      Yeah, I actually found his early vids funny viewing them as a sarcastic parody.

      I still can’t work out if he was serious all along, or started with parody, before having some kind of breakdown, not knowing which bit of what he was doing before was working and adapt g the persona, before descending into malicious activities & crypto scams.

      I used to work as a counselor at a drug rehab that primarily served probationers and homeless. We had lots of narcissists and sociopaths in my program, just because of the client population, there's a lot of these personality disorders in the overlap between criminal justice and addiction. I learned to listen very closely to certain queues and identify clients who were going to be a problem.
      13:00 This thing of like, " I don't care and it doesn't bother me at all... (but I'm also not going to let this slide)" And "I'm going to put you in your place and teach you a lesson... (and show you how I have the real power here)," that's sociopath talk. If I heard someone talking like that in my group, I'd mentally add that to the "sociopath" column in my head. Normal people just don't think this way, typically. But all sociopaths do.
      I know this is nothing new to people who have followed techlead, and heard an iota of techlead's real life, but I just pass that all along.

They just don’t have the courage to go through with it, which is why they keep getting walked over and exploited in life.
      The measure of a sociopath is the specific actions they take to this end and their severity, lack of guilt/remorse/shame, and level of irritability.

    As a victim of Malicious DMCA abuse myself, I say hats off to you Mutahar for addressing this. This has been something that TH-cam needs to look at and change due to the rampant abuse that has been going on for years, not only by Techlead, but many others.
    I would also love for TH-cam to actually implement a live chat or a real human instead of an automated DMCA system to combat abuse, and also give us an option to report these malicious users for DMCA abuse and Ban Evasion. (If a malicious DMCA Abusing channel gets taken down, oftentimes they create alternates to re strike you).

Their current stance is likely the result of not being able to afford removing the hornet's nest that formed on their property, so they definitely don't want to touch it unless they absolutely have to, even though their users are getting stung by hornets every day.

      Better solution: If someone is gonna file a claim, they should have to file it with an attorney's name. Send the attached attorney's name to the accused. TH-cam can verify that the attorney really exists. The accused can call up the law firm where the attorney works to gain confirmation or denial of the attorney's involvement. If the named attorney did not consent to having their name in the claim, the attorney can contact TH-cam with the false-claim details and have the false claim stricken.
      As for small creators with legitimate claims, there are some fairly affordable attorneys out there. And as for false-claimers who get legit attorneys, you now have the attorney's name and can file an official complaint against the attorney for misconduct- along with a bunch of other remedial actions. Doing it this way should eliminate a lot of false claims and strikes before they even reach the victim.

      Agree. There should be an intermediate step before it needs to get to the legal recourse. I understand the point with the site being as big as it is they can't have a human verify everything, and want to leave it up to the creators to legally settle everything themselves but creators like TechLead just show why the system isn't as good as it should be.
      All I heard from his statement was he is trying to get personal info so he can blackmail creators into not covering him negativity otherwise he will threaten to dox them.

      ​@@TheCommanderTacoat a minimum there should be some kind of verification process of people claiming copyright violation (like drivers license for individuals and business tax ID number for incorporated parties), where a VERIFIED legal name and address is provided and them given to the person making the claim. This puts an end to "ad rev for a 3rd party" and has mutually assured destruction for the people filing false claims to get personal information.
      Yeah, it's too easy for major media companies to abuse the DMCA since there hasn't been a real court case setting precedent and clearly defining what is and isn't fair use, and this doesn't stop that since I don't think Walt Disney Company at 150 Royal Street Suit 101 Canton MA 02021 tax ID number 952412883 has a problem with people knowing that information (publicly available information I got was a google search), but it does stop "ad rev for a third party," identity unknown and Vince Vintage hacker stalker who is hiding his identity while trying to ruin Vince's career.

