Completely agree. I was shocked to hear they were making the arrest just based on a cars headlights looking a little off. They wasted a trial when it could’ve brought proper justice and more information.

I do believe he did it, but I agree with the court's findings given the evidence. I think that they screwed up their chance by not waiting until more solid evidence was found, so that a solid case could be built. Now, like you said, we may never find out. He can never be re-tried.

I was given midazolam right after my surgery and even though I didn't have sleeping apnea, it almost killed me with respiratory depression. If they think it's not the dentist then they should tell us how midazolam got into his system! It's obvious that he did it!
Exactly.. I’m a mental health nurse and often give Midaz to sedate patients and there are protocols we have to go through due to the effects of the drug. It’s a great medication when used appropriately but I would not give the medication unless in a hospital setting. Plus if a patient has sleep apnea then we would have to keep an eye on the patients respiratory rate. Plus he could have planned this for a while as he could have siphoned a small amount of Midaz each time he gave Midaz to give a dental patient.

I think Gil is a sociopath who love bombed them both and lured in Linda. He enjoyed the games he played to pull all of the strings and manipulate them. Then when Linda wised up, the game was over. The idea that he "didn't even know about the medication " was part of what got me. Every dentist knows what midazolam is and is used for. He's guilty and can never be charged again. Sad all around.
I do understand the not guilty verdict but I do believe that he was guilty of the murder of Tom. Even though he was the one having an affair with Tom’s wife I believe he knew deep down that it was Tom who Linda loved and he couldn’t take that. I can imagine him wanting Tom to be jealous of him.

That doesn't mean Gil used it or killed him. There's still reasonable doubt. You have to be able to put Gil in that car and that drug in his hand. They couldn't do that. No fingerprints on the bottles and they can't say for sure it was Gil in the SUV.

What a nightmare with these 3! Did they not see if Tom actually met up with anyone else or even got out of his car? As a nurse, versed is injected, which we usually use to sedate prior to intubating etc. Linda & Gil both had access. Just because none is missing doesn't mean they didn't take it from a patient or only used half on a patient etc. Also, if it was Gil, to inject him properly, I doubt Tom would allow it unless Gil lied & said it was an antibiotic etc. to treat who knows what. The prosecutor blew this whole case, and should of gathered more evidence or hired someone to do a little more investigating. Who knows how many patients any of these 2 was around to administer Versed and etc. It's not considered missing if it's prescribed to a patient and not fully used. Most meds are wasted as only certain amount is prescribed and the rest we waste in a toliet with a witness. They jumped the gun and now there is a murderer walking.

IMO Gill got away not with one but two murders. He killed his so-called best friend and his son who ended up killing himself over his father's death 💔 I know in the US at least if they found more evidence that pins him to Tom's murder, they can't re-trial him because double jeopardy laws which will keep him out of prison.
as someone from Kingston & ukster county, I can tell you from personal experience, the “proeffsionals” and police work here is always broken. Cases in this county, and area are rarely investigated appropriately. Police and investigators in this area are crooks, and families rarely receive justice. Kingston is practically the ghetto in half the parts these days, which is why I moved. Its terrible, and I cant explain how many cases go unsolved, or taken to court with minimal evidence.
What's absolutely appalling to me about this case is now he can't ever be charged..... He said himself that he "replaced" those things in the emergency kit..... Those poor kids have no dad now.... And I think he that Linda was going to stay with Tom and end their relationship.... Which I'm still trying to figure out how Tom could be so fine with their relationship..... I can't wrap my head around that.... Not my monkeys, not my circus.... But there's no way I could even forgive someone for cheating..... But that's just me..... Maybe all Tom ever wanted was his own family and that's why he stayed.... It's just a shame that the police and the DA went to court without enough evidence.... The fact that a drug available to a doctor or dentist was found in Tom’s system, one known to have serious consequences for people with sleep apnea, that Gill was so close to Tom and he’d know he had sleep apnea, the extremes Tom went to to save his relationship with Linda including pretending to be his Mom (!) spell GUILTY to me. When was the naughty app installed on Tom’s phone? Maybe Gill did that to make it look like the death was caused by something or someone else. I fully believe Tom is guilty.

That was a shock to hear they went to trial with no solid evidence. I was expecting to hear they found something else or that it was still an open case. What in the world were they thinking? We can't just go throwing people in prison based on headlights, drugs that weren't touched, and weird behavior. He is definitely suspicious, but there would be so many more false convictions if that were the case.

