    Happened to me in 21. They tried to state ref me for my powerstroke. I live in Texas. I just told them good luck with all that. I left three days later and was done with my trip to CA. Sent me a “official” letter. I just called and told them to do what they thought they needed to, and was told my truck would be on a list to find and do whatever they do. I said well if you find it in California it’s been stolen.

      Ohio tried some crap with me yrs back when I was passing thru. They took my license and told me once I saw the judge and paid the fine I could get it back.
      Few days later I'm back home in texas and called dps.
      She told me come up there,get a replacement and said in nice way...they dont care what Ohio thinks,they can't do anything about it unless I go back to Ohio.
      30 yrs later and nothing has ever come of it. Texas really doesn't care about other states garbage...lol.

      I had a cop pull me over in Michigan. Many years ago.
      Because of window tint on my side windows and he said he couldn't see inside while he was driving the other way.
      I told him if he looked at my plate before pulling me over. You would have seen it's a Florida state tag.
      He proceeded to give my information back and let me go.
      This was 24ish years ago. Lol

    As a car repair technician, my Alldata app will ask me, "for use in California" on many parts. Semi trucks are also NOT exempt from the Cali emissions related rules. It's BS dude 😢

    Welcome to the "Gotcha" state. They've been doing this to gun owners for years. Federal law allows people to purchase firearms in states adjoining their home state as long as they comply with all federal laws and the laws of the state where the sale takes place. California allows people to bring their personal firearms into the state with them as long as they are types legal to possess in California. However, a California resident purchasing a firearm out of state and bringing it home is committing a felony. They actually send police to check plates at out of state gun shows to create a hot list of cars to stop and search if they spot them on the return trip. Meanwhile, dopers shooting up on the sidewalk are not an enforcement priority. I moved to the Philippines. A well run third world country is a *HUGE* improvement.

    This is from the California DMV website regarding military personnel "If you are on active duty you may operate a commercial vehicle owned by you without obtaining California registration provided the vehicle has valid registration in your home state or the state of military assignment at the time of registration, and is not used in a trade or business"

      Right but im not sure how that affected my situation. Per the california law. Any registered vehicle in the entire united must abide by all emmission laws for California prior to entering. The only thing that prevented me from not having to fix my car was the judge. I got lucky.

      It is based on where the car is registered at. It doesn't matter if Cali has smog or not. If your state does not require it then you can drive it in all 50 states. If that was the case then there will be smog station at the boarder of Cali when entering. People forget this is a free country and we are able to travel freely. @@Hardwaretuned

      ​@moosejaw50 no infact we were required to get a smog check to get our gate pass for FT Irwin for vehicles not registered in CA (and that was I think back in 98) . I even had to pay the 300 impact fee they had back then when I registered my mustang I bought while stationed in KS. CA doesn't care about military members.

    My first and only visit to Cali was 20 years ago, we crossed into Cali from Arizona to go to the dunes and were literally ( zero exaggeration ) less than ONE mile into Cali when we were pulled over by a State Trooper in 100 degree heat(me, wife, 3 year old son) and hassled for an HOUR on the side of the road over window tint that was legal in Az., but not in Cali. We finally agreed i'd roll my windows completely down, open the rear sliding glass and immediately U turn and drive back to the Az state line, followed by him.Which we did - and I have NEVER gone back to that hell hole and never will .

      Reciprocity. It's a thing. They'll hassle you about it but have no LEGAL standing. If it's legal in your state, it's legal in theirs until you're a resident or employed in California. I've lived in NV my whole life and have "Limo Tint" on my rear windows. Only once did a CA CHPie try to give me crap about it. All I had to say was "Reciprocity, Chapter 12 of your states vehicle code, look it up."

    I registered my car in Tennessee as I have a TN driver license and insurance. Cops are cracking down because people have cars registered in South Dakota or Montana but with California drivers license. I got state ref (Long Beach) when I had my car registered in Cali. I went to court and all the judge asked was my problems corrected. I told him yes and then they dismissed my ticket.