    A demerit system would resolve this. YT needs to put in place a system where you get a maximum of 3 disputed takedowns, just like a channel gets three strikes. If you issue a DMCA takedown and it’s successfully disputed, your account is gone then and there. If you issue the takedown and then retract it, you get a strike. Three strikes and your channel is gone. That would cause those who issue these DMCA claims to think, “Do I _really_ want to do that here?” It would limit DMCA takedowns to actual, legitimately provable claims only and protect smaller channels from abuse.

      Everyone wants that, it's been suggested numerous times, but i wonder, is that even legally possible without TH-cam losing safe harbour provision?
      After all you have a problem then that someone can start a campaign against a channel by creating hundreds of channels and all of them stealing content. Now obviously the rightful owner of the content needs to dispute them; and by all reason some disputes will fail just because no system is perfect. Like you don't want to give leverage to people who abuse the DMCA system illegally, but you also don't want to give leverage to people who might be up to these sorts of things, right.

    Wow the timing of this is insane. My boyfriend recently just got hit with three false claims on his channel with completely made up names and emails, clearly targeted although who knows why. They also attacked an associated channel, different person, because the content revolves around the same people. Absolute scumbag scammers. Can content creators file a class action lawsuit against youtube for this? Seriously, shit needs to change and people need protection.

      To help your boyfriend, have a look for a cheap copyright lawyer and your boyfriend can use their details instead of his own personal details to appeal the false copyright claim. Because the other side is using false details then they won't be able to submit the legal paperwork within 10 days and the copyright strike will fall off of his channel.

When the first 24 hours dictates the success of a product is willfully disputed in an illegitimate way, like IDK, sending a borderline fraudulent legal document (copyright) to a third party (TH-cam) to disrupt business (views=ad rev)

      Yeah I'd agree. His only defence would be acting in negligence, which is open to major studios that use automated systems, but in his case he clearly admits to it on camera.
      The problem is they'd have to use his video confession diary in court, and anybody watching that would quickly be bored to death. The other issue is he has the copyright to it, he'd just DMCA the court.

    Great video! I’m a classical pianist, and so I am very familiar with this problem. The major record labels DMCA every recording, since we’re all recording the same pieces, the algorithm misidentifies the our recordings! Even though it is my own recording, I have to do extra steps to publish my music. Super frustrating to get these copyright trolls!

      It is not YT's place to decide these things. YT's job is to be an intermediary for the process. They are not a party to it, and injecting themselves into it is a legal minefield best left untouched.
      This is ultimately a civil dispute between two parties. YT is required by law to honor DMCA in a neutral manner.

      @@jillsandwichorsometh it is, you just don't realize it. The entire DMCA process is a legal process. YT's role in it is described in DMCA. If they interfere, they are injecting themselves into that legal process.
      It is not very complicated. You just need to realize that this whole back and forth between creators on YT is a legal process, even though most creators don't seem to realize this.
      If YT punishes someone for making DMCA claims, without any sort of real legal resolution to those claims, then YT runs the very real risk of violating DMCA because they are going outside of their described role. Or of losing their platform designation, which shields them from liability for content that they host.

    You are 100 percent correct that false copyright strikes are illegal. That is because if you ever try, the last thing you need to sign on the bottom is a checkbox that says you swear it's true under the penalty of perjury. Perjury is a federal crime. It is a felony. It is a maximum of 5 years in prison. And false copy right striking is very much an act of perjury.

      No, only prosecutors can bring forward claims of perjury. It's out of the hands of private citizens. You would have to petition prosecutors (via an attorney​ $$$) in order to get it assessed.

      Also, perjury criminal cases have similar massive burdens of proof for convictions as defamation for civil cases where you have to extensively prove that they intentionally & knowingly lied/misinformed TH-cam's copyright system/staff-- meaning that prosecutors rarely prosecute perjury at all. Even cases that look "open-and-shut" get obfuscated all the time through the most excruciatingly stupid arguments.

