Flea was playing wrong notes, he was playing the wrong chord a the wrong time. Listen to how Le Freak goes, or just listen to the chords Niles is playing in the beginning and keep them going in your head during the pause before Niles starts the full guitar part. Flea is just wrong, he panicked and started playing the chord progression twice as fast as he was in the intro, so he had already plaed the d minor 7 chord before it arrives. This is 100% Flea messing up. Niles knows his own song, he didn't mess up, though he could have corrected in a more subtle way to not expose flea.

People don’t realise what jam means if the majority of them does by tabs most of the time or never ever jam at all... it didn’t sound out of sync nor out of scale to me. It use to happen several time in my Band also, a good funk guitarist tries to figure out what is actually going on, then if it means to stop a second, it doesn’t mean the bassist can’t play... whatever. I assume Flea knows what he doing!
