      At the end of the day, no lights and she sat in the car. He probably wouldn’t have seen it if he was looking straight it looks so dark. He would’ve crashed one way or another people need to know to exit the vehicle.
      But at the same time he guaranteed was playing with his phone so there comeback is gonna be if you would’ve not been on your phone he probably could’ve reacted a little different

      100% truck driver’s fault. Look at the road while driving. Had the driver been looking where he was going he could have at least slowed down. He was breaking the law while driving. Should be charged with manslaughter. Say whatever you want, professional truck drivers are few and far between. Even truck drivers that will own their mistakes or their actions are few and far between.
      There but for the grace of God there go I. I’ve done the exact same thing, been lucky.

      Interesting, I am not a truck driver unless you consider an SUV a truck. The other day on I-290 in Amherst, New York (Buffalo area), I witnessed a very new appearing midsize BMW SUV stopped dead in the right lane of a three-lane highway. There was plenty of shoulder just to the right for his vehicle to pull over to, but the driver stopped right in the right travel lane. Fortunately, a State Farm sponsored help truck pulled up behind the vehicle with its large arrow sign warning drivers to more around the stalled SUV. I saw no damage to the SUV and I wondered why the driver didn't pull onto the shoulder as the vehicle was stalling out. The shoulder was literally adjacent to the travel lane. Are some very high-tech vehicles death traps? Do the steering wheel and brakes lock when the engine fails? Anyone know? I have heard some more expensive vehicles are literally accidents waiting to happen.

I recall a case where the driver of a car was parked perpendicular to interstate 81 at night south of Syracuse, New York. The automobile driver was heavily impaired by alcohol and caused a mass casualty bus accident.

      True, but I had an electronic failure in a 2005 Caravan one time that completely disable everything including all electrical.. Very scary but I was on a busy street in the broad daylight so I was fortunate as the cops helped me push it to the side that time.

    the woman thought is was a good idea to stop in the middle of the road, turn off all the lights, & just sit there in the dark.

      Hate to say it, but she's wrong. Truckers are stupid. Stupid for putting up with all the BS. Stupid for risking their lives for low pay and long hours.       Best thing I did was get into a different line of work after a dozen years. Still miss it though. 😏

      Look, I'll be the first to say I hate you guys. And this is why. It may not pertain to all of you, but I've driven to Lexington, Virginia numerous times on I-81 and hate when truckers take up both the right and left lanes doing 40mph trying to pass each other while me and other drivers are driving significantly faster hoping to get to our destination a little quicker. I've seen the same thing happen on my way out to Fort Knox, Kentucky just recently. Now I don't actually hate you guys. You have a difficult job trying to keep that behemoth between the lines and also dealing with idiots who drive 30mph in the left lane. Most, in fact a lot of you guys are very professional and handle your semi's with NASCAR precision. But all in all, this guy is not at fault by no means.     For anybody who thinks it’s the truck driver or both peoples fault: the video shows a total of 4 seconds and is heavily slowed down. Also keep in mind that those cameras often detect more than a human eye can at night.
    The accident happens after just 1.5 seconds of footage. At that speed it means we only see 150 feet of footage. You can’t tell if he is looking at the road or not, but 1.5 seconds not looking ahead is not weird. Nobody looks 100% of the time forward.
    This is like saying a driver is also at fault when hitting a deer standing in the road. It’s not. Once you notice, there ain’t nothing you can do about it.

      When you work for a mega carrier, you should be prepared or expect this type of behavior. You’re a number, and if that number gets involved in an accident. They remove that number and replace it with a new number. Keep making mega carriers money and see what good it does for the industry.

      To some extent yes you're right but with the new technology with cameras on board proves a whole different scenario now you can see who's at fault and who's not and in this case you could clearly see and tell the driver which is a JB Hunt driver was at fault for not looking forward in paying attention

      You have to have an alarm to tell you that you are low on gas?
      If you can’t check your gauge once in a while and fill the tank before you get down to 1/4 tank, turn in your driver’s license and get off the road!

