    I don’t have a party wall, but have a driveway adjacent to a neighbour. The driveway has a concrete beading along it and a fence next to it. My neighbour claims the concrete beading is his even though the small fence is on his side of the beading. Does the fence supersede the beading as a boundary - as i want to re do my driveway?

    Just thinking about what has been described here, if you want to make some changes on the wall where you need consent, and have a neighbour that has decided to be as difficult as possible for whatever reason, all they need to do to prevent your works, is to not agree to the works, and not agree to a single survayer, then find the most expensive survayor possible, as you are the one wanting to do the work, so have to pay for both survayors. What if they have a mate who does it for a living and will charge 5 times the typical rate as a favour to them? How would you go about setting this right?

    Useful Daniel but what if the Party Walls Act is ignored by both of the neighbours and the neighbour not doing the work consents having seen plans and only objects some weeks/ months after the work has been completed and never raised any objections during the work that took several weeks to complete?

      If you can prove they changed their mind after you had agreed (and then spent money doing the work) you can sue them for propriety estoppel - which means, if the work has to be undone then they have to pay ALL your costs and the cost of restoring the property to its ‘before’ condition. This is because they caused you to spend monies AFTER giving their agreement, so all remedial works should be on them… you may need some legal advice before pursuing this route (your home insurance will probably have a helpline…)

    I swear whenever I come across neighbour disputes, both neighbours are usually insufferable.
