    I got this form in the mail which got sent to my moms house and I only used her address for my bankruptcy and it just asks for my signature

    Ive filled out the 2848 and my dads tax return. How do I sign the actual return.Do I mail the 2848, my current POA and return to the 2848 address or mail the tax return to it's separate address. Do I have to wait for approval from the IRS before mailing in the tax return? Thanks for the video!

    Also, for partnerships, make sure the "title" is filled out by the taxpayer/signer. I've had one rejected because there was no title filled in.

    For line 3, can you list multiple forms on the same line? For example can you have Issue: Employment ; Form Number: 941, 945, W-2 ; Year: 2016-2020

      Great question! Unfortunately each form needs to have its own line, as the filing periods are different (941 quarterly, 940 annually, etc).

    I’m a bit confused, is this only for tax professionals? I’m to manage my dads bank accounts under my name and I think I need power of attorney. I’m not a lawyer or anything and have not passed any law exams. In order for me to manage my dads bank account for the union (where he was employed and has benefits), they told me they need proof that I am power of attorney. Is this the form I need to fill out? On line 3 do I talk about how I need this in order to be in control of the benefits my dad is receiving from the union? Thanks

    Question:
    If someone is not an Attorney, certified Public Accountant or Enrolled Agent but yearly pass the AFTR Exam. Which of the a-r declared such AFTR completion or passed individual that help people prepared their taxes on form 2484.

      Hi! According to IRS Form 2848 instructions, unenrolled tax preparers (someone who passes the AFTR Exam but is not a CPA, EA, or attorney) has the following representation restrictions if they fill out Form 2848: "Unenrolled return preparers
      may only represent taxpayers before revenue agents, customer
      service representatives, or similar officers and employees of the
      Internal Revenue Service (including the Taxpayer Advocate
      Service) during an examination of the tax period covered by the
      tax return they prepared and signed (or prepared if there is no
      signature space on the form). Unenrolled return preparers
      cannot represent taxpayers, regardless of the circumstances
      requiring representation, before appeals officers, revenue
      officers, attorneys from the Office of Chief Counsel, or similar
      officers or employees of the Internal Revenue Service or the
      Department of the Treasury. Unenrolled return preparers cannot
      execute closing agreements, extend the statutory period for tax
      assessments or collection of tax, execute waivers, execute
      claims for refund, or sign any document on behalf of a taxpayer."

    I'm having problems filling this out because I'm a little confused about 5a
    I already have power of attorney but I guess you have to fill this form out as well so if somebody can help me out with 5A I would really appreciate it I don't know what to put there.
    I have to mail the send because of a qualifying dependent that I'm claiming which is my daughter because I have supported her all year long even though she's married her husband is in the military and he is not supporting her I am so because her social was recognized once in the system it's bouncing me back to I have to mail mine in crap
    otherwise it would have been as simple as electronically filing and I wouldn't be dealing with this garbage right now.

      Yes! Form 2848 can be used to represent an immediate family member. On page 2, the person would select classification "F".

    If I am representing a deceased tax filer who is applying for an ITIN and filing 1040NR together, can I submit this form in the same package?

      Great question! This is trickier and not very common. Our thinking is yes you can file the 2848 with Form W-7 and Form 1040NR. In general, (there are a handful of exceptions), you cannot apply for an ITIN without filing a tax return along with the application. So if a taxpayer is deceased, and applying for an ITIN, you should be able to file a power of attorney as well.

      Canopy, Thank you for your reply. The matter is further complicated by the fact that the decedent is a foreigner and has to file a tax return to get a refund because he sold real estate and taxes were withheld. Any chance I can discuss this with you?

      Ellen. This definitely is a unique situation! It's important to note that Canopy does not offer any official tax advice, but after putting our heads together, its our understanding that the decedents representative will provide the CPA (tax preparer/representative) the 2848 and will fill out form W-7 to apply for an ITIN for the decedent. Once the CPA has these two forms then you can proceed with preparing the Form 1040NR. Once the 1040NR is prepared the decedents representative will need to sign the return and send the paper copy of the return to the IRS along with the form W-7. One difficult part of the process will be getting the W-7 documents needed. For example, the IRS requires the original or certified copy of the passport from the issuing agency to be sent in with the W-7 (ITIN application) to the IRS. The IRS will then send the original/certified passport back to the decedents representative after approval.     Do I need to fill this form out or any form to file taxes for my brother who is incarcerated (he worked for help the year before being incarcerated), I have power of attorney.

      Hi! If you already have Power of Attorney for your brother then you can file his taxes, you wouldn't need to fill out this form again.

    If the entity is a partnership, the form must be signed by one of the partners, and the title should be "member" or "partner." This is the case even if the signer is a representative of a corporate partner, even though calling such person a "member" or "partner" is factually untrue.

      Hi! You can file your boyfriend's tax return on his behalf as long as he provides his signature. You can also file a Form 8821 to access his tax information if he provides his signature. Either way, you won't need to file a Form 2848. This form is only available in specific cases.

      Hi Timothy! You can get a CAF number by submitting Form 2848 or 8821 to the IRS and writing “None” in the space designated for the CAF number. The IRS will send you a CAF number within a few weeks.
