    Sue for wrongful arrest. Canada literally has a treaty with the US that states all valid Canadian drivers licences are legal in the US

      mr white umm I tried searching up the “open-boarders immigration policy” or as it may be called the “open immigration policy”, I didn’t find anything having to do with what Fez337 said, and I don’t even know where you got that from, but unless you have proof of that then show it. I am very certain that Fez337 is correct about the fact that Canadians with a LEGAL drivers licence from Canada are ELIGIBLE to drive in the US, unless there are some exceptions, but I think there may not be. If you mean by “open borders”, then that’s something else, but borders aren’t that OPEN, in other words, “free” of letting through people, so that’s definitely irrelevant. As a Canadian, and one that travels to US a couple times per year, I know how borders are and I have never heard of that kind of policy.

    It’s not just Canadians being targeted. It’s with anyone driving a car with anything other than a Georgia license plate. It has been going on forever.

      Driving through Georgia with Wisconsin plates, I was pulled over for following too close to the car in front of me on the freeway. The cop actually told me I must maintain 300 feet from the car in front of me. 300 feet! He just wanted to run my license, no ticket, but clearly I was targeted.

      Absolutely true. And not just Georgia. There are departments of towns and cities off major highways which basically use seizure laws to rob people blind. If an American or Canadian stays in a motel or hotel off a major highway, expect that the staff is working with police to profile people and stop them as they leave.

      not just Canadians I got pulled over in Georgia with an Illinois license for going 68 in a 70 held me up for over two hours and brought a drug dog in. apparently it was suspicious to follow the speed limit

      It's always good to hear /see a cop or former cop speaking out for the right side when cops use their might to abuse people. I do believe there are more good ones than bad and that bad behavior from officers endangers all officers, so it's good to be reminded of it with the good ones speaking out. Especially in these days when the system does allow for way more bad cops than it should.

      Georgia is one of several states where you MUST have your Canadian Passport with you in addition to your Canadian Driver's License. The policeman was correct. Refusing to let her contact the Canadian embassy was a no no.

Canadians per se are not being targeted. Any out-of-state long distance traveller is more likely to have the book thrown at them as they are unlikely to return and mount a defense. This is also a particularly touchy time with anti-alien sentiment quite high - esp. in the deep south.

      @@douglei4413 I have never tried going to Canada without a passport. I would be surprised if Canadian customs allowed entry without advising you that USA would *not* let you back in unless you present your passport or "Real ID®" They are so helpful and polite with things like that.

      sadly, most people from other countries don't know any better because they don't have this type of corruption. USA is really the only country that thinks about suing people. Most normal people that haven't handled the law before and most likely never will don't know their rights, your in a foreign country, what to do in that type of situation and just want to get out and forget about it.
      Americans love litigation that drags on for years wasting everyone's time and money.

      The officer needs to be fired immediately. The police station needs to be under federal monitor for their abuse of policy. The policy where fines and fees go back to the police station needs to be terminated. Go google Civil Forfeiture.       I am thinking she isn't being truthful.
      She got a speeding ticket and in many states, you are required to pay for it with cash right away or you sit in jail until someone wires the money or you post a bond.
      I am thinking that is what actually happened here.
      They are returning her bond AFTER her ticket was paid per her statement.

State rules make it difficult, but it can be done. Before you can sue the state of Georgia, you must provide ante litem notice, just as you would when suing any government entity in Georgia. This is basically an overview of how you sustained your injuries and evidence to show how a Georgia state agency was liable.

    I live in New Mexico, which is a state in the US, and a family member driving through Georgia was stopped and the cop wanted to see their Mexican passport because they have a New Mexico license plate. There is a reason we are the only state in the country that has USA on our license plates

    This is the result of having a country that gives amateurs a badge. Most western countries have police training that takes years. In the US, it seems it varies, but six months of training is considered the longest and a couple of weeks the shortest. Also, most of the time in training for US police consist of how to handle a firearm with the actual laws to be enforced a very distant third on the list of priorities. US law enforcement training has more in common with how you train a soldier than how you train a police officer.

