If supreme court turns down every order of lower courts, then why should we have so many courts from villages to city to town etc. Close down all courts and save money. The judges who are elevated to the hon'ble SC are supposed to be the best and most experienced adjudicators in our country, and it is perfectly so. They are never found or heard to be misbehaving or misusing their powers. But on the other hand, it is possible that the lower courts make wrong decisions or go too far with the misuse of their authority sometimes. Why, we know of many such instances where the learned judges misbehave with lawyers and with the senior judges as well. SC is the only place we can seek relief from in such cases. Being supreme, Hon'ble SCI would have been beyond criticism had the matter been examined in the context of the nature of complexity of various organised corruption cases of WB by the powers that be. Also, Hon'ble Calcutta High Court and Hon'ble Justice Shri Avijit Gangopadhyay could be asked to clarify their position, before the matter was decided ex-parte. If not hasty, abruptness of the decision has confused the people, especially of WB where Hon'ble Justice Shri Avijit Gangopadhyay is held in very high esteem due to the urgency he has accorded to the related cases of massive corruption. Any how, more clarity is expected in this regard.

I strongly feel that people of India must stand up to the support of Justice Gangopadhyay as he in recent times are one of such very few Judges who shows real grit to counter genuine corruption of political leaders. My humble request to honourable CJI is that he should alteast in any public forum as a citizen of India show his respect for what Justice Gangopadhyay has done to stem corruption.

Even CJI has also appeared for an interview and spoken on some cases he is handling. So based on partial and improper translation Supreme Court should not take such decision...One more question is, Supreme Court is boss to High Court or equivalent ? Abhijit Gangopadhay is God to thousands of protesting candidates who are at dharna more than 800 days. No National media is covering them because they are not at Jantar Mantar. Justice Gangopadhay said that he has started war against corruption and delivered many landmark judgments in that direction. It is a question upon your court which has only 1 good judge according to you... it is a deep concern if it's as said by you that only one judge is good and others are bad.. He's a justice of the high court not a civilian Robin hood.. altho he may do good things but there is a prestige of being a High Court justice that he has to follow.

Absolutely correct. Where is judicial discipline when CJI of India gave an interview to India today TV channel and discussed about the LGBT case, which is under in his bench and do i have to think he is above the law? Justice Ganguly' s only fault is he is honestly and sincerely fighting for the cases for the job seekers, who despite been qualifying the exams of the teachers recruitment, didn't get job because the rulers of West Bengal sold their jobs in lieu of lakhs of rupees to the persons who submitted blank sheets in the examination and it has been proved by the CBI in Kolkata high court.
The judges must be under income tax scrutiny also and it is long overdue . Why the govt is hesitant on this issue. Let these superne classes vote under invoke tax lenses and if they refuse to deliver the judgements on the pending cases ,let it be .Already there are so many pending cases in the various courts of India.
According to Former Justice of SC, Ashoke Ganguly- SC & HCs of India operate independently and the SC cannot have any administrative superintendance of any High Court as per the Hon'ble Constitution of India. If Justice Abhijit Ganguly has to be removed from hearing of any case it can only be done by the Chief Justice of Kolkata High Court.

Justice Ganguly was right. Nepo kid chandrachur himself discussed under trial matter in india today interview. So going by the logic of chandrachur, chief justice of supreme court should be suspended by president. After justice chandrachur becomes the cji, mysteriously all the cases related to corruption of TMC has been postponed again and again. Samajdaro ko isara hi kafi hain.

This judgement was against the people of West Bengal engaged in a battle against corruption facing all wraths of the Government High office and it's goons. The entire ground reality was ignored. The magnitude of all embracing corruption in every sphere of life involving super influential political personalities were overlooked in the name of technical lapses without giving a chance to justice Ganguly to defend his act. This entire episode could have been a historical milestone in our country. Iconic characters of corruption are rejoicing. Cry Bengal. Cry.
Being a tet qualified candidate and after facing interview I can say for sure that justice Ganguly was doing a Fantastic job( I only needed 0.5 marks in the interview for securing the job ,but it seems out of 10 I got nothing..). but, what our not honorable CJI chandrachud just did will support the corrupted peoples. Did the SC satisfy itself that the English translation of the HC judge's interview to a TV channel in Bengali, is true, correct and not twisted, before acting upon it ?.. The HC judge himself could send SC his own English translation. It will be more reliable. It's still not late.

