Tightening the bolt that goes through the main hoop will correct this problem! Sometimes you have to shorten the pipe spacer that the bolt goes through also. That will close up the gap between the legs of the main hoop.
your first problem is your need to use 3rd hole in handle as the pivot and you wont have that problem.

You could turn the handle upside down .. that looks flat
