stick with a single layer at this point. LOL I myself would just make the embed powder the same recipe as the outside, if I was only looking for color and not for an extra boost of effervescence. I'd be happy if I was wrong. 😂

    • @JerikaZimmerman
      @JerikaZimmerman  3 ปีที่แล้ว +2

      Yeah it’s definitely grey and confusing territory! When I observe my bath bombs dissolving, I don’t see them shooting out like lushes does, just an another layer or colour revealing itself at the same rate as the outer bath bomb. I think due to the “powder” nature of my embed, they incorporate somewhat with the main bath bomb recipe to an extent, making it not as fizzy. All of the additional ingredients due affect the rate, you’re totally right! Awareness is key and we all should proceed knowing this patent is in place and be willing to face the consequences should Lush should (and rightfully) decide to sue for patent infringement.

      @moriversoap 3 ปีที่แล้ว +2

    How long do embedes last before they go bad. How long would you recommend saving a bath bomb before it goes bad?

    Tried this last night and had a little trouble with the coloring. Can you mix the color with water then add to your dry mix?

    Thank you so much for this video! You mentioned you don't put SLSa in your embed powder even though your bath bombs contain it. Knowing that SLSa slows down the fizzing reaction of a bath bomb, do you find that your embeds fizz at the same rate as your bath bombs without it?

    Thank you for this, I've been waiting for it! 😀. Can I check, I thought the ratio was 1:1? Have you changed your recipe? Thanks xx

    • @JerikaZimmerman
      @JerikaZimmerman  3 ปีที่แล้ว +2

      Ya... I did. I researched the patent a bit more and decided to change it up so that I was not infringing on Lush's patent. After some testing, my bath bomb secret color still comes out as desired, though the 1:1 ratio is DEFINITELY fizzier and provides a more "wow" affect.

    I need help. I made this embed powder. It seemed to start to activate when I spritz water on it. Then I placed the various colors in bowls and they became a bit hard/gummy. What did I do wrong?

  • @AB-xb2ph
    @AB-xb2ph 2 ปีที่แล้ว +1

    Random question… so the two layer thing… if you did let’s say… a “jawbreaker” effect and layered something dissolvable like rice paper between the layers. Maybe it could be considered a totally different bomb with it breaking down at different times? So the single bomb wouldn’t be layered if it was separated? It’s a stretch lol.

    What rules are there in shipping soaps & other cosmetic type products to Canada from USA? I hear people talk about extra steps, but no good info on it. I just want to make sure i'm following the rules for Canada customers. Don't know if anyones knows since I haven't had any good luck finding clear details on it.

  • @Pumpkin20001
    @Pumpkin20001 3 ปีที่แล้ว

    I’ve been using especiallyforyou.ca embeds I think the patent only applies in US and it has to be entirely enveloped so cloud bombs that peak out embeds are ok. Also if the ratio is the same it’s fine.

    What makes it so you are not infringing on the patent

  • @jillianj310
    @jillianj310 3 ปีที่แล้ว

    Ok, so I have a question after trying this for the first time... I scaled back the recipe quite a bit (by 20 lol) so I wasn’t sure how much dye to use (I used fd&c green water soluble) so I just used the tiniest amount... how do you know if you have the right amount of dye to have it be concentrated in a tub but not use too much water to over activate it? Is it just trial and error and something you learn with experience? I have a mint green color powder right now and it seemed to be activating a little so I didn’t want to add much more water to activate more color at this stage.

    • @JerikaZimmerman
      @JerikaZimmerman  3 ปีที่แล้ว +1

      Yes, I'm afraid its trial and error! That's how I learned!