I don’t think it is. HC are independent institution, SC can overturn the judgement of HC but taking a case from HC judge just for an interview is unprecedented.

Black day in judicial history of India. Justice Gangopadhyay was one of few people left who was fighting against the horrendous corruption being committed by the current government of west bengal.
My humble submissions are following 1. Justice Ganguly made comment against Avishek Banerjee in the interview with reference to the virulent, arrogant comment of the latter on some honourable justices of Kolkata HC. What is wrong in it for a judge to give a strong message against such unruly attitude of a politician ? 2. When Justice Ganguly gave the interview, this particular case related to Avishek Banerjee was not pending for hearing before his court. The case was filed recently only. Hence it should be considered as post facto. 3. If we draw a parallel, any class Teacher after harshly criticising a student in past for his/her bad conduct in class should lose the authority to examine the class tests of that student. Is it a logical consequence ? Having said these, does the order passed by honoursble justices of Supreme Court reflect any jurisprudence or this impulsive order is issued in a haste ?

Justice Ganguly, instead of explaining why he spoke to press for the case he was hearing, did a reverse attack on the SC. This itself shows his way of dealing with the things. SC was absolutely right to not have him hear the case when his way of dealing things are like this.

Possibly Mamata has oiled the CJI with tons of ill gotten wealth she and her bhaipo have acquired. So, again the TMC will go scott free in all the scams with the blessings of CJI. When a judge will give his/her judgement in public before the case has been finalised then during the hearing how can you be sure that he/she will be neutral...... that's the point...one can put any allegation on the judge for which one may be punished but vice versa is not acceptable

He made a warning comment against Avishek in response to his unruly verbal attack targeting a section of honourable judges of Kolkata HC. But no case related to Avishek was pending with Justice Ganguly when he gave that interview. The case related to Avishek is a very recent one when Justice Ganguly passed an order for a face to face interrogation of Avishek with an accused under Jail custody. When Justice Ganguly made the public comment, no case related to Avishek was pending at his desk.
Judge Abhijit Ganguly had been continuously naming one party of the case as offenders, while the case was sub judice and even in his own court. These remarks created unease. But when he did the same in public and more so sitting on a channel interview that was telecast widely, then it was brought to the notice of SC and the CJI was shocked. The CJI instantly removed him from the case.

They are never found or heard to be misbehaving or misusing their powers. But on the other hand, it is possible that the lower courts make wrong decisions or go too far with the misuse of their authority sometimes. Why, we know of many such instances where the learned judges misbehave with lawyers and with the senior judges as well. SC is the only place we can seek relief from in such cases. So, I beg to say that I don't agree with u. If the SC turns down an order of a lower court, it is for the best interest of justice.

Translation of the original Bengali interview given by Justice Ganguly might not be proper or partial as I have seen the complete interview.. So based on partial and improper translation Supreme Court should not take such decision...One more question is, Supreme Court is boss to High Court or equivalent ? Already TMC party leaders are rejoicing after this statement of Supreme Court..So common man/honest man/poor people/powerless people will feel helpless and frustrated again in corruption cases. ..Danger to the democracy.

Where is judicial discipline when CJI of India gave an interview to India today TV channel and discussed about the LGBT case, which is under in his bench and do i have to think he is above the law? Justice Ganguly' s only fault is he is honestly and sincerely fighting for the cases for the job seekers, who despite been qualifying the exams of the teachers recruitment, didn't get job because the rulers of West Bengal sold their jobs in lieu of lakhs of rupees to the persons who submitted blank sheets in the examination and it has been proved by the CBI in Kolkata high court.

To my mind, the Solicitor General conceded the matter too easily. Otherwise, usually, I've seen Mr. Mehta standing his ground & not backing away from a fight (legally speaking). Wonder why he didn't pursue the parity argument calling into account the public comments of other judges, including SC judges, even while matters are before their courts and ask that the H.C judge be given the same leeway?

Justice Ganguly was right. Nepo kid chandrachur himself discussed under trial matter in india today interview. So going by the logic of chandrachur, chief justice of supreme court should be suspended by president. After justice chandrachur becomes the cji, mysteriously all the cases related to corruption of TMC has been postponed again and again. Samajdaro ko isara hi kafi hain.