      Legally, the driver is not in any criminal trouble, but his company can be sued financially depending on how accurate his logs are and having video of a headset on his head which makes distracted driving a little harder to argue. The driver getting fired might be a good thing.

    The other issue is Law Enforcement always tells you to stay in the disabled vehicle. I watched people burn to death by doing that. Make the disabled vehicle visible. If you can't, then get to a safe distance from the soon to be wreckage. Not in the Jeep as a sitting duck.

    I'm a retired school bus driver. We face many of the same issues as truckers, but we have the added factor of our "cargo" yelling, running around, throwing stuff, etc. We used to speak of the two iron-clad rules of school bus driving.
    Rule #1- Whenever something bad happens, it's always the bus driver's fault.
    Rule #2- Whenever something bad happens, and there is incontrovertible PROOF that it's not the bus driver's fault, see rule #1.

      It's no wonder that scores of school districts have trouble getting drivers. Getting a CDL is problem enough but that kind of treatment will turn candidates away in droves. The school district nearest to me has had the principal being a driver for two years so far. No one wants the jobs.

      I’m a retired coach driver, my oldest daughter said to me that since I’m retired now that I should drive school bus. I said driving a bus load of kids is a bad as driving a bus load of drunks, the only difference with kids is I can’t threaten kids if they don’t settle down I put them off the bus.
      Plus the fact that you have them stupid cameras now watching the drivers every move.

    As a police officer and former truck driver, based on the clip you provide, I would say that both drivers are at fault for the accident. The Jeep does not belong in the road, and if it ran out of gas it would have coasted enough to get onto the shoulder (yes, a lack of power steering would have hampered that but it should have been on the shoulder). But the driver also takes no visible evasive action, even when the Jeep should have been visible in his headlights. Unfortunately, Texas uses the concept of proportional liability so each vehicle that contributed to the accident has some responsibility for the damages. My personal opinion, again just based on what you show, would put the responsibility at between 60 and 75% on the Jeep and the remaining 25 to 40% on the trucker.
    Also, in your clip I do not see any distracted driving. The driver is just steering the truck down the road until he suddenly ducks from the unexpected impact as it is about to happen.

      I agree with Steven's statement. Both parties are at fault. The driver of Jeep made a bad decision to turn off lights. The JB driver should have seen the jeep in time to at least minimize impact by attempting to change lanes. The fault is 70/30, Jeep impeding right of way. Reverse the vehicles, and it would be 90/10, truck. Truck has more safety equipment to set out yo help prevent the accident.

      As a truck driver myself even if you are looking straight ahead by the time that dark vehicle in pitch black came into his line of sight via his headlights it was already to late. And the only person to blame is the 4 wheeler who thought it would be best to stop on the fukn highway in the middle of the night us truckers need protection from idiots like that. But at the same time my heart goes out to the family who lost loved ones.

    Any good lawyer would blow this ridiculous lawsuit out of the water and the woman that stopped on the road that run out of gas would be charged and her insurance company for damages to the truck. If that were a semi, he would be at fault we’re stopping on the road in a travel lane. This woman could have coasted off the side of the road when her car stopped running and definitely should’ve turned her flashers on it, did they check to see if she was on the phone or distracted in anyway? Don’t matter if the guy was on the phone or not ( which I don’t think he was ) but maybe he was. She was still in the wrong for parking her car in a travel lane, and especially after dark.

      It's hard to tell, but to me it looks like he might be looking down before the crash. Also, was he going over the speed limit? Don't want to blame a fellow truck driver, but if he was looking down, and if he was speeding, that's what did him in.
      As for the lady, I feel bad, but as someone else mentioned, Darwin Award winner. Like that idiot on the scooter a few weeks back that got in front of a truck without getting into the drivers line of sight, and then got run over.