      Phinehas Treptow.. the department never suffers financially from a loss in court. the fine is either paid through taxpayer funds or through insurance.. they honestly feel no pain from losing in court. What people need to do is better educate themselves on the common laws of the place they are in, quote the laws to the officer to give them a chance to look them up and if THEY are wrong and still arrest you, then they lose qualified immunity and you can sue them personally.. THEN they'll take notice.
      until such time, sue away, the police dept will laugh at you, because anything you win is just your money being spent and given back to you

    What gets me is it just wasn't the ignorant police officer who pulled her over. When taken back to the station, the officer obviously had to tell other people why she was arrested etc. Not a single one of them seemed to know the law or care to correct the arresting officer on her mistake.

      No need to apologize. The cop did nothing wrong. Her Ontario drivers license was invalid because she was living and going to school in Kentucky. No valid license, no valid insurance. The cop had to impound the car. Also, she presented the cop with ID with two different addresses. So, the cop had no choice but to hold her until her identity and address were confirmed.

      @@creekdweller9662 - Umm... no. Qualified immunity grants government officials SOME immunity from civil suits. In other words, you can't sue them for doing their job. However, you CAN sue if you can show that the official violated "clearly established statutory or constitutional rights of which a reasonable person would have known".
      A reasonable person (especially a cop) should know that a Canadian driver's license is just as valid in the US as a US license is in Canada. So in this case, a lawsuit would be easy to pursue.

      ​@@Mr.Ekshin It's way worse than that simple interpretation. The "clearly established" standard doesn't refer to laws, reasonable people, or behavior expected of cops. "Clearly established" means established by the supreme court. In this case, there is almost certainly no existing judicial precedent for a Canadian driver's license with scanned passport on a cell phone in GA so the officer would get qualified immunity, and there will never be a precedent for similar cases so cops can literally do this everyday forever in complete immunity. A great/terrible example from 2019 came when an officer in TN ordered his dog to attack a suspect who had already surrendered. The closest "clearly established" standard involved a SCOTUS case where the suspect had surrendered by laying down. But the TN suspect surrendered by sitting down and holding their hands in the air. That little difference granted the TN officer qualified immunity which was affirmed on appeal. In another recent case some federal agents beat up a patient at a VA hospital, but they beat him up WORSE than the closest "clearly established" case, so the court granted the agents immunity. It really is that bad. Cops have complete immunity for ANYTHING that SCOTUS hadn't PRECISELY address before 1982. Think about it, cell phones and digitally scanned passports didn't even exist before 1982 so nothing related to them can ever become "clearly established".

Official issuing building permits has to know property law, building standards etc. I am a public servant and I can't explain my errors by not knowing the law. If I did something so serious as that cop did, I'd be fired on the spot and probably facing charges. And the fact that when in doubt the cop ruled against the citizen is an aggravating circumstance. When in doubt you rule for citizen, that's standard in whole developed world.

      Hey if a good cop knows the bad cop is doing bad and looks the other way that makes them both bad are all bad they know what's going on got any time I'm sure there was many cops on duty that could have stopped that guaranteed many more knew what was going on at the time and none of them stopped it that makes them all guilty of the same thing I've heard many judges say ignorance is no excuse unless the shoe's on the other foot

      @@ryanm7263 actually that is not true Canadian ID and drivers licenses are recognized legitimate forms of ID in the US by a ratified treaty and reciprocity that is unique to Canada and the US it was ratified in 1932!! So it is not like it is a new thing. All states including Georgia must by federal law except a valid Canadian ID and license the same as they would New Yorks, Ks, TX or any other states legally recognized entity. However this officer violated Georgia law, also a Nexus card is a recognized visa and I quote from the Georgia statute "Non-US citizens holding a valid foreign driver’s license are allowed to drive in the state of Georgia for tourism or business purposes. In the case of a driver license issued by the driver's licensing authority of a foreign country, a law officer may consult such person's passport OR visa to verify the validity of such license, if available." Being a student is a temporary residency and does not establish a permanent residency status required for a state residency as the student from a foreign nation and who is retaining their foreign citizenship is clearly in a temporary status as is a student who goes back to their home state when not attending courses, maintains their home states residency. This also has been established as federally recognized law and was formalized by the US Supreme Court in 1973. So yes the officer and the department are subject to state and federal criminal and civil penalties all because the officer did not consult the statutes or radio for consultation from her superior as is required by the law in the US. A law enforcement officer must have probable cause that a crime was committed to effect an arrest under sworn oath to both the US Constitution and their respective state Constitutions and since she (the driver) was within both state and federal law then, and the officer was unsure of the law. Then the legal choice is seek clarification or in the absence of actually knowing a violation occurred the officer was obligated to release the individual, anything else was abuse of power, criminal violation and a violation of civil rights. So again yes the officer and the Employing Dept. are culpable and open to litigation.