      But the problem with youtube is you can't identity those who orchestrated mass flag behind the scene. I've been experience youtube for 10+ years now. There's a lot of anonymous childish folks who succeeded to take many of genuinely good video down.
      We can't do nothing unless they openly brag about falsely claiming copyright the content.
      Btw you remember those viral vaporwave macintosh 420 song? It used to have a music video with dreamy cgi, it got 20M views. And some bastard take that stuff down. And I forgot to download the video arrgh..
      Oh btw, the original gta v ufo video are actually made by local youtuber from my country, it went so popular that it got into Rockstar main website back in ps3 era.. and you guessed it.. some bastard take his video down with false copyright claim yet other cringy gta channel did not get the same treatment.     One of the crazy things about the youtube DMCA system is, someone who is not even the channel owner of the copyrighted content can file a DMCA takedown. Someone could claim they're SomeOrdinaryGamers, claim hundreds of videos, and TH-cam does NOTHING about it. If someone wants to claim DMCA on someone. Fine. Put your channel at risk. In order to file a DMCA claim on TH-cam in my opinion, you need to be signed into your own youtube channel and make the claim from there. You also must have a certain tenure on TH-cam with a certain numer of uploads and watch time in order to verify that your account isnt just a troll account that is made for the sole purpose of false flagging. False claim once, you get a warning. False claim twice, you get a slap on the wrist you cant file any more DMCAs for a year or something. False claim 3 times, channel termination.

      That's dumb. A lot of the time some other company is managing the DMCA process, not the actual rights holder.
      Also, YT is a victim of DMCA just like everyone else. They are forced into this by the government, including all of the stupid parts.
      While YT could probably take the outcome of DMCA claims into consideration, it is very, very rare for them to get to an official false claim status as they are either settled or dropped. And dropping a claim doesn't mean it is false, it could just mean that you don't want to go through the time and effort of a trial, even if you are totally in the right. Those things are expensive, and you can never guarantee outcomes. Happens all of the time.

      @@MadLover4690 You could argue that, sure, but TL never said he didn't think he had a valid claim, just that it was too much trouble to pursue seriously. If I am a rights holder, I can throw out thousands of these claims with the plan to pursue none because it is not worth the money. That I do not follow through to a real court case does not mean I did not have legitimate grounds to file DMCA. And that I have other motives as well does not mean I do not have the required motive, which is to protect my content.
      I'm not saying you have a good argument, I'm saying it probably isn't enough by itself to reach the bar you're going for.
      In court, I don't think a judge would agree that the DMCA claims were made maliciously or in bad faith. He very obviously owns the copyright, he knows that, and he appears to believe that no real good faith use of it is happening (the part about no real journalism and such).
      He will most likely ultimately lose the case, but that is very different from knowingly making a false claim, which is what you are saying he did.

If someone outside of TH-cam wished to make a claim, it could be necessary for them to file the claim in writing via their attorney. The attorney's information would then be on file with TH-cam for future claims. I'm not saying that its OK for people on youtube to upload unedited non transformative pieces. What I am saying is that DMCA is a legal process and should have consequences for those who do abuse the system. For those who dont abuse the legal system and are having their works ripped off and uploaded to youtube in whole pieces, the legal process protects them and their channels if they have one.
      I just think that the legal process should be handled by lawyers and not a form that just anyone can fill out and even impersonate people and potentially jeopardize thei actual content creators channels as well. DMCA is not a weapon to be wielded against people who you dont like criticizing you.

    At a minimum, abusing the dmca like this should result in being able to recover attorney fees if the originating party backs out of the dmca strike like a coward because they know there is no legal bounds for making the strike.

      You'd have to prove the abuse, but I think it is already the case that you can seek attorneys fees as damages for maliciously brought cases that the other party knew had no real merit.
      The problem here is that Tech Lead seems to think he can lawfully do what he is doing, which makes recovering attorneys fees unlikely in most US jurisdictions.
      Then again, the fees would only be a few thousand, if that, considering that the civil case would be easy to dispute, given current facts. And tax deductible as business expenses.

    I honestly think channels like LegalEagle would be awesome if they started to protect other youtubers without the means to protect themselves with their Patreon, Sponsor, and/or TH-cam ad-revenue as a way to help out.