I did a double take when you mentioned Saugerties, NY. I live in this area and never heard of this case. I now kind of want to research local sources on this whole situation to see what was in the news at the time (if anything). We definitely don’t have a full picture of what happened. I have to wonder why the case was brought to trial with such weak circumstantial evidence. Ulster County is fairly rural, it isn’t as if there’s murder trials happening all the time. I lost my mom when I was young because of cancer and *I* have thoughts of ending things. I can’t imagine losing a parent in these circumstances. I can’t even imagine the pain that his son must’ve endured. That breaks my heart. I hope Gil suffers for the rest of his life. The life he doesn’t deserve to have.
The biggest tell I think is the Midazolam being in Tom’s autopsy report and Gil being in possession of that substance and him ADMITTING that he refills the jars when needed. Reasonable doubt? Sure. But the jury overlooking this piece of evidence is truly aggravating. Gil knows about his sleep apnea and he absolutely would’ve known what doses of Midazolam could injure or result in death could occur. I mean is it really that far fetched to put 2 and 2 together and realize that he’s responsible???!

He did say he refills the emergancy kits, and if he knew they'd find it, he would know to change a used vile of midazolam for an unused one, since he is incharge of refilling and it would be immediatly suspicious if there was even a slightly used vile in there. The car light shadow is pretty damning but there's no saying they were parked together just because they happened to be there at the same time and wanted to say hi. Not sure, I do lean more towards suspician though, he went to such weird lengths to break people up, and pretending to be your own mother or work for the cia, he was a bit screw loose about it.
I think Gil found out that Tom’s wife was going to stay with Tom. And I think that pushed him over the edge. Unfortunately, there just wasn’t enough evidence to convict him. Even though he got away with murder, I am very sure he will get put in his place when he arrives to the Pearly Gates!

I absolutely cannot STAND when someone cheats on their partner. Especially when a friend or someone you know knows that you are in a relationship or marriage with a specific person and they either try to flirt with your partner/spouse or actually sleeps with your partner/spouse.
It may be only circumstantial evidence, but I think Gil is guilty of the murder. He had access to the drugs, his fingerprints may have been wiped off the bottles. His car with the exact headlight scenario was at the scene of the crime at the right time, and of, course, he had motive in wanting to be with Linda. Sad that he did not face justice.
There is NO. definitive evidence that connects him to the crime. Zero. Just because he had an affair, or is a sh****y person, doesn’t mean he killed him. Of course there no finger prints in the emergency kit. It's exactly that, AN EMERGENCY KIT. As a dental assistant, in our state, we not only need an emergency kit, but also an epi pen. We have it just in case and in the past 10 years we've never had to use it. However, we HAVE to order a new one every year, because they expire. Hence, no one has had to open the kit. Meaning the medazepam he's using is from different bottle. No sane doctor would use their supply from their emergency kit, makes no sense. Did they check order invoices from the last month? We can't purchase it without his license number.
The saddest part about this case was his son took his life at 18! He was so happy when he was born! Linda will always live with this guilt and feel responsible for both of their deaths. I hope she knows it's not her fault. I didn't see the case, but do we know if there was a phone conversation with Tom and Gil the night before or early that morning? I think he was guilty, but there is room for doubt. Had they had something, just one thing to deal the deal, then that would've been great, but there was no DNA or finger prints. Still, I feel like he did do this to him.

I have a theory- the husband was also messing around with the other guy. I bet they met there in the back of that parking lot to fool around on many occasions. When the husband threatened to tell everyone that they had been intimate the other guy took him out. Or he just took him out to get him away from his wife. But I do believe they were doing more than just talking in that car. Which is why he didn’t care if the wife continued to see him. Which is why his pants were undone and seat laid back.

This case reminds me of the “Michelle “Shelly” Michael” case that took place (in part) at the WV hospital I was trained at back in 2005. I never knew the details beyond paralyzing the victim and setting his house on fire while he was still alive. We even reviewed the medication used in several of my classes since she had access to it as a pediatric nurse.
Tom passed on my birthday. I currently drive a Pathfinder(not back then) and I used to live in that area and would drive to Kingston to go to my dentist. I actually lived there during time of trial & didn’t know it bc I’ve never heard of this case.

A topic that you didn't mentioned. Drug, typically a drug for any doctor office drugs are tracked, did they checked from the time of death to the time any of this drugs got picked up from the doctors office by the disposal company.

I think Gil is a sociopath who love bombed them both and lured in Linda. He enjoyed the games he played to pull all of the strings and manipulate them. Then when Linda wised up, the game was over. His ego wouldn’t let anyone else win the game so he took out Tom and moved on. He’s the real monster to watch out for

In my opinion he did it because during the interview, he denied knowing about the medicine they were talking about but then he ends up having it in his office..?? So he went from “not knowing” to having 2 whole bottles in his office? Make it make sense…
The idea that he "didn't even know about the medication " was part of what got me. Every dentist knows what midazolam is and is used for. He's guilty and can never be charged again. Sad all around.
I do understand the not guilty verdict but I do believe that he was guilty of the murder of Tom. Even though he was the one having an affair with Tom’s wife I believe he knew deep down that it was Tom who Linda loved and he couldn’t take that. I can imagine him wanting Tom to be jealous of him.

