Seriously? He was saying "no you can't make the phone call" from the very start rushing them every second of the way. I thought it was odd he couldn't just give them two minutes to make the call (it became strung out after that not because he's allowing it to take longer but for the reasons I'm about to say.) Patience looks like = "Ok, you can make the call, I'll wait a few minutes." I've seen many officers do this in videos when making highway stops. This wasn't patience, it was a cop not entirely familiar with the law (reason he asked his buddy about legal procedures) and then wanting so badly to rush an arrest but also not 100% sure he's doing things to a T after realizing the father/lawyer was getting on the phone and he might do something wrong while the father/lawyer is listening, which would get the case dropped in court later. He was hesitating to climb aboard and effect an arrest for that reason but also trying to sound confident and knowledgeable about procedures at the same time hoping the guy just makes things easier and climbs onto the police boat.
@crispinhandly6159 I'm not 100% sure about this, but I don't think cops are required to allow alleged drunk driving/boating suspects to call a lawyer before agreeing to a sobriety test or before arresting them, etc. I honestly don't know for sure, but I don't remember seeing this happen in general. I don't live in Florida so I don't know the local laws or procedures. I've been pulled over and taken field sobriety tests (passed them all of course!), and I don't remember the officer giving me an opportunity to call my lawyer before taking the test.

He didn't give him the opportunity, that's my point. At no point does he say "yes you can make the call." The kid is making the call with the cop not wanting him to make the call, not allowing him to make the call but once he starts making that call, the cop is hesitant to board the boat and arrest him because he's worried he may screw something up in doing so, so he's doing everything he can to stop the phone call without boarding the boat. At no point did he say "you can make the phone call." You're thinking he's allowing him to make the phone call just because you're seeing the phone call being made. That cop is one inch from boarding that boat every inch of the way but he's hesitant to cross that inch. Let me break this down as an analogy: You're up on a roof, I want you to come down. I say "get down here" and you say "no, let me stay up here for 5 minutes" and I keep saying "No, you can not stay up there! Get down here now!" Is this me allowing you to stay on the roof? No, of course not. But I'm hesitating to climb up there because I'm worried about something, so doing everything I can to not allow you to stay up there while also not climbing up there myself. Just because you're still on the roof after 5 minutes of me saying come down doesnt mean I allowed you to stay up there those 5 minutes. It means I wasn't confident enough to climb up there, but me telling you every second of those 5 minutes that you can not stay up there is me being impatient and not allowing you to stay up there. Bottom line, I'm an English teacher, so that's what provoked me into commenting when I saw the word "patience." Patience and hesitancy are not the same things. The cop is being hesitant, but certainly not patient.
I've never seen a more patient and calm boat captain in all my life. Seriously? The cop was so rude and rushing them nonstop, and had no legitimate probable cause to assume that he was drinking, much less drunk. He used technicalities to make the rest all the way. This is one of the very rare cop videos where I absolutely cannot side with the law... The only reason the sheriff even allowed him to speak to the lawyer was because he thought that was more likely to lead to an outcome where the captain would most likely agree to doing field sobriety tests -- the sheriff actually kept telling him that he wasn't going to allow him to speak with the lawyer, but let it happen anyways because he assumed that the captain would surely deny it otherwise, and the most likely (or only) chance for a solid, likely conviction of the crime would be if field sobriety tests and/or breath tests were conducted. *In the end, the cops spent a bunch of their time being inconsiderate to people enjoying their time off, and arrested a captain on unsubstantiated charges which weren't even related to the alleged crimes he was observed doing in the first place.*

If you ARE impaired, why give them any more evidence on an optional test? Go for the implied. Consent breathlizer test , as refusing that one is a $500 fine for boaters in Florida. He would’ve been better off submitting the breathalyzer even if he were guilty because they’ll convict him anyways . In Florida, you don't (legally) ever want to refuse the test. Instead, insist on talking with your lawyer without actually refusing. He did the right thing by never refusing. The officer cannot "refuse" on your behalf like this one tried to do.

