    Hi everyone, several people have asked this question: "Why does a person need to apply for a waiver and consular process if they are married to a US citizen spouse?" Great question. Being married to a US citizen does NOT cure all immigration problems! For example, if a person entered the country WITHOUT inspection at the border, she cannot adjust her status unless she is a victim of domestic violence (or fall into another category where an exemption is allowed). In order to adjust your status, you must have been inspected and admitted in the U.S. Otherwise, you must consular process. When you apply for adjustment of status, the government will ask you to prove that you had a lawful entry (i.e., I-94 record).     I have a question: the uscis says "The provisional unlawful presence waiver process allows those individuals who are statutorily eligible for an immigrant visa (immediate relatives, family-sponsored or employment-based immigrants as well as Diversity Visa selectees); who only need a waiver of inadmissibility for unlawful presence to apply for that waiver in the United States before they depart for their immigrant visa interview." The people can obtain waiver by the "employment-based"? Where I can find those 2 peoples that can give to person a waiver because law says "Since March 4, 2013, certain immigrant visa applicants who are immediate relatives (spouses, children and parents) of U.S. citizens can apply for provisional unlawful presence waivers" and don't show above 21 years or below, just children.     Im a US citizen and my girlfriend is an illegal immigrant here in the US. She entered illegally and has been here for 3 years. If we decide to get married and she applys for a green card she will have to go back to her home country and apply over there at the US embassy. I doubt we will be eligable for the waiver due to hardship. When she goes back to her home country how will they decide how long before she can return to the US? Ive read it can be 3 to 10 years. This scares me because if thats the case we might as well not even go through with this whole process.

    Hello, hoping you can answer my question.. I just became a Canadian citizen. Here in Vancouver BC; I am originally from Mexico and i got brought to the USA when I was 13 with my parents. I Lived there for almost 30 years. I left the country back to Mexico 5 years ago As I was waiting for my Canadian passport. I have it now.. My question is what are the chances of me being denied entry to US or what’s the worst that could happen if they find out I used to live there? I have family there that I haven’t seen in over 5 years. Thank you

    Has anything change on the unlawful waiver ? My parents been here cense 1991 I petition them on 2003 but they were not approve. My dad because they found an Oder of deportation by a judge voluntarily to leave the USA 🇺🇸 witch he never left. Mom Hers was denied because she got caught to many times trying to enter the border. So do I have any hope of getting them legal?

    I came to United in 2013
    with tourist visa I overstayed and got in trouble 3 times 2 of my cases (2013/2015) were dismissed and the 3rd case was in 2016 I was charged with Trespass in the Second (2nd) Degree is classified as an A Misdemeanor (140.15)
    I find a company that going to sponsor me and I want to use the waiver I-601A.
    my mom she’s permanent resident
    She’s 73 years old.
    My questions are : is the Misdemeanor will a problem? Do I need another waiver?
    What should I do ?

    This waiver I believe only applies to people who have overstayed but have either a US citizen parents or a GC holder spouse.
    It does not apply people who what to adjust status through marriage to a USC spouse cos the overstay is automatically forgiven without a waiver.
    Pls correct me if am wrong.

      @Sheila Gomez: If someone enters the country illegaly, the person cannot even overstay because there is no record of him or her in the states.
      The lawyer is referring to those who entered legally and have overstayed their i-94.
      However, she is mixing things up because overstay is not a crime once u marry a USC. U do not need a waiver and u do not need consular processing to get a green card.
      U only need a waiver if ur married to a GC holder or u have a USC parent but have overstayed ur i-94.

      Apologies for the delay in responding...busy time for us...people who have entered without inspection at a border face a number of big challenges. However, if they are eligible for the I601A waiver, this might be their only way to obtaining a Green Card. Every case is different, however. If they have other immigration violations, the I601A waiver does not cure those additional problems.

    This what my girlfriend is going through, she brought her daughter over here because of abuse of the severe kind but now she has over stayed a year. Mother just got her 10 yr green card and she is stressed about what to do with her daughters status. I think her daughter can use this, she is only 16yrs old turning 17 in January

    My husband I 290 be approved in November 16 now we are waiting for decision on I 130 every time I call they said your application with officer he is working on it it’s been over 90 days any idea when they can finish there review because thay told me there is no time frame

      Haramestatets Haramestates hi it can take up to 6 months and you should be able to have a case number and you can also look it up online, I got mine that I was approved trough email then I had to pay the Fees for it, it does take time too

      Great question. Some misdemeanors are taken very seriously under immigration laws (e.g., child endangerment). A lawyer need to analyze the specific offense to determine whether it may interfere with naturalization's good moral character requirement.

      Honestly ,the information she's giving out is not completely correct.
      U don't need a waiver or consular processing if you have a USC SPOUSE and are already in the states.

      Hi Jackie, a USC spouse doesn't cure all immigration problems. If a person entered the country without being inspected or admitted by a border agent, he/she cannot adjust their status here (unless they are a victim of domestic violence or fall into certain categories). Thus, the person will need to consular process unless he can prove to the government that he had a lawful entry.
      "The applicant must have been:

    Hi sweet heart. Ok basically I applied for my husband in 2016 and now after he had his interview he got a letter after the interview saying president proclamation law. Now everytime I check his status it says he is under administrative processing. How long does that take and what does it mean when they email you saying your case is being considered for a waiver. Now do I have to apply for that waiver or just wait. Plus my spouse is from yemen. Hope you make a video about this or respond to my comment. Thank you

    An immigration attorney informed me that even after a waiver, an I 601 A, and once oversees, the American embassy in that country can deny the petition that was approved here. Then what, stuck without authorization to re-enter. Thoughts? Thanks

    my wife came here on a visa but made a false statement on her visa(tourist) she did not intend to stay we meet through the church got married applied for green card and were denied i never received denial notice in mail with reason but do know it is because she said her live in boy friend at the time was her husband when applying form a tourist visa ( she did so because her actual husband was in USA via Mexico illegally and told her / ordered her to go to embassy with his brother and say he is your husband and get via so they would be in US together) so bottom line is she did what she was told by her husband and got the visa came here and divorced her husband and we meet. Now she forgot that she put that on her original via app when we went for interview it was bad. Seems like she commited fraud to obtain visa. Now we are married i am American born citizen and our app rejected and my wife is my life the gift from God ! In 54 years on earth my life was a mess and i was never stable and happy...now i am. What can we do now? Randy T

    USCIS website only shows Nebraska timeline. I have my husband who submitted I-601A waiver in January and got receipt from Potomac center. How long is Potomac taking from receiving to approval?

      Gabriel, I don't know how long Potomac is taking. On average (based on data from all USCIS offices), it's taking 7.8 months. See chart at egov.uscis.gov/processing-times/historic-pt.