I just don't understand how a drug only obtained by doctors and dentists AND his exact car being at the scene isn't enough evidence...??
That doesn't mean Gil used it or killed him. There's still reasonable doubt. You have to be able to put Gil in that car and that drug in his hand. They couldn't do that. No fingerprints on the bottles and they can't say for sure it was Gil in the SUV.

I believe he is guilty but I don’t think they presented enough evidence. I’m a nurse in Australia 🇦🇺 and work in a government run hospital and we have strict rules that we have to follow but I would think that in places like private dental practices the protocols would not be as strict

What a nightmare with these 3! Did they not see if Tom actually met up with anyone else or even got out of his car? As a nurse, versed is injected, which we usually use to sedate prior to intubating etc. Linda & Gil both had access. Just because none is missing doesn't mean they didn't take it from a patient or only used half on a patient etc. Also, if it was Gil, to inject him properly, I doubt Tom would allow it unless Gil lied & said it was an antibiotic etc. to treat who knows what. The prosecutor blew this whole case, and should of gathered more evidence or hired someone to do a little more investigating. Who knows how many patients any of these 2 was around to administer Versed and etc. It's not considered missing if it's prescribed to a patient and not fully used. Most meds are wasted as only certain amount is prescribed and the rest we waste in a toliet with a witness. They jumped the gun and now there is a murderer walking.
Wow Linda let this man in her life. Her husband and son dead because of her selfish decision. Even though what she did wasn’t illegal, it was definitely heartless. She’s guilty in this.
IMO Gill got away not with one but two murders. He killed his so-called best friend and his son who ended up killing himself over his father's death 💔 I know in the US at least if they found more evidence that pins him to Tom's murder, they can't re-trial him because double jeopardy laws which will keep him out of prison.
as someone from Kingston & ukster county, I can tell you from personal experience, the “proeffsionals” and police work here is always broken. Cases in this county, and area are rarely investigated appropriately. Police and investigators in this area are crooks, and families rarely receive justice. Kingston is practically the ghetto in half the parts these days, which is why I moved. Its terrible, and I cant explain how many cases go unsolved, or taken to court with minimal evidence.
What's absolutely appalling to me about this case is now he can't ever be charged..... He said himself that he "replaced" those things in the emergency kit..... Those poor kids have no dad now.... And I think he that Linda was going to stay with Tom and end their relationship.... Which I'm still trying to figure out how Tom could be so fine with their relationship..... I can't wrap my head around that.... Not my monkeys, not my circus.... But there's no way I could even forgive someone for cheating..... But that's just me..... Maybe all Tom ever wanted was his own family and that's why he stayed.... It's just a shame that the police and the DA went to court without enough evidence.... Because now he's gotten away with a murder he can never be charged for.....
The fact that a drug available to a doctor or dentist was found in Tom’s system, one known to have serious consequences for people with sleep apnea, that Gill was so close to Tom and he’d know he had sleep apnea, the extremes Tom went to to save his relationship with Linda including pretending to be his Mom (!) spell GUILTY to me. When was the naughty app installed on Tom’s phone? Maybe Gill did that to make it look like the death was caused by something or someone else. I fully believe Tom is guilty.

That was a shock to hear they went to trial with no solid evidence. I was expecting to hear they found something else or that it was still an open case. What in the world were they thinking? We can't just go throwing people in prison based on headlights, drugs that weren't touched, and weird behavior. He is definitely suspicious, but there would be so many more false convictions if that were the case.
No one should ever be murdered, but man, what a loss.

I did a double take when you mentioned Saugerties, NY. I live in this area and never heard of this case. I now kind of want to research local sources on this whole situation to see what was in the news at the time (if anything). We definitely don’t have a full picture of what happened. I have to wonder why the case was brought to trial with such weak circumstantial evidence. Ulster County is fairly rural, it isn’t as if there’s murder trials happening all the time. I wonder if that creep Gil is still living around here. Oof.
Definitely all kinds of crazy was going on here, husband letting wife date best friend, letting her decide who she chooses, Gil pretending to be CIA through Samantha. I feel like I heard about this case years ago, not on a podcast, one of the televised true crime shows. The theory was that Gil showed up in the gym parking lot, as shown on camera, that he had 2 coffees, the coffee for Tom was drugged. The pants unzipped is quite the conundrum. I lost my mom when I was young because of cancer and *I* have thoughts of ending things. I can’t imagine losing a parent in these circumstances. I can’t even imagine the pain that his son must’ve endured. That breaks my heart. I hope Gil suffers for the rest of his life. The life he doesn’t deserve to have.
why would they start a trial with practically no evidence? its not like he can be tried again if new evidence comes up.
The biggest tell I think is the Midazolam being in Tom’s autopsy report and Gil being in possession of that substance and him ADMITTING that he refills the jars when needed. Reasonable doubt? Sure. But the jury overlooking this piece of evidence is truly aggravating. Gil knows about his sleep apnea and he absolutely would’ve known what doses of Midazolam could injure or result in death could occur. I mean is it really that far fetched to put 2 and 2 together and realize that he’s responsible???!