Honestly, the decisions made by the driver of the boat were not particularly unreasonable. His attitude could have been better - though it also could have been way worse - and the driver could have been quicker to comply with some things, but ultimately refusing to submit to testing isn’t unreasonable in these circumstances.
The kid actually made a good choice to not do the sobriety test. Only take a sobriety test if you are actually sober, if you’re drunk or have been drinking just go to jail.

@@41Velu Correct me if I am wrong, but if you do the test while sober, still fail it somehow (I've heard of sober people getting failed before) you get arrested, take the blood or breath test, it comes back no alcohol, you usually should get released with no charges or license suspension at that point correct? I think where the issue of refusing a FST comes in is that once you refuse it, its an automatic license suspension as is stated on the back of our driver's license. So if you refuse either way, don't you get suspended? I feel like if you're sober just do the test and if you really haven't had any alcohol they will find that out at the station.
I don’t know about that but he did seem to handle it well. He does have the right to not answer questions and until arrested he can talk to whom ever he wants. He remained calm, bought himself some time, he cooperated and more important, he ensured they have no physical evidence just an “observation”, smart play. I’m thinking he’s going to get the charges dropped/dismissed.
I would say he did an amazing job especially for someone who was born in 1996. Seemed to appreciate the importance of being a safe captain. Love the fact that he called out the cops making the huge wake. "A wake is a wake" lol so true if its unsafe to produce a wake then a law enforcement wake is no more controllable or safe than any other boats wake.

I'm not defending the guy on all the other stuff, but cops don't get a pass in the wake zone when they're not in pursuit or emergency situation. So, being "that guy" or not, he did have a point. Human nature, when you've been told you're breaking the rules, then the people that just told you that do it themselves, I'd be "that guy" at that moment as well. Cops have a hard job, but it doesn't help their public profile when they go about acting like rules or laws don't apply to them.

So many of us reading this have been or could have been 'that guy' in so many situations but have dodged that bullet for some reason or other, when your times runs out though you have a choice - you can man up and 'be that guy' or you can be the tool - I'd say that guy manned up pretty well and took his medicine.
As an attorney, based on the laws in my state, while I'm happy to do a breathalyzer or take a blood test, I'm not doing any field sobriety tests, it is too subjective and they can easily claim that I'm intoxicated even when I'm dead sober.
This is what happened to me. I had to put my arms out and walk one foot I front of the other and take 20 steps. I got overconfident because I was stone sober and the cop was pr&ck. Took an extra step and cop said I failed and I spent the night in jail. All charges were dropped but it cost me 15 grand worth of lawyer and court fees so still ruined my life at the time.

"As an attorney" you should know that the arrest is based on observation and not the results of blood alcohol, the latter would be evidence subsequent to arrest. Additionally, "as an attorney" you should also know that blood wouldn't be drawn unless other factors were at play which would've already landed you in the jackpot.
No, he just knows how the cops work the FSTs - They never find few enough clues to let you go. At the point they ask you to do the tests, they've already decided you're done. At that point it is just them piling up evidence on you. You copy what they're doing - that's a clue, you start before they say start - a clue. etc... the more "clues" they find the more they have to show the judge - DRUNK.

Never agree to the sobriety test. They can use any reason at all to fail you. Watched a video by a lawyer who said very few sober people can pass the test. If you fail, you're screwed. You're better off waiting till you get to the station to take a blood test. You rarely help yourself by answering police questions without a lawyer. He was already going to be arrested, no point helping the cops make their case.
@@RickMcCargar You will lose your license for refusing the sobriety test. If you're sober, you might as well take the test and submit breath/blood samples, cause even if they "find a reason" to fail you (which I think it's unlikely that they're actually out to get you unless you're being an asshole), the bio samples will be strong evidence that you're sober. If you're drunk, you're going to fail the test anyway, so in that case yes you should refuse any and all tests, lose your license, but you may be able to escape a conviction if you're not obviously drunk on the bodycam footage and you lawyer up. Boating is different obviously, but this guy is obviously drunk in the footage (speech is slurred, he's having trouble keeping track of what he's doing), so he's probably getting convicted unless daddy's connections get him clear

