      Because NOT all parts of the tree is dead, just some branches were. You do know that trees have branches that spread out, right? Sometimes the tree split into 2 main ones like a V. One section could go dead and other is fine. It happens.

    That tree is not dead but dormant. It might as well be dead due to the butchering. The "green" thing nearby is an evergreen (conifer). Good grief JJ. They have the right to "prune" the tree but that is a terrible job.

      The section that is protruding WAS CUT. Too bad if it looks bad. Owner of the tree should have known how big the tree is going to be BEFORE he planted it. It sure don't look like it is 20 FEET Back from the Fence from the main Trunk of the Tree....

      Looks like it was cut where the fence line is....the guy that owned the tree should have known that was an evergreen and that it was going to drop leaves and kept it trimmed down himself ...or at the very least offer to pay for maintence on the pool

      Ikr! she’s acting like she’s a pro saying deciduous or evergreen but doesn’t even know what a cedar tree looks like. That tree is totally alive and his neighbours pruned branches of that tree that were not hanging over their property. JJ screwed up.

    3:14 obviously the dude cut the tree branches inappropriately.. one can only cut what hangs over your own property. This dude went a good 20 feet further.

    I can sympathize with the plaintiff saying the tree isn't dead. We have a neighbor who has a large tree like that. It's easily 4 or 5 stories tall. Earlier this year, we had a cold snap and trees all over were falling apart and damaging fences. This tree was no exception, and after the springtime, when all the other trees were green with leaves, this one sat bare. I thought it was dead, and would only be a liability to the new fence we had paid half to have put up as a result of their tree breaking and smashing the old one. But sure enough, toward the end of spring, beginning of summer, that tree, like all the rest, was green with leaves.

      Old and diseased trees can still get leaves. There's a huge, gnarly tree behind the fence of my neighbors' and twice in 10 years, two sections of that tree fell over into my back yard. These sections both were large enough to have killed somebody. They sawed and haul them away, yet the main portion of tree remains which may or may not fall into my yard. But why take chances? They know it's dangerous, yet allow it to stay.

      Re the it must be dead because "everything else all around it is green" was the stupidest thing I've ever heard Judge Judy say. Everything else all around it was clearly conifer. The tree might have looked dead but it's winter and it had been cut (chain sawed) back almost to the trunk, way past the fence line and she'd already established it was deciduous. Once spring arrives it will get leaves and grow back some small branches but it's always going to be a weird shape because of the way it has been butchered. It wasn't an old tree even, he'd only planted it 23 years ago.
      Don't people with pools also usually have pool covers so that leaves, bird droppings and general dirt and detritus don't get in their pools? Even with those branches cut off they will still get leaves in their garden because the trees shed most when it is windy. Just rake them up and use them as a mulch.

      Trees fall down when they die a tree can turn white is still alive until it fall down. No matter how tall it is no matter how old it gets no matter whether any trees bloom or not or whatever where they lose all this leaves or whatever it's not dead until it falls down no matter how crazy it looks.

      @@laceandbits Regardless, if the part of the tree go past the property line, the homeowner on the other side have a right to CUT it off at their property line. You should know what tree you are planting and how big it is going to get BEFORE you plant it. Just a matter of Courtesy.

      @@1flash3571 But they hadn't just cut it off at the property line. Their gardener/odd job man had butchered it back almost to the trunk from the side and from above. He must have been on the tree owner's property to do it which is trespass. My comment was mostly about how stupid Judge Judy's comment was. If it had been cut back just to the fence line no one would have been upset, even the tree owner.
      We have neighbours' trees overhanging our property, and if they come further than we want we trim them. I far prefer that softening of the boundary to having an empty fence-line corridor with no trees or plants just in case something hangs over and upsets someone. If I had a pool I would put a cover over it in the autumn but as it is I rake up the leaves and use them for mulch on the vegetable beds. Win win as far as I am concerned, and I would never be
      discourteous to do this to someone else's tree.

    In my state, you can not cut a tree on someone else's property. No matter what. You can cut or trim up to your property line. Now if a tree fell or branches and damaged your fence, house or anything else, the trees owner is responsible for any damage. It does NOT include leaves from a tree. How would anyone know if it's was that trees leaves that clogged a drain. It's ridiculous.