      Wouldn't have made a difference if he was locked on like a hawk. For as close as the car came into view, he had no chance of avoiding a collision. This is what I hate the most about the laws in the US, especially around truck drivers -- it's all a bunch of arbitrary "shoulda, coulda, woulda" bullshit.     As someone who's vehicle just quit on the highway in rush hour traffic in the hammer lane. I can say without a doubt. That it was a truck driver who came to my rescue. He literally pulled up behind me and stayed behind me while I got out of my car and found the problem and was able to get my car going again. I was terrified and I honestly believe that driver saved my life that day. I never got to know who it was in the truck or thank them. However I am extremely grateful for that driver. This incident is sad and I pray that the driver is shown mercy for all the good they do and never get credit for and for all I know this same driver could be the one that protected me with his truck on that fateful day just a few years ago. God bless you driver's and know that for all the hate you receive you are just as much loved.

    He looks like he is watching a video on his phone. You got to look at the road, especially at night. I came across 2 people kneeling on the middle of I-81 southbound in Scranton, Pennsylvania at midnight. They were praying on the right lane. I was able to stop in time

    As a retired accident investigator, I can tell you that a driver who hits a stationary object on the freeway is typically found at fault. If they can't see past their headlights, they need to adjust their speed and elongate their visual horizon. This at-fault would even apply to a tire in the middle of the road which is way harder to see than a stopped vehicle. The Jeep has reflectors for a safety reason on the front, sides, and rear. The reflectors were not broken, were they? They reflect light for hundreds of feet.
    For the sake of argument, let's say she had stopped due to a sudden mechanical failure and couldn't move to the side of the road. The failure affected her electrical systems too. So the only thing that she had would have is reflectors. Would she be at fault then? No. The same reasoning applies to this accident. The reflectors were working, I assume. And the driver of the truck had his headlights properly aimed?
    That's the way the law works for a truck driver he's hit from behind too.

      I rear ended a disabled car on an interstate at night. Center lane, No lights, no flashers, nothing. I caught the blame and the cost for all of it, including a citation for “following too close” 😂😂 Atlanta PD!! and an out of court 💵 settlement with my insurance company. Most ridiculous, expensive load of bullshit in my life !!!!

    You are the professional! It's called Defensive driving! No matter what happens, their always going to say, it's the truck drivers fault! Period!! But if you have those dashcams in your truck it helps in providing the driver with, who is at fault. That's the only thing that will help a driver, in most situations! Remember driving is not a right, it's a preveldge! So these drivers now a days don't follow the rules and regulations, they think that they have the power to do what they want. And two weeks of training is not enough for an inexperience driver to get behind the wheel of an eighteen wheeler! And they should also check if the driver ever had a speeding ticket, suspension of license for what ever reason, a DUI, reckless driving, in a car or pickup truck. And if he has, then that also plays into the factor of what ever the semi driver has on his or her license from the pass, before they get their license! That there will explain what kind of driver he or she is, and might disqualified him or her of obtaining a CDL! Can't change the spots, if he or she has had them for awhile too! Or bad habits! An I blame the states! They should build vehicles and including semi trucks, pick ups, vans, and cars etc! That if you get behind the wheel, you should not to be able to use a phone, lap top computer, any electrical device, that is taking away from you as a driver. That will most definitely stop a lot of these crashes that happen with people using them.The only way it will work is that the person or persons are at a safe area, and have to be completely stop where ever they'll be. But once your in motion the phones, laptops , do not work at all! Period!! Besides their not in the auto or semi book when you apply for a license right? Or taking the test! So each State should do their part, to avoid all of these fatal issues an accidents!

    I drove for JBHUNT. They have inboard cameras for good reason....to protect and prove truck drivers are not always at fault. They do not allow headsets or Bluetooth earpieces to make calls. They do allow calls via stereo in truck. You get caught on the phone or Bluetooth, you can be fired. You cannot always see ahead and Hunt will say you should have been driving slower...hey...JBH....you drive slower...you place yourself in danger of being hit for the same reason here! You can not see that far ahead!

