I'm so glad somebody out here has objectivity! It makes perfect sense that if he had encountered bad checks before that he would use "good check" to let everybody know that bad checks would be an immediate contract breach.

It's illegal to sell something you don't own! JJ has saved others for falling into this scam by outing this defendant
Nothing illegal about what he did, it's quite common. The defendant basically makes deals with homeowners that want to sell their homes, he find the buyer and then act as a mediator, usually getting a percentage or a fixed amount of the final sale price. The homeowners could get a realtor, the issue is that these houses are usually in very bad shape and realtors won't bother with them, so that's where the defendant comes in and finds people that either want a fixer upper or a flipper like the Plaintiff.

@@JetstreamTheSexSam Yes you can. There are different levels of 'ownership'. But from a fundamental level think of it like this... have you ever financed a car? When you did, was it insured? You would have usually been required to insure the vehicle at certain limits as per the financing agreement. Because technically, you don't "own" the vehicle. The bank does until the loan's been paid. THEN you get the title and can - depending on your state - even remove the insurance. When you buy a house, unless you own it outright (deed in hand), typically you NEED to have HO insurance to protect the asset of the mortgage firm. BUT none of that means you cannot sell the property. Car or house. Happens every day. The devil's in the details of the definitions. This is a super fast example and it's more complex but you get the idea. For example it gets tricky if you owe more than you can sell it for (short sale), etc.
For example, obviously, you can legally sell something you don't technically own if you have been granted permission to sell. Likewise, you cannot illegally sell something you don't technically own if you haven't been explicitly granted permission to do so. I think a lot of people miss some of these details because they simply never read the contracts they sign and think: "Eh, it's just the way it works." But I STRONGLY advise people to READ what they sign.

In real estate mediation, a neutral third party assists in negotiating a mutually acceptable deal. Mediators do not make decisions but instead help the parties make their own agreement by clarifying issues, utilizing persuasion, and employing other conflict resolution strategies and techniques. If you look at contract the name of the seller is on it, not the defendants, he just mediated the purchase of the property, it's the same thing as a real estate agent, they also don't hold the title< I think you meant deed but can mediate a sale between parties.

It's the same thing behind brokering, completely legal (unless it's an industry where brokerage is regulated like insurance, mortgages, etc) ...or another way to look at it is as a finders fee. People saying you can't sell what you don't own aren't understanding the situation, or are just choosing not to understand so they can hate on someone who found an angel to make money.

This sounds like a wholesaling transaction. Defendant found a good flip deal and contracts to purchase from seller. Defendant then assigns that sales contract to the plaintiff for a wholesaling fee (eg $5000). Rather than a simple assignment, it sounds like they wanted to do a double close: defendant closes with seller, and then plaintiff immediately closes a new sale with defendant for a few thousand dollars more than first sale. Plaintiff gets property to rehab and flip. Defendant gets a few thousand in income without the risk of the reno. Their paperwork is very shoddy though.

This is called wholesaling in the real estate world. As an investor, it is quite a headache dealing with wholesalers, because they act as if they are buying the property from the seller, and then sell the contract to someone else, for a "finders fee," essentially. It is legal, just another hand in the pot.

For those who doesn’t know. He is a wholesaler. The (defendant) wholesaler is the one who finds the house and basically seals the deal with the homeowner. Once deal is sealed, he has to find a buyer who will actually be purchasing the home (plaintiff). So contract to buy gets signed to the defendant and defendant gives a contract to sell the house to the plaintiff. It’s not illegal. He’s just like a broker. The 5000 is just what he got for his work. It takes a long time to find the house and make deals and actually close the deal .

He's just assigning his rights to the property or assigning the contract. Its not a scam and not illegal. Title companies and attorneys close these kinds of deals everyday.