I've taken 3, was released each time. I don't drink and drive. Back then I barely drank, haven't for 16 years with bar-b-que or good steak which I used to have 'A' beer while eating. I've known 5-6 others that have been released to drive away after taking a field sobriety test, have known a couple of dozen that were arrested, but they all admitted later they were drunk.
@@Ray56z If you are sober and agree to the test only to find the cop has determined you are impaired you have little defense since it is his word against yours. You can be prosecuted and convicted based solely on the officers opinion. If he does not like you or is having a bad day he can make your day worse. Once it is determined by a field test that you failed there is no obligation for further testing. You could ask for a breath test, but they can refuse to give you one. Field tests are a gray area filled with pit falls that carry heavy consequence. I was pulled over, arrested and held overnight because I would not take the field test, yet I was perfectly sober. Even though I kept asking for blood or urine testing they refused to do so. When I was finally released the form said I was detained for drunk driving. However there were never any charges filed against me. This was a case of a deputy carrying out a grudge for non related issues. He lied to the Highway Patrol officers and they did not investigate any further than his claim I was drunk and impaired. Once they got me to the jail their commanding officer realized that a big mistake had been made and he could do little to mitigate the violations of my rights. The paper work was in place.

There's very little upside to taking the field sobriety tests. It is designed to gather evidence of impairment against you. The accuser has the burden of proof, be polite and respectful but don't assist them in gathering evidence against you.
Exactly right! The cop was not being truthful. He knew the guy wasn't going to pass the Field Sobriety Test. It's subjective anyway. The cop is the one who decides if you pass the FST. He already told him he thinks he's drunk. The cop wanted the FST to build a case in court as an FST provides a much stronger case for the prosecution. It's better to take the arrest and forgo the FST. I don't blame the guy for wanting a lawyer's advice before making a decision.

I recently got pulled over 10 minutes after a night fishing trip, cop said I reeked like alcohol (when I reeked like fish) and asked me to do field sobriety test. I had a beer 2 hours before, but failed the test due to her subjectivity and my lack of balance after spending hours on a boat. Got back to the station and passed the breathalyzer in flying colors. Still needed to spend thousands on lawyer and worried for months before I was able to get my DUI dismissed. Short lesson: Don't take a field sobriety test, it's voluntary. You will probably get arrested and forced to take a breathalyzer but you will win if you weren't drinking.

Seriously? He was saying "no you can't make the phone call" from the very start rushing them every second of the way. I thought it was odd he couldn't just give them two minutes to make the call (it became strung out after that not because he's allowing it to take longer but for the reasons I'm about to say.) Patience looks like = "Ok, you can make the call, I'll wait a few minutes." I've seen many officers do this in videos when making highway stops.
This wasn't patience, it was a cop not entirely familiar with the law (reason he asked his buddy about legal procedures) and then wanting so badly to rush an arrest but also not 100% sure he's doing things to a T after realizing the father/lawyer was getting on the phone and he might do something wrong while the father/lawyer is listening, which would get the case dropped in court later. He was hesitating to climb aboard and effect an arrest for that reason but also trying to sound confident and knowledgeable about procedures at the same time hoping the guy just makes things easier and climbs onto the police boat.
@crispinhandly6159 I'm not 100% sure about this, but I don't think cops are required to allow alleged drunk driving/boating suspects to call a lawyer before agreeing to a sobriety test or before arresting them, etc. I honestly don't know for sure, but I don't remember seeing this happen in general. I don't live in Florida so I don't know the local laws or procedures.
I've been pulled over and taken field sobriety tests (passed them all of course!), and I don't remember the officer giving me an opportunity to call my lawyer before taking the test.