      @@metalbeast83 Yea, it got worse back in 2020 I think. It was voted on to make the emission laws really strict. That's why most companies don't mail illegal emissions parts to Cali. They haven't pulled me over yet, but I'm waiting. I am ready. They can't do anything to out of state cars as my state doesn't require smog or emissions inspection.

    OK. I'm a Californian. I have been here a very long time. San Diego. I can tell you this: Everyday a flood of cars and trucks cross North from Mexico in to CA. They have little to NO emissions equipment. Too often belching over-rich mixtures from a.lack of maintenance or equipment. Sitting behind these vehicles in traffic makes your eyes burn and can give you a head ache. They NEVER get pulled over (for emissions). I had a chance once to speak off the record with a career CA Highway Patrol Officer (remember haters this is just one guy...) and asked about this issue. He told me if he pulls me over and issues a citation, there is a good chance I will show up on the court date and either pay the fine, fix the car or both. The implication was the other folks would not so what was the point(?). It still grinds on be to this day. How can CA leadership think that weather born emissions magically stop at state and country boarders? My state has lost all common sense.

      Difference is those Mexican cars bring in workers that make $ for people who don't want to pay US wages (which are already bad).
      Meanwhile pulling over well done tuned cars that aren't breaking traffic laws is also about making money.

      Can we not point out unjust laws and regulations without making people with actual identity issues a joke? I’ve seen this same comment basically all down this thread and it just takes away from the real issue. No one wants to support people that like to make others live the way they think they should, and so when you see that the people complaining about laws like this are the same people making the same tired jokes at the expense of the most vulnerable people in society, people are going to focus on that instead of the actual, legitimate issue raised. It’s just human nature, fair or unfair.
      So if you can’t control your human nature to ‘other’ fellow citizens, others aren’t going to control their human nature to preemptively decide anything you have to say is just as unintelligent, and nothing changes. This was really messed up and if a state wants to treat visitors this way, people need to know so they stop visiting. Idk if it’s worse or better than my state that basically bends over backwards for visitors at the expense of the locals. Two different extremes I guess. But nothing can change if people don’t learn about it and people won’t learn about it if the people that are bringing the issue up are the same people that think it’s hilarious to beat a dead horse, making the same jokes for well over a decade, and putting people down for absolutely no reason. If you are a dick to others why should anyone care that cops are dicks to you?

I never gave a f#ck what their "orientation" was, until they decided to get all militant about it and act as outrageously as possible to provoke a response. Children don't need to be exposed to this, but these creatures tend not to be breeders, so I wouldn't expect them to understand that.     First thing I noticed when I moved from California to the Midwest was the cops in the Midwest were actually pretty mellow. One actually held the door open for me while I was coming out of a convenience store and he was going in, that never happened to me when I lived in Cali, I lived there for the first 32 years of my life. That was 27 years ago and I’ve been in enjoying freedom ever since. ☮️🇺🇸

    I admittedly was riding dirty in SoCal for nearly 10 years. I was pulled over 2 times, but the officers were cool and never asked to see under my hood. Until the 3rd time. He did a U-turn in the middle of the road like he was a stunt driver on _'Dukes of Hazzard'_ and pulled me over because he heard by BOV and exhaust. But I had a Trump Card; I was moving east in 5 days. I showed him my vehicle transport invoice and moving company invoice, then he had the nerve to ask me (like it was going to help him) _"Does that state have a referee like CA?..."_ Bro. 😑 He let me go and said, _"I'd better not see this car on the roads after this date."_ I just said, _"You won't."_ I had a great time in CA, but it's the WORST for car enthusiasts.

    I just researched the issue. California's regulations provide exceptions for out-of-state vehicles which are just "passing through." However, some local authorities enforce unreasonable standards for what constitutes "passing through."

      I look it up on Google and there's no definite reason.I've got California law.I know if you got a license.You can drive anywhere in the country and every state have.Your vehicle is registered past inspection.You should be able to drive it anywhere in the united.They're just looking for revenue

    You should check with another lawyer. Requiring all cars to meet CA regs is illogical, even bone stock cars from other states were/are built to different emissions standards. If that was true any bone stock car with out of state plates would be eligible for ticketing.

