Just because the canvas cover comes off does not make it temporary or portable. The metal structure that holds it up and actually does the obstructing is NOT portable or temporary. The guy selling and installing those things must be giving a kickback to someone in that government to allow them to stay. No building or zoning inspector with an ounce of sense would allow them.
It's a technicality they are trying to get away with. The metal structure is the boat lift so it's allowed but because they attach the roof with bungies it's not a permanent roof and they only said permanent roofs aren't allowed. Building inspectors don't usually have much sense but unless someone reports you they won't go looking for violations.

The reporter is really missing the point... the material covering the thing is not the problem, doesn't matter if it's attached with clips or not, the metal frame underneath it is the problem. People shouldn't be allowed to build those frames hanging out over such a narrow waterway.
People should also be required to learn to captain a boat before taking control of the helm. Lets remember that no one else who lives around there has a problem hitting the cover.

They have a 40 foot boat in a 20 foot wide canal and can’t drive for shit If the caused that much damage to there boat they tryed ramming it out of the way but it didn’t work
@Lee Devries Unfortunately the home owner is the responsible party for insuring that the proper permit has been pulled/complied with. I'll sell this guy some outriggers if he's willing to pay $25k for them... lol
Yeah, the contractor is in the right. Temporary structures have never been permitted structures anywhere. A boat cover on a dock that can be removed is temporary. The contractor knows his laws. That’s why he’s waiting to get a ticket and go to court, the court has already defined permitted vs temporary structures many times and the local government always loses that battle. It is a temporary structure. People need to stop trying to control what people do with their own property and money. If you don’t like the covers on the canal, sell your house and move somewhere else.
Since its not being enforced then someone should just take up the whole canal with a cover and claim selective enforcement if they try to make them take it down.
Aside from the damage, this ordinance was set to stop the obstruction of views. That alone is reason to enforce the code. You can't see anything from your dock, except the neighbor's tarps..
Anything that impedes a navigable waterway or canal must be made in a way so that it does not impede the waterway and safe navigation of all vessels that normally or are able to navigate that waterway. The waterway must be kept safe during daylight or during night time use . Nothing shall protrude in such a manner that can not be seen during night navigation .
The tarp is the only temporary component of the cover... the framework is fixed permanent, that’s what did the damage in the first place, not the soft tarp! Yet not a mention of this common sense fact. Personally I’d just hook a rope to it and pull m effor down.
There was one report last summer that a family left their boat dock and went out for the day. When they came back they could no longer reach their dock. The neighbor had a contractor on standby for when the families boat went out so he could modify his dock. He had told one of the neighbors that he could not put the cover over his boat until his neighbor went out on their boat. That incident had the police involved. The neighbors attacked one another over the structure. The police made it clear that they could not make anybody take down a structure. They had to turn it over to the permit department. When I first saw this video I thought it was this case that I'm speaking of and that perhaps a verdict from permits had came through.
That’s the dumbest thing I’ve ever heard. Contractors don’t sit on “standby” and why would they wait till the boat left making sure they would be stuck in the canal and have nowhere to go. You got fed a line of bs and bought it.
When you’re operating a vessel, you are in control of that vessel, if you hit something, it’s your fault, NOT the structure you hit! Plain and simple. Question- why did they hit the dock coming in and not going out? Probably a case of too many liquid courage’s!
It's obstructing a waterway. Just like having someone's garage block part of a street. There's a good reason for that regulation. Doesn't make sense to allow these structures to remain in place and the owners not be cited.
You just can’t be obstructing the right of way. The drone footage clearly shows that the cover in fact constricts the waterway. A little common sense and compromise. The awning owner needs to clip the corner off his cover.
Probably just BARELY, and I'm sure wind has a LOT to do with being able to get past it with one of these luxury yachts these rich people have.. **I'm sure a few pitchers of whatever they drink while out on the ocean wouldn't help matters. I don't see a problem with using the covers unless the actual roof goes past the dock and into the navigable water. I believe there are rules as to how far you can go out with a dock and the roofline should be limited to that setback as well. Would be a better solution than a lengthy legal battle that ends up costing the taxpayers.
Agreed! Just keeping the cover frame bound to the boat's measurements will be a solution. But I know it won't be enough to the owner of who the sun comes at a different angle of what the cover/lift is positioned before of after noon! Well, well..they can pay the sun if they really care!
Right!?
It's a technicality they are trying to get away with. The metal structure is the boat lift so it's allowed but because they attach the roof with bungies it's not a permanent roof and they only said permanent roofs aren't allowed. Building inspectors don't usually have much sense but unless someone reports you they won't go looking for violations.
@@deckmonkey1459 the frame for the roof is extending past the boat lift. It is a navigation hazard.
@@coldwarveteran4239 EXACTLY!! The cover frame is a separate structure from the lift and has nothing to do with the function of the lift.

