    If the mechanic has a bad attitude, is trying to extort me, then tries ordering me out of his shop while he still has my property...I'm not going anywhere. It sounds like the Defendant tried to extort more money & when the Plaintiff wouldn't comply, the Defendant attempted to hold his bike hostage starting pulling down garage doors. That Defendant needs anger management counseling.

    The lie that both the defendent and his son told about the door already being down says A LOT about them. Not to mention the stereotype-voice the son did. 🙄

      You were there? I mean that's the only way you could know they are lying. I would recommend not claiming you know things with zero proof. It'll probably make your life a lot easier not to mention people who claim things with zero evidence are one of the biggest problems in society today. Btw I was a mechanic for many years in a couple of older shops. Propping the door open with a stick or pipe is common. Secondly it makes much more logical sense that she walked into the door especially if the sun was beaming in there. Or she did it on purpose to sue once things were going south with the bike. You literally have to stand on the side of a bay door to lower it down which means that she would be standing like 3 ft away from the guy lowering the door. It makes absolutely no logical sense if she was standing right there in the doorway that the guy would keep lowering the door down on her. Even if he did those doors come down so slow there's no way it would have "hit" her head. If anything it would have touched her head.

Or maybe we should ignore his actual admission to law enforcement and go by your experience as a “mechanic in older shops”? I think I’ll stick with the hard evidence and agree with the OP that the defendant and his son were lying in court.

      The police officer could have been just as confused about the door as the judge was when he was telling her the same thing.

    If I were the judge when it was clear that the defendant's lied about closing the door on her head, I would have awarded her at least $1,000. Because there was still pain she suffered.

      @@elvickRULESThat doesn’t make any sense. His bike was inside, so he had a right to remain by his bike until the issue was resolved or the police arrived. That doesn’t give anyone a right to slam a garage door onto someone’s head. The plaintiff had a right to be upset. It’s not his fault that the defendant’s son misquoted a price on the work order. If it was quoted on paper, they have to adhere to the quote.

      Yes, but it was minor pain. She went to the doctor the day after and they gave her Tylenol. It's not like she was referred to a neurologist or prescribed something stronger for continued pain. And to be honest, the award was probably more than what she would have received if she put a claim against the shop's insurance.

    The son used a racist accent to tell lies; I think he thought sounding "black" would make his story more believable. It's just disgusting and shows the education he got, his father has a strong accent, and yet he didn't try to sound like him when he spoke about his dad.

    The father and son are rude. If the bike was such a 'hack job' why agree to work on it. Since they took the business, They could've easily said, "We are not responsible if xyz happens," or better yet point out any noticeable imperfections on the bike. If they noticed the scratches before, they should've mentioned it. Sidebar; I work with jewelry, so when customers want their pieces cleaned, we examine most of it IN FRONT of them(to diamond check we have to go behind a counter, but they can come to that side of the store, but obviously not by the microscope or our tools).... did you see you had a scratch on this link, you're missing a diamond here, these gemstones in your ring are loose, I'm going to have YOU close your crown so there's no water damage when I clean your watch...... It's better to call out visibly broken or damaged components BEFORE you provide the service, waive liability, and allow the customers to choose whether or not they want to proceed. I feel like dad and son are shady, and just mad they got called out.

      She went to the hospital and they told her nothing was wrong and to take Tylenol. A lot of people exaggerate the extent of injuries to get money. The hospital wasn’t buying it and neither did the judge. The injury has to have some effect on your life for it to be emotional damage, medically (states by a doctor) linked to emotional suffering like depression/anxiety, etc. or physically unable to do normal life activities like work or walking. Calling off of work to go to the hospital, that then tells you you’re fine, does not count. Her insurance paid for everything too and they still wanted “reimbursed”. For what? They didn’t pay.

      What she got out of ‘bouncing’ the garage door on her head, is the case of her husband being litigated in his favor.
      Because the defendant decided to lie about pulling down the door, the Judge lost any confidence she might have had about his statements:
      If he lies about one thing, she can’t trust his word about the other things.
      The hospital bills were covered by her insurance, so what was left was her ‘pain and suffering’-claim. JM turned that down, based on the doctor telling the plaintiff she should take a (mild) painkiller, indicating that no huge damage was found.
      I’m sure she had a nasty headache for a few days, but that’s about all she would have had.
      The plaintiffs were ‘lucky’ that the defendant was caught in a lie.
      I’m not so sure how the case would have been decided on otherwise…

    I'm sorry. If your employee writes a quote for work, all listed work for that project needs to be COMPLETED for THAT PRICE. Dock your son's paycheck. Don't try to change the quote.
    My father was a master craftsman when it came to woodworking, refinishing, and repair. He never had to write a quote, because his spoken quote was what the customer paid. Even if he ran into unexpected trouble or issues, and LOST money. People that cannot be relied on, even with a WRITTEN CONTRACT, upset me like loose shopping carriages and title-jumping upsets Judge Milian!!!

Where I’m from we say it exactly how he says it because we were once colonized by Britain and that’s their pronunciation (speed-o-meter with the long O sound)

      In Australia the proper word is 'Spedometer' but like most words we shorten to just Speedo, so they should have just gone with it after the first time

    This was a joke. The defendant clearly LIED but she didn't make him pay for lying. Badge ruling. This is why they should have kicked the defendants azz. May as well have gotten street justice because this ruling was a joke.

    Clients are not allowed in the shop must wait at the waiting room after seeing the mechanic cause they have to wear steel toe safety shoes 👞 in case of an accident as we know now is happened to the plaintiff or something heavy fall on your foot. There should be signs on the wall telling you before you step in the office to see the mechanic and he will also verbally will ask you not to go in the shop.

      Yep. If someone gets hurt... The shop is responsible and there is lots of dangerous equipment in a shop. That's why they don't let people back there.
      Also if they said get out. She was CRIMINALLY trespassing... So she got what she deserved. he has to protect his shop.

    The plaintiff was being greedy and couldn't even explain why she should get thousands of dollars for nothing. I hit my head on a garage door before and much worse. I get a headache, a bump, and sometimes a bruise when it's really really bad and I just take some Tylenol and leave it be.

    And for the people commenting about the defendants imitating the plaintiffs FAKE SLAVE TALK, at least the defendants accents are real.
    Who grows up for generations next door to me here in the USA, goes to the same school as the rest of us, including their parents and grandparents, but talk like they just come off the plantation?
    Black people talk the exact same way uneducated slaves were made to talk centuries ago.