      Well, hate to tell you this although it is listed in California's vehicle code, it's a federal law..... Hate to tell you, but Arizona and Texas is in the United States.... If a state chooses to actively enforce it, they can the same if they choose not to...... Act stupid, get stupid reward.... It's that simple. We also know that no shop in California would install that exhaust system.....if your out of state, the shop either gave you a written doc from the mfg or stated on the receipt it was illegal. So let's not play the I didn't know it or they just started enforcing it..... It's been this way since the late 1970's.......

    According to CA law, the emissions rules only apply to cars being registered in CA.
    On the other hand, CA’s 95db limit on exhaust noise applies to ALL vehicles, regardless of the state of registration.

    Contest in court, it'll get tossed out as state ref tickets only applies to cars registered in CA. If you're visiting CA for a short period of time then you should be fine.

      Technically you have to comply with your home state emissions but CA can’t really enforce those in you because your home state laws aren’t enforceable by other states.

    I am from California and needed to go to do a presentation in Lassen County. I rented a car in Reno and drove over to Lassen County. I was driving a car that had Nevada plates on it. I was driving about 10 over the limit on a two lane highway. I passed a CHP going the opposite direction. He didn’t turn around right away but I saw he did eventually turn around and flip on his lights. By now he was several miles behind me. When I felt he was close enough and there was a safe place I pulled over and shutoff the ignition, opened the windows and kept both hands on the wheel. He went through the usual spiel. Then he looked at my license and rental agreement and said, “oh you’re from California.” It was at that moment that I realized I most likely got pulled over because I had Nevada plates and this was his M.O.. Yes I broke the basic speed law and was driving over the limit. However, lesson learned, I now check the plates on the car I rent and will only drive one with the state plates for the state I am in. Flash forward several years and I was driving the same stretch of road and saw the CHP pulled over another car with Nevada plates. Bottom line - I drive slower and check the plates before I drive out of the rental lot.

    When I lived in Oceanside they would wait till some marines are about to get stationed elsewhere to pull them over and have them state ref'ed. causing a huge headache. I moved away to Arizona but it looks like its gotten worse out there.

I feel you though, I bought a 3v when I first got stationed here (had to sell it due to health reasons) but was always worried the cops would try to pull something like this. I have my whole driveway registered in TN now. Keep us updated on the outcome, I just put an obnoxious exhaust on the daily 💀

    Of course it's more necessary to pull over cars. The poor and homeless that are robbing Harbor Freight dont have money to pay for a ticket. These states are hemorrhaging money. Law enforcement has to come up with the money somehow. Especially when some departments are having budget cuts.

    Why the hell do people think they don’t need to learn local laws before they travel somewhere else? Your home state has nothing to do with California law or federal law. They are under no obligation to recognize your registration, or drivers license. If one state makes it legal to drink at 18, that doesn’t mean it’s legal for an 18 year old from that state to drink at 18 in any other state. That’s what happens in a country that believes in strong “states rights.” They can do whatever they hell they want that’s not explicitly illegal under federal law. You aren’t a resident of that state, you don’t vote in that state, so your opinion doesn’t matter in that state. You aren’t doing anything to change the law in that state, you just want to whine you got caught breaking their laws. This is exactly why truck drivers often don’t go to California. Their truck is not legal in California, so they just stay out. Now you know not to move there. I know I wouldn’t want to move there 😂

    Very concerned my 2010 F350 DRW 6.4 diesel has been deleted (the emissions package killed them quick) , which is used to haul a truck camper and trailer, will get pulled over down there. I'm from an area in Oregon that does not test. Mostly concerned they would force me to have the whole combination trailered out of their State.

