  • This lesson covers the doctrine of promissory estoppel - the first of a handful of consideration substitutes. When a promise lacks consideration and is, therefore, gratuitous, a party can fall back on one of the consideration substitutes, such as promissory estoppel, to argue that the promise should be enforced by the court in equity.

So if a company during a buyout promises to not change the company's inner process and policies, and is actively trying to change all those things, would that constitute promissory estoppel based on the idea that they were keeping the employees on the basis nothing was going to change, thus making it so the decisions made were based on that promise?

But what about case law with regards to the application of promissory estoppel, would have loved to see the cases being applied in your discussion 😊

I understand there was no consideration in the example given, but there was also no clear acceptance of the offer. Can we still analyze promissory estoppel if there was only an offer given, no acceptance?

Has the Promissor's (gift giver) gratuitous promise contained in a unilateral contract been disclosed as a free Will gift/donation to the Promissee w/o a Promissee's obligation to the Promissor.
What is the Promissee's consideration to the Promissor for the corresponding promise?

For gratuitous promise, does promise need to accept the promise?
