Regarding the question with Kim and Joe.. Why did the certified mail letter not cancel the listing, is that just not how it's done? Also if that wasn't effective, I would have thought since the original agreement wasn't an exclusive right to sell, she wouldn't be eligible for the commission anyway. I know I'm missing something... But can’t you also put a lien on personalty -such as a boat- in a mortgage loan? Not just Real Estate. Also, in example 1, how would having title insurance for the one who recorded the deed impact who holds title?

Discussing it with my teacher, he maintained that the recording of the deed makes the person the rightful owner. I showed him your question, and he maintains his answer. So which is it for sure?

Now I already have a license in NC and SC and I'm taking my Colorado state test next but I don't understand how Oscar is the owner for just taking possession if Larry recorded the deed first cause I swear there was a question in school that said a man sold his house twice and moved to a remote island and took the cash and the person who recorded first was the owner and the man was all the way off in the Bermuda triangle and did not care!! Now I got 100 on the law portion so I know a little just don't understand this one!!!

Q C Thé test is hard but if you study it’s possible! A lot of people did not pass. These videos definitely help me. The hardest test Is after you are licensed you really need to have a strong network!
quick comment and 2 questions. comment= recall Joe mentioning "don't worry about the math" i got 1/6 on the math, not your fault.. lol my questions are: does a broker need to carry his pocket card at all times? or sometimes or what.. and if a property manager has a (trust) escrow account and chris has a -$1000 balance and daryl has a credit of $2000 is this a violation of any laws or can the 2000 offset the -1000 balance or what dude. Need help..
You may never see this....but Joe signed an exclusive listing for 90 days which meant the contract will expire in 90 days or when the sale closes after it's purchased thru a buyer that Kim procured, whichever comes first. But Joe didn't wait the 90 days and created an open listing for other brokers to take a shot at it. Soooo since the house got sold within that 90day period he owes Kim and the other guy....had he waited for the 90 days to pass he wouldn't owe her anything.

The question did not say the letter was accepted by the broker. Therefore the contract was still valid for 60 more days.
She was still contracted with him for 90 days. He can’t cancel after 30 days. It is a breach of contract.
In NC we are a pure race state. So for question number 1 won't the first person to record the deed be the owner?
I am taking the exam for the third time tomorrow, hope to pass, these questions are worded so differently on the actual test.

It's a bit confusing in question about terminating an offer...what's the difference between revocation & rejection?
Revocation is pulling back on a purchase contract, rejection is denying an offer that is not yet a contract.

That Quitclaim deed easement question didn’t make sense at all
The seller used quitclaim deed to transfer property to someone else. thus terminated his easement bc not his land no more.

Because it deals with money/property. Just remember EE - Receiving OR- Giving. If you are giving money to a lender then the lender is receiving it.