    It’s illegal ( a misdemeanor ) to modify any exhaust as to make it louder than stock or defeat the emissions equipment in this state. California simply hates taxpayers. New laws are now aimed at motorhomes entering the state being smog tested while tourism by said motorhome owners is a big business. California has simply become the FU state more interested in making regulations and causing higher prices while making it harder for people to visit and businesses to stay in business. I don’t understand their reasoning behind shooting themselves in the foot with overregulation of businesses that draw tourism and the deterrence of the tourists to come and spend money ENJOYABLY in the state.

      An RV is usually just driven to a destination and parked for an extended period of time. Not used to commute and hardly needs to be closely regulated for emissions. Carb and the EPA need to have their budgets cut to the same percentage emissions have dropped.

      @@Hardwaretuned well if your lawyer is worth anything he'll bring that up that the cop is being subjective and is not able to differentiate between 95db and 96db. Unless they have concrete testing to prove your car is more than 95db the judge should throw out the case.

    When I did an engine swap on my 2005 mustang I had to provide documents that stated it met California emissions standards to pass MA state inspections. California must be God in disguise.

    If it just has to pass emmission standards then stopping at the 1st smog test station & passing will satisfy that requirement. Just smog test it which means no obdll fails & you're good to go. Or is there more to it? Like a legal inspection certification from the DMV?

    I left the state many years ago, but when I first moved there, I had a year-old pickup. Even though it passed smog with flying colors on par with vehicles with CA emissions packages and certainly better numbers that many long time CA registered vehicles, I got hit with a $300 penalty when I went to register with DMV. Reason given was my truck wasn’t manufactured to meet PRC emissions. I guess I was lucky I had over 12k miles on the odometer because I’d talked to others who moved with newer cars with less than 12k who went to register got hit with CA sales tax for “buying a car out of state” even though they weren’t a CA resident at the time even though they’d paid it in their previous home state. That was in the early 90s. I think perhaps it’s time for car enthusiasts and self defense rights supporters to combine their efforts and create a stronger political movement and vote with authority. I’d rather hear a Coyote’s musical exhaust than I would profanity from a loud car stereo. Though driving is a privilege in all 50 states, cars are still property. I recall one CA state police agency back in the 90s that once received the title, “misdemeanor cops in a felony world.” Sounds like the title has spread.

    They tried that on me back when i was stationed in whidbey and drove up LA to see family what the lawyer told you isn't what i was told due to its been settled by the Supreme Court that as long as the car is legal in the state that it is registered no other state has the right to counter act that so i had a $25 fix it ticket the Court charged me but hey that was also 2018 now I'm in Florida and they really only care about how loud your music is

    California Motor Vehicle Code does specify how many decibels at what distance regarding noise. This is not an "emissions" check requiring you to adjust your smog. If you have a loud, exhaust disturbing others with your noise you can get pulled over.

    Doesn’t matter what state you’re from. You have to comply with the local state. I drove a semi into California. Got flagged by Prius from CARB at the state line. Long story short, $13k in fines. Because too much soot at the exhaust. Done with that state!

    Sorry to hear about your troubles. I interprete the California law as saying if your out of state car does not meet California emissions and vehicular code, consider not bringing it into the state, or by all means visit California by car if you drive a car that passes California standards. That's a state's right to.demand this. Cops have told me that sideshows are a huge problem for various parts of the state and so they are more vigilant and sensitive about certain types of cars because of that reason. Clearly you are being caught in the middle of these issues. Hope everything works out well for you.

    Dude, Australia has way harsh laws than California. If you get pulled over with any non-standard part fitted to your car you can be fined! They will fine you if your window washer bottle is too low, if they literally cannot get you for anything else? If you stop and lock your car and go into the woods or on private property there will be a fine slapped on your wind screen with a sticky back so they make sure it won't blow away in the wind and it will be addressed to the owner of the car!
    I drove my mate's parents Toyota Altize Camry and the police will do a full lock down blocking every single road and mass impounding of cars even if you aren't doing anything wrong? Your parked up with your car and hood open like a mini private car show and Nek Minnet coppers fucken everywhere. Dude's with their mod 4x4s simply take plates off and drive over traffic island to get away.
    You'll be lucky to come away from the car meeting with anything less that $2.5k in fines.
    Me.....I fucken locked the car and got my friends parents to come pick us up. They wrote a ticket for low washer fluid and they didn't even test the car to make sure? I got my friends parents to write to the police saying they parked in a public carpark and left their car there overnight and why were they receiving the fine? They didn't want to do it so I typed it all for them and threatened the police with court action if they didn't dismiss the infringement within 28 days. The cops deleted by the fine end of story.I wanted to exposes their BS in the court system!

