    An incredibly human reaction from Joe here, I remember my family being shocked that he would lie even for a moment about the Justice’s condition. But in that moment he’s not only frustrated with the prevailing political winds, but heartbroken that Toby was right.

      Thinking back to Matthew’s time on WEST WING I think of this storyline. Joe loves the Chief Justice so much, and his heart aches.
      And all these Democrats in charge have tunnel vision, only interested in what they need. Toby, especially, can forget to even think of the other person’s feelings.
      I’m glad to finally have the season and episode listed so I can follow all of Joe’s time in the Bartlett White House.

      Imho this was a classic example of why Supreme Court and federal court justices should have age limits. In Australia about 40+ years ago we made 75 the mandatory retirement age and our legal system hasn’t fallen apart! Also ALL our High Court (the equivalent of the US Supreme Court) justices are expected to recuse themselves from any possible political decisions!

      And just so you know, when tabulating their rulings, Trump's nominees make up 3 of the 4 members most moderate members of the court. The Democrat-nominated members comprise the 5th, 6th, and 9th most moderate. So, there's really no cause for your statement. Trump's judges are actually very serious people.

      Not necessarily age limits, but cognitive and ethical tests. I am not sure which candidate would fare worse.

      Capability, cognitive, and ethical tests are all subjective. You can't argue against a birth certificate. Many state and local level judges have age limits already. There's absolutely no reason not to change the supreme court justice appointments to "up to age XX." I suggest age 72, maybe age 75.
      If most of the general public retires by age 70 or 72 (if not before), then that's good enough for politicians and judges too.

    Again, there should be term limits. We have seen in recent years, people occupying positions of authority and power who were well past the time of retirement. Having a lifetime hold over a role is something I strongly disagree with.
    I do sympathize with Joe perspective, but ultimately, I agree with Toby's standpoint.

      I'm more of a fan of age limits instead of term limits. There's nothing inherently wrong with someone staying in politics for a long time, and the issue of people amassing wealth or power over their time there can be dealt with by other laws and regulations. There definitely is something wrong with letting someone remain in politics after their physical, or particularly mental, faculties have started to fail or wear out from old age. Just like how we make aging folks retire from the workplace in their 60s, so to should politicians be forced out at the same age. The average age of the US Congress is currently 58, so just age limits alone would help clean the legislature up and allow more opportunities for fresh faces to get in.

      @@_Hoagie - I'm personally for both (whichever is more relevant to the position at hand).
      Whilst I'm sure that there are exceptions to this rule, most people over the age of 70 don't have the mental and physical stamina and capabilities to hold down a full-time job - especially one where you hold significant power, authority and influence. Which is what public office is all about.

      @@_Hoagie Age limits are an interesting idea. Term limits, on the other hand, are a terrible one. People are against ‘insiders’ nowadays, but these political and government positions are like any other job. People develop salient skills and knowledge as they gain experience. They also can develop trust with one another, that can help them get things done and weather tough times together. Term limits are a way to ensure that amateurs are in charge. A remedy that is worse than the disease it aims to cure.

      @@_Hoagie We do not make aging folks retire from the work place - they choose to retire or they are let go often because they cost their employers too much in benefits and salary over a long tenure. The GOP wants to increase the year you can claim social security to 70 instead of 65. Recently I watched Dr Fauci be interviewed by Lawrence O'Donnell and he's the same age as President Biden but he comes across much younger. The presidency ages everyone. Individuals age differently. I think an upper age limit is fine for the year you would begin your administration - 70 is about right as a max. But in my opinion, age is not the big problem but how long they have to be lobbied and have millions of dollars funneled into their campaigns to buy a vote and stay in power. Citizens United (2010) was a huge turning point, not the beginning of all the pay to play but it opened the door to much bigger influence and dollars pumping into the campaigns.

    It's weird because everybody talks about the supreme court being independent and yet every president who can appoints his own people, to sway it one way or another. Terms should be fixed and the chief justice should be independent of any party.

    A timely posting. TERM LIMITS! The original idea for lifetime appointments was so they wouldn't be influenced by outside sources, knowing they had a job for life. We can see how that's working out with the greedy bastards on the Court now. No amount of money is ever enough for some people. I'd even give them a limit as long as 20 years but then they have to leave and live under the same laws they helped reinforce as the rest of us.

    It's false to assume that Matthew Perry's character lied. Look at their eyes -- the fact is, Toby knew the Chief Justice was unconscious the whole time, cuz Joe told him in his body language. What he says is less important, even though it's the essence -- LOYALTY.
    Toby knows Joe is the Chief Justice's man. So he didn't ask for disloyalty, which is what ratting out the Chief would have been. Toby got what he really asked for -- a candor beyond words.

      Toby has laser vision, he’s the harshest of the group. You notice all the young staff judge ‘Democrats-good. Republicans-bad’ And I know this could have been reverse Party Administration and it could be the same. Leo has a much calmer demeanor, and kinder attitude. “Let’s just take five and talk about it.” With age comes wisdom.
      I remember Ronald Reagan said Tip O’Neill was one of his closest friends, ‘after 6 P.M.’