Wait, is the guy with the damaged Yacht the victim or the guy whose property that was damaged by the Yacht the victim? In your opinion of course.
Just because you own a boat or yacht doesn’t mean you’re rich. A lot of people live on these as a first home
The problem is not those covers lol, it’s the fact that these docks and lifts take up over 1/2 the canal lol
Yea, Florida waterways have 3 kinds of fools. The ones with a dock that takes up 1/2 the waterway, the ones with a boat that takes up 2/3 of the waterway, and the ones who can't navigate a straight line. It's great that they all decide to move down south and end up living next to each other 🙄
The reporter is really missing the point... the material covering the thing is not the problem, doesn't matter if it's attached with clips or not, the metal frame underneath it is the problem.
People shouldn't be allowed to build those frames hanging out over such a narrow waterway.
People should also be required to learn to captain a boat before taking control of the helm. Lets remember that no one else who lives around there has a problem hitting the cover.

I was thinking this lol
Define waterfront property as that means the front of your home is the canal and follow those rules
This is an "overhead covering" and a "visual obstruction". Just because this guys claims it's "temporary" doesn't change those facts. It's a violation of the ordinance. Period.
I’m so poor I walk around a popsicle and call it air conditioning. Rich people, if it’s a navigation hazard, and it’s a rule for a reason. Take them down.
Take him to court by all means. Arrogance should be rewarded promptly.
Exactly, how dare the boat owner expect the world revolve around him and his inability to captain a boat. The boat captain should pay for the damage he caused to someone elses property. Lets be reasonable here. It's not like the dock jumped out in front of the boat.
They have a 40 foot boat in a 20 foot wide canal and can’t drive for shit If the caused that much damage to there boat they tryed ramming it out of the way but it didn’t work

😂😂😂😂. You don’t listen well do you.....🤦🏼♂️🤦🏼♂️. Dumbass
@Lee Devries Unfortunately the home owner is the responsible party for insuring that the proper permit has been pulled/complied with. I personally don't see any issues with this type of cover other then it overhangs the dock to much. I would be a pissed off neighbor if this guy blocked up my canal with this.
Next time there's a hurricane I'd be worried about my sawsall getting away from me in the wind...
Brilliant man. Vigilance is critical as there is a well documented history of rampaging power tools cutting loose.
the whole video I was thinking sawzall
Since its not being enforced then someone should just take up the whole canal with a cover and claim selective enforcement if they try to make them take it down.
That’s smart.
These covers should use this guy in there commercials for how strong there temporary solution is 😂 😂
temporary does not mean poorly
They are obstructing the navigation channel, extending past the poles. Duh, take them down.
All boat docks, lifts, covers should be aligned/parallel with their seawall, why is that so hard for everyone to understand and follow ?
Boats in inland waterways are much different than open water boats And that cover company knows it
Look at the Coast Guard regulations. That structure may be a hazard to navigation

First World Problem: Your boat cover is obstructing my boat's way.
LOL!!
It's obstructing a waterway. Just like having someone's garage block part of a street. There's a good reason for that regulation. Doesn't make sense to allow these structures to remain in place and the owners not be cited.
It seems like there would be a limit on the size of the boat and dock you can have in relation to the canal also. Just saying
You just can’t be obstructing the right of way. The drone footage clearly shows that the cover in fact constricts the waterway. A little common sense and compromise. The awning owner needs to clip the corner off his cover.
Probably more like 1/3 !
And the county needs to make him do it, this is BS.
They said they hit it while returning to the dock, how the hell did they make it past when they were heading out

Why not just buy TH-cam videos with no commercials. Only $15 a month.
That's what money is for! Lol.
The cover itself may be temporary, but the framework holding the cover is permanent, and is a potential hazard.
why not close your outriggers when you come in from offshore?
Well when a big cabin cruiser comes through and they have video of a perfect navigation dead center then wind up ripping down those covers and destroying them then who is at fault?
“After sustaining over $25k in damages, we decided to blame somebody else”

The boat lift cover was installed by the previous owner. This property was sold just recently. The frame can be slid back and the height can be adjusted to a desired height. It's easy to do.

This boat has navigated past the structure multiple times. Not like you just threw it up and they were just suddenly blocked.