    I had the same experience. I was looking for a video like this. We are in the same area and the cop started with the loud exhaust thing. And I knew right away, those kids shutting down intersections got them on a mission, they are going after anything that looks modified.

    Federal laws requiring all states to accept another states registered vehicles (if they are legal in your home state) trumps CA’s unconstitutional BS. If you are a private vehicle, they have no say.

    My 2005 mustang shoots flames out the exhaust and I haven't got a state ref ticket yet but as soon as I take my G37 which is completely stock I get pulled over 😂

    Per the interstate commerce clause, the cops are 100% wrong. Highway laws apply to the residents of the state. It's unconstitutional to apply this law to someone from out of state, or from out of the country that is traveling. Anyway, never go to California. Ever. For any reason. Or Florida.

    I don’t have a driver’s license because I don’t drive. A cop told me that I MUST get a state-issued ID, or I can be arrested for not having a valid ID out in public. My passport card that I carry with me is not sufficient in his opinion to be used as ID in my state.

      Well even in my situation I’m not getting my car smogged. I know what I’m going to do with my car and going to keep that to myself for the time being. I’m out of state I don’t smog here in California. The only time I would ever need to smog is if I fix my car and have the state ref pass it. The car will get some quiet mufflers.

    What about your 14th amendment right? That ticket denies your right to travel.
    (1) the right to enter one state and leave another (an inherent right with historical support from the Articles of Confederation),
    (2) the right to be treated as a welcome visitor rather than a hostile stranger (protected by the "Privileges and Immunities" clause in Article IV, § 2),
    I'm guessing your in the navy, that means you have no requirement to change the registration or your license due to duty assignment.

      Not so. He has a legally registered vehicle in his home state and also has a valid license. One is not anything like the other. CA can't decide to restrict people from other states travelling into or threw. It's one damn country.

      Articles of Confederation are not a legal document, but the bill of rights which the 14th amendment is. If someone takes this to court rather than roll over it will not pass legal muster and get thrown out. This isn't some nutty sovereign citizen crap, it's your rights. @@Kdubz_Auto_HVAC

    @2:11 how did you answer the question of how many days have you been there? because they have a 10 day law, requiring you to register and change your driver's license. Not saying it's right but it's one of those that have not been challenged and ruled unconstitutional obviously.

      So I will say this was told to me but I have to see it I’m writing. Once I see the law on paper then I’ll fully believe that is the case. I do believe there is still some misinformation being passed around and I’m trying to find the best sources for that information without fishing through an entire book of state laws

      Depends what county you live in. Some cities and counties suck in Ca. for built cars. And if you talk back they will get the one officer who knows all the laws and hammer you. There are a few guys that show up at cars and coffee that have cars registered outside Ca. to get around smog laws. I haven't heard any of them say this has happened to them. Funny they always go after cars that are loud but don't care about motorcycles that are twice as loud. If you drive a Mustang or a Charger/Challenger in my area you will get followed.

I got a state ref in LA while pumping gas 😂 I stood as long as I can I was there for about an hour and a half but they wouldn’t leave so I just started the car and immediately 5 squad cars pulled up and 2 of them with their guns out. I left LA though I’m in Kern County now and have been pulled over with the same exact set up but they always just hit me with “stay safe”. So far 1 cop has mentioned the loud exhaust but all they said was get it fixed. I drive by the sheriffs station 4 times a day every single day and there’s ALWAYS a squad car there hiding but he has never pulled me over