He did say he refills the emergancy kits, and if he knew they'd find it, he would know to change a used vile of midazolam for an unused one, since he is incharge of refilling and it would be immediatly suspicious if there was even a slightly used vile in there. The car light shadow is pretty damning but there's no saying they were parked together just because they happened to be there at the same time and wanted to say hi. Not sure, I do lean more towards suspician though, he went to such weird lengths to break people up, and pretending to be your own mother or work for the cia, he was a bit screw loose about it.

I think Gil found out that Tom’s wife was going to stay with Tom. And I think that pushed him over the edge. Unfortunately, there just wasn’t enough evidence to convict him. Even though he got away with murder, I am very sure he will get put in his place when he arrives to the Pearly Gates!

I absolutely cannot STAND when someone cheats on their partner. Especially when a friend or someone you know knows that you are in a relationship or marriage with a specific person and they either try to flirt with your partner/spouse or actually sleeps with your partner/spouse.
It was gill. He replaced the entire emergency kit, which is why his fingerprints weren't there at all, even though they should have been.

It may be only circumstantial evidence, but I think Gil is guilty of the murder. He had access to the drugs, his fingerprints may have been wiped off the bottles. His car with the exact headlight scenario was at the scene of the crime at the right time, and of, course, he had motive in wanting to be with Linda. Sad that he did not face justice.

There is NO. definitive evidence that connects him to the crime. Zero. Just because he had an affair, or is a sh****y person, doesn’t mean he killed him. They shouldn’t have taken him to court without evidence. Why do you think he did it? What would your argument be? There was zero evidence tying him to the case. He shouldn’t have been taken to trial. He may have a crappy person, but that doesn’t mean he committed murder. I can believe she wasn’t sure, there was zero evidence . Personal opinions are one thing, but you can’t take someone to trial because of a feeling.
Of course there no finger prints in the emergency kit. It's exactly that, AN EMERGENCY KIT. As a dental assistant, in our state, we not only need an emergency kit, but also an epi pen. We have it just in case and in the past 10 years we've never had to use it. However, we HAVE to order a new one every year, because they expire. Hence, no one has had to open the kit. Meaning the medazepam he's using is from different bottle. No sane doctor would use their supply from their emergency kit, makes no sense. Did they check order invoices from the last month? We can't purchase it without his license number.
The saddest part about this case was his son took his life at 18! He was so happy when he was born! Linda will always live with this guilt and feel responsible for both of their deaths. I hope she knows it's not her fault.
I didn't see the case, but do we know if there was a phone conversation with Tom and Gil the night before or early that morning? I think he was guilty, but there is room for doubt. Had they had something, just one thing to deal the deal, then that would've been great, but there was no DNA or finger prints. Still, I feel like he did do this to him.

I have a theory- the husband was also messing around with the other guy. I bet they met there in the back of that parking lot to fool around on many occasions. When the husband threatened to tell everyone that they had been intimate the other guy took him out. Or he just took him out to get him away from his wife. But I do believe they were doing more than just talking in that car. Which is why he didn’t care if the wife continued to see him. Which is why his pants were undone and seat laid back.

This case reminds me of the “Michelle “Shelly” Michael” case that took place (in part) at the WV hospital I was trained at back in 2005. I never knew the details beyond paralyzing the victim and setting his house on fire while he was still alive. We even reviewed the medication used in several of my classes since she had access to it as a pediatric nurse.

Tom passed on my birthday. I currently drive a Pathfinder(not back then) and I used to live in that area and would drive to Kingston to go to my dentist. I actually lived there during time of trial & didn’t know it bc I’ve never heard of this case.
I agree with the prosecution that it would be a crazy coincidence that if it weren’t Gil it would be someone who drove the same car, with the same light pattern, who also had access to midazolam 🤔 also he sold his car weeks after? SUS.
I use factor and the meals are bomb! You can select the meals you want out of a whole menu. I personally buy some for the week and freeze some meals for the next week

Drug, typically a drug for any doctor office drugs are tracked, did they checked from the time of death to the time any of this drugs got picked up from the doctors office by the disposal company.
They took that to trial with barely any physical evidence… but I believe Gil is guilty!