    The truck driver should launch a lawsuit against the woman's estate for all the losses incurred by the driver (including any injuries and trauma). Running out of fuel on a freeway is evidence of negligence on her part. Not pulling over to the shoulder is also evidence of incompetence and poor judgment. If you're traveling down a freeway and lose power, you should have plenty enough energy to coast to a safe location.

    It took many watches to realize he wasn't manipulating his steering wheel near the point of collision: He was pressing something in that general direction. Maybe had his phone mounted or something?
    Reaction time seems abysmal even at night. I do most of my driving at night and he should've noticed something off around 300-400 feet. He couldn't put on his high beams since there was oncoming traffic but that wouldn't have mattered as he only sees it at maybe 20ft.
    Shared fault but since we don't cap punitive damages in this country it's going to be a huge burden on JB. I think it's fitting that they pwned themselves with their own inward facing camera.

      If it was a car that crashed into and killed her, it would have been 100% her fault but because it was a truck driver she's the innocent victim that did nothing wrong. Texting is illegal by car driver or truck driver but if the police found a car driver to be texting before running into the back of her unlit, dark colored jeep parked smack dead center of the traveled lane killing her she would be at fault enough for her own death that a wrongful death lawsuit would be futile. Truth is I stared at the video looking for the car and didn't notice it until he was practically on top of it - not enough distance to brake in by the time I saw it parked on the road. Could have swerved perhaps but no telling if the left lane was clear.

    I learned the tip from another co-worker, clean windows and mirrors help with seeing better at night, it's common sense but you need to DO it. Also Newspaper makes good streak free window cleaning, you finish with elbow grease and micro fiber towel.

    Funny thing is that when youre going for your drivers license in most states, youre told to move your disabled vehicle off the road with your four ways turned on. But hey. What do I know.

    Head lights will glow off reflectors 300 plus feet away on cars taillights, and if he was paying attention, he would have had time to react and avoid killing someone.
    She wasn't doing the right thing, but he's supposed to be a paid professional driver 🤔 driving an 80,000-pound truck is skilled, dangerous work, and requires full attention all the time.
    There is no excuse for this one. He should be charged with involuntary manslaughter.
    I drove and owned my big truck for over 10 years till a distracted driver who was fully loaded and traveling 67mph in a construction zone, was on his phone ran into my trailer as traffic had slowed to 5 mph due to a lane closer. 5 years ago and suffered permanent partial paralysis and pain from traumatic brain damage. I'll never work again.

      I feel bad about your injuries and the woman that lost her life. But the jeep should not have stopped on the travelled portion of the road. The shoulder of the road is there for a reason.

      Look at it this way, if a large rock 🪨 the size of a car fell onto the road in the dark, his headlights would allow him to see it unless you're playing on your DUMB PHONE! Not only are you distracte but , the light from your phone also causes your vision to be restricted at night. He wasn't paying attention, and he killed someone. If it had been a car seized rock, he would have killed himself.

    She is right. I had a cop in chicago tell me the accident is always the truck drivers fault. Now I was hit by a cadillac in my trailer tandem while sitting in the middle turning lane waiting to get over into driving lanes. Thank god the company i came from give my company and me a copy showing that driver turn his steering wheel into my truck.

    Ive been driving for years and I had to watch the video twice. First time i watched the dash cam and i didnt even see the 4 wheeler shadow until right before impact

    She ran out of gas and was sitting in the lane of traffic in the dark,not pulled over onto the shoulder, no four-way flashers, no triangles, nothing. That poor truck driver had no chance of avoiding this disaster.

    I used to Chauffeur for the New York Times for a while, working the night shapes. One thing they used to tell us regularly, "Stay hyper vigilant out there at all times. We lose on average one driver every year, due to disabled parked cars on the sholders and roadways at night." This is a real problem. My condolences to everone involved.

    My question is, why didn't the mitigation system work? IMO this should have gave him a warning that something was on the road. When its dark, a person must be focused as I have seen people walking on the side of the road at night and sometimes they are hard to see.

