This is all done by the executive, the legislative branch doesn't create the regulations and the judicial branch has no involvement in the decision to punish you. Checks and balances my ass.

In any case the principles that underlined those ideals had been the cause of real infighting in britain the century before. And selfish fighting for material resources is still better than fighting for the blood or soil.