      No need. Read the real story. She brought this all on herself. She was living and going to school in Kentucky and thus her Ontario license was void and with it, her insurance. She gave the cop two ID's with two different addresses. She never bothered to exchange her license and plates for Kentucky ones. Or change her address on her insurance.

    Have your Canadian governor or ambassador file a diplomatic protest. Then hire a lawyer and sue the PD. The officer will do it again if you don’t sue. More Canadians will be victims if you only want formal reprimand.

      legally a foreign licenc, despite its international and accepted in many country, you have to have your passport with you or your birth certificate if you were canadian

      Reminds me of the movie "My Cousin Vinnie". They didn't make thay movie for nothing. Every movie has a message. Unfortunately, this not only happens in Georgia. But the south has a "reputation." Sad that a visitor to our country sees what it's really like. The good thing, not every police officer is like this. There's still a few good ones out there. Sorry for the inconvenience and bs you had to experience.

    Wow! When I was pulled over for headlights off while driving a friend's car in San Francisco, I didn't even have my license on me. I had forgotten it back in Vancouver. All I had on me was my passport, but the officer was super nice about it. He showed me how to turn on the headlights, suggested I apply for an international licence if I was going to be in the States more than thirty days, and sent me on my way.
    I always knew I was extremely lucky - especially since I only had an Ontario G1 at the time and wasn't technically supposed to be driving alone and after midnight if I'd been back in Ontario. He took my word that I even had a license at all!
    But seeing how this young woman was treated I'm realizing things could've gone so much worse!

      @@AkbarSnackbar There is no law universally reimbursing legal fees, especially for civil suits. That's why people usually lose money even if they win a civil asset forfeiture case. The legal fees cost more than the money seized so they lose money even if they win. That's by design so police can abuse civil asset forfeiture and make it not worth it for people to try and get their money back.

      Well, in almost every other profession, any and all of what you suggest might be the consequence of such egregious (or similar) conduct...EXCEPT in law enforcement. Somehow, the police in the U.S. are ALLOWED to make mistakes and, in the vast majority of cases (99%?), pay no price.
      The rest of us are not afforded that courtesy.

      They "owe" her nothing. She can sue to her heart's content, and the case will be dismissed each and every time. What happened here is literally next to nothing. An arrest without a conviction means she was inconvenienced for a few hours. Lawsuits aren't based on being inconvenienced, they're based on quantifiable damages. So, unless she missed some event that was going to ruin her income for life, she's SOL. Suing the government is typically pointless.

      Qualified Immunity. Not knowing the law isn’t grounds to fire public employees. The standard is to actually prove they willfully violated rights or broke a law they “ought to know”. It a sick standard, but you’re talking about years of expensive litigation in a foreign country and an award in the 10s of thousands. And IF a settlement is declined and the settlement awarded later is lower than the original, they lose that.

      Got two more stories relevant to that.
      -- I was pulled over on another interstate, not for anything driving-related but just for having a license plate that said Mississippi and not South Carolina, and the clown sat me in his patrol car asking my why my parents weren't travelling with me. I said "well I'm 42 years old and they have their own lives now". He just looked puzzled and didn't know what to make of the whole thing. Not even making that up.
      -- A friend of mine moved to New Orléans from New Jersey, went to apply for a Louisiana driver's license, they asked her for ID and she gave them her birth certificate.
      "Dat ain't no gut" the clerk said.
      "Why not" asked my friend.
      The clerk said..... wait for it.... "it's not from here".
      You just want to find a wall to bash your own head into....