Very unfortunate that SCI has stopped the wheels of justice on flimsy grounds. Justice to the people of Bengal has been delayed. Why haven't they taken cognizance of Abhishek Bannerjee s statement demeaning the Calcutta High court? Smacks of high handedness and smells bad.
Idiot he can apply RTI in Supreme Court or he can file request to supreme court Registrar to publish him his transcript. How can he himself take his own case and issues orders by himself. Which law allow him to do this. He himself will file case, Himself listen to his case, himself issues orders, himself will give verdict. That's conflict of interest. He should file case in supreme court if he wants transcript urgently. He can file case against order of Supreme Court stating that his video was not translated properly. He is Judge. He is aware of rules and regulations. He is aware what he has said in that interview. He khows what Supreme Court had issued order. If he is confident and knows that he didn't said anything wrong then he should file case against that order. That transcript was not submited in closed envelope so technically it's a public document not confidential document.

This judgement was against the people of West Bengal engaged in a battle against corruption facing all wraths of the Government High office and it's goons. The entire ground reality was ignored. The magnitude of all embracing corruption in every sphere of life involving super influential political personalities were overlooked in the name of technical lapses without giving a chance to justice Ganguly to defend his act. This entire episode could have been a historical milestone in our country. Iconic characters of corruption are rejoicing.

Parliament should initiate impeachment proceedings against CJI immediately.

Being a tet qualified candidate and after facing interview I can say for sure that justice Ganguly was doing a Fantastic job( I only needed 0.5 marks in the interview for securing the job ,but it seems out of 10 I got nothing..). but, what our not honorable CJI chandrachud just did will support the corrupted peoples.

Did the SC satisfy itself that the English translation of the HC judge's interview to a TV channel in Bengali, is true, correct and not twisted, before acting upon it ?.. The HC judge himself could send SC his own English translation. It will be more reliable. It's still not late.

I don’t think it is. HC are independent institution, SC can overturn the judgement of HC but taking a case from HC judge just for an interview is unprecedented.
@@LawChakra from the five writs, sc has the power take any case from HC. Judicial system (SC/HC/DC) is independent but there is a hierarchy in this system which allows higher courts to take action against lower courts

My humble submissions are following
1. Justice Ganguly made comment against Avishek Banerjee in the interview with reference to the virulent, arrogant comment of the latter on some honourable justices of Kolkata HC. What is wrong in it for a judge to give a strong message against such unruly attitude of a politician ?
2. When Justice Ganguly gave the interview, this particular case related to Avishek Banerjee was not pending for hearing before his court. The case was filed recently only. Hence it should be considered as post facto.
3. If we draw a parallel, any class Teacher after harshly criticising a student in past for his/her bad conduct in class should lose the authority to examine the class tests of that student. Is it a logical consequence ?
Having said these, does the order passed by honoursble justices of Supreme Court reflect any jurisprudence or this impulsive order is issued in a haste ?

Justice Ganguly, instead of explaining why he spoke to press for the case he was hearing, did a reverse attack on the SC. This itself shows his way of dealing with the things. SC was absolutely right to not have him hear the case when his way of dealing things are like this.

You are correct Sir. With an agenda in mind the SC is loosing focus and dithering in unnecessary directions. The dynastic arrogance typical of Congress culture is clearly perceptible. The SG, Tushar Mehataji, is occupying a high position in the country which he reached through hard work and dedication. He is aged. When a judge will give his/her judgement in public before the case has been finalised then during the hearing how can you be sure that he/she will be neutral...... that's the point...one can put any allegation on the judge for which one may be punished but vice versa is not acceptable
A prestige of a Honorable High court Justice is way higher than a politician and they should maintain that... any Justice shouldn't trouble them with nonsense from the polity people.

He made a warning comment against Avishek in response to his unruly verbal attack targeting a section of honourable judges of Kolkata HC. But no case related to Avishek was pending with Justice Ganguly when he gave that interview. The case related to Avishek is a very recent one when Justice Ganguly passed an order for a face to face interrogation of Avishek with an accused under Jail custody. When Justice Ganguly made the public comment, no case related to Avishek was pending at his desk.

Judge Abhijit Ganguly had been continuously naming one party of the case as offenders, while the case was sub judice and even in his own court. These remarks created unease. But when he did the same in public and more so sitting on a channel interview that was telecast widely, then it was brought to the notice of SC and the CJI was shocked. The CJI instantly removed him from the case.