      @m rapacki What are you looking at? There looks to be a three way split towards the top, they cut the two limbs extending beyond the wall on their side which so happens to be the larger branches on the fork and would have most of the leaves. Most likely the house and other trees blocking some of the light encouraged the tree to grow to the only open space directly over the neighbors yard. Also this pic HAS to be late fall or early spring Im thinking, the owner said it was alive and the neighbors wouldnt have cut it if it wasnt dropping leaves so its NOT dead and there are no leaves on any similar branch or tree in pic, only the evergreens have leaves. Once the spring opens up and the leaves sprout it obviously wont look like before but itll be better than it looks in the pic

      @m rapacki He said he originally PLANTED it about 23 ft from the line, that tree grew off at an angle towards the neighbors where it forked and spread out over the prop line. But honestly is hard to tell anything for sure from the one pic. This tree should survive this though and I do agree with you its best to at least talk to your neighbors before doing something like this. Its just common respect

    An arborist would tell this judge that what this gardener did was butcher this tree. The Judge is not an expert in trees. Many trees lose their leaves and look dead but come spring grow and have leaves that make it look like a different tree. Also if this tree was dead, then there would be no need to cut the branches over leaves getting into the pool (which is why the gardener was called in the first place).

      The defendants were lazy and cheap because an arborist would be a whole lot more expensive than a guy who knows how to trim roses and pull weeds.

      I agree, however, if you're going to have such a large tree in your yard... you should educate yourself on the tree and arboreal information, in case this happens.
      He said: "No its the lighting, it's not dead. They just butchered it."
      That inspires nothing to believe.
      If he'd said: "If the tree was dead, it wouldn't have produced leaves for them to complain about. It's currently just dormant until spring, then it'll grow its leaves again."
      She likely would've heard him out, and asked some more questions to get validity of the claim. Etc.
      When you go to court, YOU have to present your case in the best manner possible. That's not on her, but on him.

      @@FtanmoOfEtheirys This is correct, and many states have a law that requires you to pay triple the cost to replant an equivalent tree. So if you cut down a 100 year old oak tree that would cost 2 million to source, transport and replant you would be responsible for 6 million in damages.

    The tree's owner said the chop job was done in February. Doesn't Judge Judy know that a deciduous tree has no leaves in February but it's certainly not dead, as she surmised from the photo??

    I've always thought the JJ was a bit ummm thick, but this confirms it. She says the tree is clearly dead because all the other trees around it are green...and this was just after she asked if the tree was a deciduous tree or an ever green. Yeah lady, all the trees around the one in question are clearly ever greens which means they do not lose their leaves. That the "gardener" did was way more than a trimming, it was a massacre. The tree isn't dead yet but it will be from that "trimming" in a few years.

    I got paperwork from an arborist that was given to my neighbor to give us permission to prune part of her tree that hangs over our roof.

    The plaintiff should have hired an arborist to get the value of the tree and could have provided documentation, including the health of tree. If you are going to go to court, you don't do it by the seat of your pants.

      I personally don't know much about this law but usually the people who cut down the trees without permission are fined from 80k - 450k dollars... It also depends on what type of tree it is If it's for example a 100 year old pine tree on your property, the person who cut it down is in another world of fucked.
      This is per tree btw if for example someone cut down like 5 or 8 trees that would stack up lmao.

      The defendants have air rights that extend literally to space over their property line. They can trim any branch or limb that extends into their property, at the property line.

      @@RobertLinthicum while that is true, they cannot cut down a trees limbs or otherwise if it will kill the tree. That’s why arborist have to go through training on how to properly trim all different species of trees and follow guidelines. Killing trees makes them more of a liability in the long term and trees are quite expensive when it comes to cost of replacing.

    If the tree was dead it wouldn't be dropping leaves in the pool. The tree wasn't pruned, it was hacked to a nub.
    Everything around it is green because they are cedars which are evergreen. Judge is too hasty, guess she has better things to do. Not a good reference for that professional tree pruner, you'd be nuts to hire him after that.

    Clearly judge Judy has little knowledge on plants 😂😂😂 he clearly stated it is a variety that loses its leaves and she’s going to argue that it’s dead? 🤦‍♀️ Also MOST places you can only cut up to the property line when it comes to trees.     You are only allowed to trim the part of the tree that is in your own yard. Many trees leaf out late. Rose of Sharon and Hibiscus don't leaf out until super late either.

    The trees in the background are coniferous. It looks like it's Autumn or Winter so his tree wouldn't have leaves. Either way, they've made a mess of limbing the tree.

    In my state, you are perfectly within your right to prune branches that hang onto your side of a property boundary. Those branches are *your* property, but you cannot cut down the tree if it is planted off of your property.

      In UK law you can prune from the boundary, but legally the branches (and fruit etc) are still owned by the tree owner, so should be offered to the owner. In the real world , no-one is going to offer or want prunings. But I guess the law is there if the wood has value as timber or firewood. Or has fruit.

