    Why is it that people are more than happy to declare 'rules' and 'laws' that they believe to be absolutely true, but when someone (such as an auditor) quotes the actual legislation, the other person reacts as if they're being spoken to in a foreign language...
    It's the same with the police, they'll give an order, and when challenged with the actual laws that they are supposed to police, they give sarcastic responses like "oh you're one of those, you know the law do ya? Google lawyer are ya?" - it's frustrating that they're so hostile to anyone that might know basic laws, which are freely accessible online and really aren't that complicated or difficult to understand...

      @@jacksugden8190 It's not a point of view. It's simply fact. I do accept that these auditors are not on as sure legal ground as they seem to believe, but the simple act of filming inside a public building is not in itself illegal or actionable unless it is harassing or in breach of the Data Protection Act, or accompanied by other offences or civil wrongs. He was doing nothing wrong in the video. If they detected him filming, they could have asked him to refrain from identifying service users, which would be understandable, and if they suspected he was doing so, they could have then asked him to leave. If I were a service user and I believed I had been filmed by him, I would ask him to ensure that he blurs out my facial image in any reproduction of the film. As long as he agrees, there is no issue. If he doesn't agree, then there is an issue and I would then report him to security, and if he becomes abusive, I would bring in the police.

    One of the issues is that SO's undergo counter terrorism training which highlights hostile recon but the part of the training they forget is that in a public area they are to observe and report to the counter terrorism hotline.
    That's it, no power to prohibite filming.
    On private property or property covered by restrictions however they can, under certain situations they can also take your recording device.
    But in public accessible areas absolutely no way.
    On a side note the building manager is absolutely pathetic.

    • @daz7335
      @daz7335 2 ปีที่แล้ว

      Under counter-terrorism training, the steps are to See, Check, and Scan. The check part is " the power of hello". The key first step is to speak to anyone acting suspiciously. NOT just observe and report. This is designed to help you understand their intent (likely not hostile) and to put off anyone that is hostile.
      Even public buildings only have "implied right of access". The landowner, or their representative (in this case security) can at any point remove your right of access. This can be due to breaking set rules they have (like filming) or any other reason that isn't discrimination. (Because someone is filming would NOT be discrimination)
      Security would have no right to take your recording device, at any point. And police in this situation wouldn't have the right to either.
      What's worse is the fact the police officer doesn't know the law and what powers are available to her or security. Just like the police do themselves, the auditor is saying it with conviction and they are believing what they are told. Once the implied right of access is revoked, and they have been asked to leave, they are trespassing. Reasonable force can then legally be used to remove the person.

The job I choose to do does not give anyone the right to film me and place on social media.
      You are determined to film people despite their clear lack of permission to do so.