The kid is making the call with the cop not wanting him to make the call, not allowing him to make the call but once he starts making that call, the cop is hesitant to board the boat and arrest him because he's worried he may screw something up in doing so, so he's doing everything he can to stop the phone call without boarding the boat.
At no point did he say "you can make the phone call." You're thinking he's allowing him to make the phone call just because you're seeing the phone call being made. That cop is one inch from boarding that boat every inch of the way but he's hesitant to cross that inch.
Let me break this down as an analogy:
You're up on a roof, I want you to come down. I say "get down here" and you say "no, let me stay up here for 5 minutes" and I keep saying "No, you can not stay up there! Get down here now!" Is this me allowing you to stay on the roof?
No, of course not. But I'm hesitating to climb up there because I'm worried about something, so doing everything I can to not allow you to stay up there while also not climbing up there myself.
Just because you're still on the roof after 5 minutes of me saying come down doesnt mean I allowed you to stay up there those 5 minutes. It means I wasn't confident enough to climb up there, but me telling you every second of those 5 minutes that you can not stay up there is me being impatient and not allowing you to stay up there.
Bottom line, I'm an English teacher, so that's what provoked me into commenting when I saw the word "patience." Patience and hesitancy are not the same things. The cop is being hesitant, but certainly not patient.
I've never seen a more patient and calm boat captain in all my life. Seriously? The cop was so rude and rushing them nonstop, and had no legitimate probable cause to assume that he was drinking, much less drunk. He used technicalities to make the rest all the way. This is one of the very rare cop videos where I absolutely cannot side with the law...
The only reason the sheriff even allowed him to speak to the lawyer was because he thought that was more likely to lead to an outcome where the captain would most likely agree to doing field sobriety tests -- the sheriff actually kept telling him that he wasn't going to allow him to speak with the lawyer, but let it happen anyways because he assumed that the captain would surely deny it otherwise, and the most likely (or only) chance for a solid, likely conviction of the crime would be if field sobriety tests and/or breath tests were conducted.
*In the end, the cops spent a bunch of their time being inconsiderate to people enjoying their time off, and arrested a captain on unsubstantiated charges which weren't even related to the alleged crimes he was observed doing in the first place.*

In Florida, you don't (legally) ever want to refuse the test. Instead, insist on talking with your lawyer without actually refusing. He did the right thing by never refusing. The officer cannot "refuse" on your behalf like this one tried to do.

Honestly, the decisions made by the driver of the boat were not particularly unreasonable. His attitude could have been better - though it also could have been way worse - and the driver could have been quicker to comply with some things, but ultimately refusing to submit to testing isn’t unreasonable in these circumstances.

@@41Velu Correct me if I am wrong, but if you do the test while sober, still fail it somehow (I've heard of sober people getting failed before) you get arrested, take the blood or breath test, it comes back no alcohol, you usually should get released with no charges or license suspension at that point correct? I think where the issue of refusing a FST comes in is that once you refuse it, its an automatic license suspension as is stated on the back of our driver's license. So if you refuse either way, don't you get suspended? I feel like if you're sober just do the test and if you really haven't had any alcohol they will find that out at the station.

I don’t know about that but he did seem to handle it well. He does have the right to not answer questions and until arrested he can talk to whom ever he wants. I would say he did an amazing job especially for someone who was born in 1996. Seemed to appreciate the importance of being a safe captain. I'm not defending the guy on all the other stuff, but cops don't get a pass in the wake zone when they're not in pursuit or emergency situation. So, being "that guy" or not, he did have a point. Human nature, when you've been told you're breaking the rules, then the people that just told you that do it themselves, I'd be "that guy" at that moment as well. Cops have a hard job, but it doesn't help their public profile when they go about acting like rules or laws don't apply to them.

So many of us reading this have been or could have been 'that guy' in so many situations but have dodged that bullet for some reason or other, when your times runs out though you have a choice - you can man up and 'be that guy' or you can be the tool - I'd say that guy manned up pretty well and took his medicine.
As an attorney, based on the laws in my state, while I'm happy to do a breathalyzer or take a blood test, I'm not doing any field sobriety tests, it is too subjective and they can easily claim that I'm intoxicated even when I'm dead sober.
This is what happened to me. I had to put my arms out and walk one foot I front of the other and take 20 steps. I got overconfident because I was stone sober and the cop was pr&ck. Took an extra step and cop said I failed and I spent the night in jail. All charges were dropped but it cost me 15 grand worth of lawyer and court fees so still ruined my life at the time.