    The other trees around are pine trees. They're always green. That tree was NOT dead. It was trimmed horribly wrong though.

    Judge Judy is clearly not aware of Tree laws. You do in fact need permission to cut down branches another person's tree even if they are hanging over onto your property.

      Some trees have more than one branch that is alive. Those branches do grow leaves.

      Plaintiff was right tho, this is a case where JJ was wrong. If the tree were dead, it'd have no leaves which feeds back into the original issue with the case.

    In Texas if a tree grows onto your property you may cut it back to the property line and even if that kills the tree you are within your rights to cut the tree.

    This is a rare failure from Judge Judy. You can only trim branches that go over your Property line. Also if the tree were dead it wouldn't be able to make leaves (obviously).

    Ok so my parents have a pool with neighbors trees whom were closer to the fences than this guy's trees. Admittedly, they hated leaves in their pool too however, this was why, during storms during the spring and summer, my dad would cover his pool to avoid the leaves and he would close his pool for the year just as leaves would start to fall in autumn. There were several larger overhanging branches that were trimmed occasionally and he was legal to do so in my state as long as it was over the property line. Needless to say, when the tree died from disease in 2019 and the neighbors had to cut it down, he was happy to help front some of the cost of removal lol, especially because it would permanently rid his pool area of leaves lmao. He had even called a landscaper to clean his yard each year after all the leaves fell, not because he was too lazy to do so but because he was a teacher and sports coach and had more important things to do. I personally will note that since the trees removal, he actually misses the natural shade sometimes to the point where he had to buy a small gazebo for the back area of the pool where its shade used to fully cover. He still doesnt have regrets that the tree was removed though.
    This case has me dumbfounded.

    I'm an ISA certified arborist. In Utah, if there is a tree hanging over your property line, you have the right to cut anything hanging over that property line, BUT if in doing so you cause the tree to die, the owner of the tree can now sue you for the value of the tree x3. Yep. In addition, if the tree falls onto your property, you are responsible for the damage done by the tree, not the owner of the tree. Nobody ever believes me when I say it, but it's law.

    In English law you have the right to trim off any branches of a tree that overhangs your land, but only as far back as the boundary. Technically you should then offer the cut branches to the neighbour as they remain his property but his consent to the cutting is not required. Also the local council can slap a Tree Preservation Order on particularly fine or old trees, and you then need their consent for any work at all and to use a reputable tree surgeon. The guy who lives behind us has two fine beeches which are subject to TPOs and we are always notified by the Council of permitted work being carried out.

    They only had a right to prune to the property line... looks like they pruned all the way back to the trunk which if the tree was 23 feet inside the properly line, would be WAY overstepping their rights.

    In our country we have the right to cut our neighbours shrubs or trees up to the boundary line. We also have the right to place the cut sections of the plants on the neighbours property for them to dispose of. I did this to my neighbours trees that were hanging over my driveway.
    The neighbour was a cop, he thought he could intimidate me. I got in his face and told him he needed to read council bylaws.
    I unfortunately got his dog impounded once. It kept wondering onto my property. He did nothing about fencing it in. I got tired of having to return the dog, so l rang dog control. Normally an owner gets two warnings, then the dog impounded on the third complaint. Because he was a cop, the dog was immediately taken. No credits for breaking the bylaws in our city if your a cop. Hopefully the dog went to a better family.

    Judge Judy is dead wrong here - that tree is deciduous and the trees in the background are conifers... so it's entire possible for the trees around to to be green while it is still leafless during the dormant season. But how they butchered it, it may be dead soon.

    Our neighbor would ask if he could cut a tree out of the fence line. We would ask if we could cut limbs hanging over the fence line. That is how we communicate. Neither of us will cut trees/limbs without asking each other first.

    Tree law is one of the most controversial laws there is. You can trim a tree over and up to property line as long as you don’t damage or kill it. They killed this tree and should have to pay.

      Actually, any tree branch - no matter how high the tree is, that hangs over the fence line or open property line, is fair game for the neighbor to trim. My neighbors tall tree branches hang over my garage. Causing green mold to grow on my garage roof shingles, because the roof doesn't fully dry because of the constant shade the tree branches cause.
      So, I climbed on my garage roof, and cut branches. My neighbor called the police, but the cops informed my neighbor that anything over my fence belongs to me.
      So did the judge, when my neighbor took me to court. So believe it when you hear of a tree law.

      To be on the safe side, I checked with the codes department before I trimmed a bush back. I gave my neighbor the opportunity to do it themselves first to be nice. It had grown to almost 5’ onto my side of the property.