      As hard as it sounds - and it actually is. There is an iron cast rule that overrides all the buts and ifs.
      Any driver must always be in full control of his vehicle. When visibility does not allow a clear sight, the driver must adapt his speed and be able to avoid a collision, The law says that any driver must expect that other drivers are making mistakes.

    Had a similar situation years ago. Winter time, open highway, clear sunny day with drifting snow. I ran into a crosswind with a wall of blowing snow, visibility immediately dropped to about 30 feet, and I slowed down. A few seconds later a car appeared, no lights, center of the travelled lane, almost at a full stop. Good thing my foot was already on the brake or it could have been far worse. I would not have had time to step on them. 3 vehicles written off. The car in front, my pickup, and the guy behind who also didn’t have time to stop. Two more went into the ditch.
    Lesson learned - If you slow down significantly or stop on a highway, for any reason, pull over to the right side as far as possible. Keep the lights on, not headlights, just running lights and flashers. BE VISIBLE!!!

    Still jeep was visible in more than enough time to go around.....driver is at least 50% at fault.....other driver is at fault also

    Mad respect for truck drivers. My old man made sure when he taught me to drive a car - "give the road to the trucker son, they can't stop on a dime, they can't see you in their blind spot, get outta their way when they're trying to merge" all the basics! And he was tough about it too, no sugar coating and a nice businesslike voice - he commanded it! 😄 And I'll never forget "Son, you cut off a trucker he won't have a chance - he'll make you and this car part of the asphalt - no more Scot"

    The woman in the Jeep was drunk (speculation), she ignored low fuel warning indicators, ignored her vehicle starting to cut out, ignored her duty to get her disabled vehicle off the road while it was still in motion, and ignored her responsibility to notify other motorists of the presence of her disabled car by way of turn on the hazard flashers or at the VERY LEAST turning/leaving on the parking lights. Like that wife, it bothers me to the core that when a four wheeler commits all those failures of their responsibilities it's entirely the truck drivers fault for crashing into a dark colored, unlit vehicle, parked in the middle of the road, on a dark highway at night. If another car ran into and killed her, it would have been 100% her fault case closed. But because it was a truck driver that hit her, she's the innocent victim of the big bad truck.

    Alex...EVERY state has the law written, in legal language, a rule that states...if driver strikes any object its drivers fault. If a driver traveling at 1 mph hits anything in front back or side u are charged with failure to control speed or driver inattention. ITS THE LAW in every state😮

    The same area of Texas, Waco, my wife was a juror for a trial where 4 wheeler ran red light and t boned by 18 wheeler. Insurance company, driver and company were deemed liable when car was at fault. The trucker said he never looked to his right while going through intersection making it his fault for not stepping on brake and avoid law violating car.

    I was in a similar accident Oct/ 2023 No lights, no emergency vehicles, just left in the left lane and was deemed my fault for hitting a vehicle from the rear ! Thank GOD no one was inside the vehicle ! I'm sure J.B. hunt has some hard core lawyers like my company and made those responsible drop their law suit !

    In this case (accident) it's the truckers fault. The jeep should have lights/hazard lights turned on and further to the right of the road to be safe. With that being said the trucker should've seen that jeep. Depending on speed and weather conditon(s) there should've been a clear view for him without any other distractions. If there's a camera un truck turned inward then his ass is grass. No camera well then its his word against everyone else.
    Suing? Nice try 'cause u not going to WIN and a person got deleted🪦. You're Done!.....Trucking Career Possibly Over🚛
    You'll end up having to PAY top dollar for a good attorney

      The Jeep was ghosted on the road, so there was no way for the trucker to see the Jeep from a distance at night.