Additionally, "as an attorney" you should also know that blood wouldn't be drawn unless other factors were at play which would've already landed you in the jackpot.

Never agree to the sobriety test. They can use any reason at all to fail you. Watched a video by a lawyer who said very few sober people can pass the test. If you fail, you're screwed. You're better off waiting till you get to the station to take a blood test. You rarely help yourself by answering police questions without a lawyer. He was already going to be arrested, no point helping the cops make their case.

If you're sober, you might as well take the test and submit breath/blood samples, cause even if they "find a reason" to fail you (which I think it's unlikely that they're actually out to get you unless you're being an asshole), the bio samples will be strong evidence that you're sober. If you're drunk, you're going to fail the test anyway, so in that case yes you should refuse any and all tests, lose your license, but you may be able to escape a conviction if you're not obviously drunk on the bodycam footage and you lawyer up. Boating is different obviously, but this guy is obviously drunk in the footage (speech is slurred, he's having trouble keeping track of what he's doing), so he's probably getting convicted unless daddy's connections get him clear

I've taken 3, was released each time. I don't drink and drive. Back then I barely drank, haven't for 16 years with bar-b-que or good steak which I used to have 'A' beer while eating. I've known 5-6 others that have been released to drive away after taking a field sobriety test, have known a couple of dozen that were arrested, but they all admitted later they were drunk.
@@Ray56z If you are sober and agree to the test only to find the cop has determined you are impaired you have little defense since it is his word against yours. You can be prosecuted and convicted based solely on the officers opinion. If he does not like you or is having a bad day he can make your day worse. Once it is determined by a field test that you failed there is no obligation for further testing. You could ask for a breath test, but they can refuse to give you one. Field tests are a gray area filled with pit falls that carry heavy consequence. I was pulled over, arrested and held overnight because I would not take the field test, yet I was perfectly sober. Even though I kept asking for blood or urine testing they refused to do so. When I was finally released the form said I was detained for drunk driving. However there were never any charges filed against me. This was a case of a deputy carrying out a grudge for non related issues. He lied to the Highway Patrol officers and they did not investigate any further than his claim I was drunk and impaired. Once they got me to the jail their commanding officer realized that a big mistake had been made and he could do little to mitigate the violations of my rights. The paper work was in place.

There's very little upside to taking the field sobriety tests. It is designed to gather evidence of impairment against you. The accuser has the burden of proof, be polite and respectful but don't assist them in gathering evidence against you.

Exactly right! The cop was not being truthful. He knew the guy wasn't going to pass the Field Sobriety Test. It's subjective anyway. The cop is the one who decides if you pass the FST. He already told him he thinks he's drunk. The cop wanted the FST to build a case in court as an FST provides a much stronger case for the prosecution. It's better to take the arrest and forgo the FST. I don't blame the guy for wanting a lawyer's advice before making a decision.

If he wants to be nice and lenient, that’s fine, but it should be on his own terms. If the cop said upfront “no problem you can call your dad and ask your lawyer, I’ll wait” then that would have been fine. But when the cop told him no multiple times and kept telling him to get in his boat, and the dude just did whatever he wanted, it makes the cop look pretty weak.

I recently got pulled over 10 minutes after a night fishing trip, cop said I reeked like alcohol (when I reeked like fish) and asked me to do field sobriety test. I had a beer 2 hours before, but failed the test due to her subjectivity and my lack of balance after spending hours on a boat. Got back to the station and passed the breathalyzer in flying colors. Still needed to spend thousands on lawyer and worried for months before I was able to get my DUI dismissed.
Short lesson: Don't take a field sobriety test, it's voluntary. You will probably get arrested and forced to take a breathalyzer but you will win if you weren't drinking.