Also despite it being a perfect world it would be her fault but because of people looking at truck drivers as being PROFESSIONAL the blame will be on him. You have also keep in mind when on the road you can't just think for yourself but others as well. You can't always know what they are doing but u have to be SHARP mentally and physically (10 steps) ahead. From someone coming in your left or right lane....jumping across the cross walk and etc. That includes a car possibly in the dark. If the trucker had No lights on his truck along with no fog lights that would be a whole different story. Usually other vehicle lights and your lights would help see in a situation like this. Also keep in mind if he was coming around a corner or up a heal that would cause an accident cause it would considered a blind spot. To run right into it!?....hmmm The courts and company won't let him get away with. Its an automatic law suit on the womans end (family memebers).....Its called negligence! Yes she was wrong for lights as I mention along with not being further to the side but companies and the law don't see it that way.
      Also when have u ever in a situation like this seen a driver telling their side be honest? This was a life take and anything this person has said or said will be held against him. This is a situation of ending everything (loosing his license and job aka lively hood). THIS IS SERIOUS and depending on what city, state, county he would be put under the jail.
      You have to remember those in position(s) of power are against truckers. Years ago Truckers use to be TOP GUN in this country. NOT ANYMORE
      Keep in mind not all of them are bad but not all of them are on your side.
      If he was distracted which could be possible he won't admit it. Because the company and law will not believe him no matter what he says other that it was preventable. A trucking companies favorite word PREVENTABLE/NON PREVENTABLE.
      The company will be worried about a law suit while he is worried about a good lawyer. Either way its going to cost money.

      2... I was in an almost identical situation like this 4 years ago in Texas.
      I was on I-20 heading to Dallas at night, following a Rig, about 50' in front of me.
      The trucker suddenly swerved into the left lane, just missing a ghost car parked in the right lane. The car had NO lights on at all.
      I managed to swerve into the left lane in the nick of time, but the pickup truck behind me smashed into the car at 65 mph.
      Both girls in the car & the driver of the pickup were killed.
      That trucker literally saved my life, because I was so close to that car before my headlights illuminated it... there would have been no way I would have reacted in time, had I not already been prepared to react because I saw that semi suddenly swerve.

      If he would've hit that vehicle it would've been a trickle, domino affect with yourself included....Those are the type of accidents that slow down traffic or keeps you stuck in traffic for hours. Once again staying on top of your game.

    Nothing irks me more especially as a local city driver is when drivers don’t turn their damn hazards or lights on!!!!
    Sometimes if I get the chance before a driver gets on the highway and we’re at a light I’ll get their attention to turn their lights on, they thank me usually, but still we have a lot of drivers getting away with that…
    Please turn your lights on, we can’t see you when you don’t!

    Even if it wasn't the drivers fault, Its going to be on the trucker. JB makes all their drivers take the Smith systems class This very scenario is on the test. I can't tell you how many times I've had people walking in the middle of the interstate going through Missoula, Montana in the pitch black. I was blessed no doubt, but if I wasn't paying attention I could have easily hit them. They would have been wrong, but I still could have lost everything. You never know who has a death wish. Drive like everyone does and protect your hard work and that cdl.

    I saw a crash like this in NC many moons ago….wasn’t dark, but it was foggy, hot and rainy on new asphalt. The lady had her car shut down, no 4-ways, no lights and the driver in front of me rear-ended her and drove the backseat through the front seat breaking her back. She had a baby seat in the back seat but thankfully she didn’t have the baby. Last I heard, the driver wasn’t charged. But, that was back in the 90’s, today, drivers are at fault for everything now days,

    Unfortunately, it's a product of our sue-happy society. They see a company with deep pockets and the greed begins. Granted, the driver should NOT have been on his phone, but otherwise could have been legally distracted by looking at his gauges or other operational criteria needed to safely operate a tractor-trailer. On the other hand, the lady had NO common sense and NO logical reason to be stopped in a lane of traffic in the dark, almost promoting an accident and questions of suicidal thoughts. Batteries, lights, and four-way emergency flashers ALL still work even if the engine dies ... NO excuse. As a truck driver, I would be counter-suing her estate for the life-threatening situation and damages caused by her suicidal actions.
