    1.Area Wise Contribution :
    Following charges shall be calculated as per area of the flat. However in Bye-Law which area should be consider for Repair & Maintenance Fund and Sinking Fund is not mentioned, So we will suggest consider the built up area, like in Bye-Law suggested Building Insurance should be ( 67(a)(11) calculated on built up area of each flat.
    Repair & Maintenance Fund - Bye Law - 13 (a) & 67 (a) (3)
    Sinking Fund - Bye Law - 13 ( c ) & 67 (a) (5)
    Property Tax - Bye Law - 67 (a) (1)
    Building Insurance - Bye Law - 67 (a) (11)
    Repair & Maintenance Fund - Bye-Law No 13(a)
    Let us assume @ 800/ - Sq Ft then formula would be:
    Construction Cost x .75% x Flat Area / 12 = Member Monthly Repair Fund
    Ex: 800 x .75% x 524
    ------------------------ = 262

    Sinking Fund Calculation - Bye-Law No. 13(c ):
    Let us assume @ 800/ - Sq Ft then formula would be:
    Construction Cost x .25% x Flat Area / 12 = Member Monthly Repair Fund
    Ex: 800 x .25% x 524
    ---------------------------- = 87

    2. Equal Contribution: Service Charges/Maintenance Charge: Bye Law - 65 (g), 66 & 67 - Service charges should be divided equally to all members irrespective of area. eg Watchman Salary, Sweeper Salary, Common Electricity Charges, Audit Fees etc..
    3. Additional Charges
    Non-Occupancy Charges: Non-Occupancy Charges as per Bye-Law No. 67(a) (10) & 43 (c) and government notification for Non-Occupancy Charges MH Govt. GR No 20081104172832001 of 1 Aug 2001.
    Parking Charges: Bye Law - 67(a) (7), 83 & 84.
    4. Interest on defaulted Charges: Bye-Law No. 71: A Member shall be required to pay simple interest at 21 percent per annum simple interest on outstanding
    5.Water Charges - Bye-Law No. 67(a)(2))
    First of all need to identify the monthly water charge & total no. of inlets, then calculate as follows:
    Monthly per Inlet Charge = Monthly water charge/ no. of inlets
    Ex: Monthly Expenses on the water is 5,000 and the total no. of inlets (all flats) is 90, then monthly per Inlet Charges = 5,000/90 = 55.55
    (Let take it around figure Rs. 56 per inlet charge)
    Let us assume 1 BHK has 3 inlets & 2 BHK has 4 inlets
    So the water charge on 1 BHK will be Rs 168 and 2 BHK will be Rs 224

    Pl consider one flat unit of four family-members(hum dou hamare dou.) Above four is applicable for water surcharge. e. g monthly water charges r ₹300per month then ₹75 will be surcharge for fifth family member because some family stays jointly & certain tenants family consists of more than four.     * We are having 3 wings A B C
    A wing have 7floor 4flat each floor all 1bhk. Passage area 100sq ft per floor
    B wing have 11 floor 6 flat each each. Passage area is 300 sq ft each floor
    C wing have 7 floor and 6 flat on each floor. Passage area is 350sqft per floor
    In this case how can we calculate maintenance charges which common same charges as instructed by you...?

    1) our society is comprising of 3 bldgs, two are registeted as one housing society, but bldg A has seperate water meter and bldg has different water meter, but society takes total of boath water meyers and distributes the amount is it correct way of calculating.

    Service charges are different from maintenance charges .
    Service charges are common services as mentioned in bylaw 65. Common electricity, house keeping , office charges , AGM , MC expsnses security , gardening, lift man , audit expanses. Etc and these are charges equally.
    Maintenance charges are repair and maintenance of equipment, lift maintenance charges , etc are charged as per area .

    Very good explanation, thanks. If same person is owning 2 flats, should the service charge be levied on both flats equally or it should be treated as a single flat?     Respected sir,
    We are from Kolkata. We have 5 blocks in our complex. They have charged 2400/- for Durga Puja which is mandatory. And they have charged if anyone sell their flat our board of directors charge 1%of the selling price. Is this mentioned in the law ? If any new owner wants to join the owners group he or she is bound to submit the Xerox of the whole deed. Can you please guide me that if these rules are mentioned in our laws.

      This is for Maharashtra, you can check out Gujrat Bye law for same. But logically this rule is fit for every state as per my opinion.

    I have a shop which is 400 sq.ft carpet .My society is charging Rs.5200 per month which is more than 3 bhk flat maintenance. We dont have facilities like watchmen, lift etc as compared to flats. only housekeeping person cleans the common area and washroom once a day . what we can do to lower the maintenance charges.     I don't think you are correct ?? For which state this referance you are giving ?? Our apartment is of different area, 1 bhk corridor area is less, 2 bhk it's more 3 bhk it's much more, and for 4 bhk area is too more, then house keeping charges how you can charge equally ?? Common area is different. For 1 bhk undivided share is less and 2 bhk it is more and for 4bhk it is too much, then how you treat equal charges ???

    As per The West Bengal Co-operative Societies Act,2006 sl. item no.93 it is stated that in the event of letting out a flat by the member, the housing co-operative society may realise a tenancy change @ 10%of monthly rent from the tenant per month, is this a battle of logic, sir please clarify whether it would be 10% of service charges or rent. Rent may be deferred as furnished flat and non furnished flat.

    You forgot to give explanation on calculation for property tax of building. Are you sure it is not equal but area wise? Every flat owner is paying property tax of their flat separately. Then building property tax is divided equally in maintenance whether you have 1bhk or 2bhk. Please confirm.

    In continuation of my previous enquiry l have amalgamated my two adjacent flats by applying with the local municipal corporation.Now thw the question is am i required to deregister my previous two registered agreements and am i required to enter into one amalgamated deed andapply to the housing society for one share certificate by cancell ing previous two share certificates.Nobody knows the exact rules in my society.So please guide.Thanks.

      Hi there,
      You can do as you want actually but its better to keep things separate.
      You can join your 2 flats internally etc but society share cert per flat will be x amount and they cannot give you one certificate of 2x.
      Shares have to be equally divided.
      Keep ur deeds separate as well to avoid further legal issues if one of your heirs wants to sell one or some similar issue etc.
      This is from my same issue in Singhagad Road top floor 2 flats which we had joined and then issues etc and we separarted last year before selling 🙏

      If you have merger documents from govt, then only society will consider it one unit, otherwise 2 units , you will get two maintenance bill.

      Maintence charge cant be collected on sq ft basis, in video clearly said... Maintenance Charge (Service Charges ) equally divided to all flats. Pls go through Bye Law no 65 to 71.

      No, for increase the maintenance charge managing committee must present the budget in AGM and share the details budget to increase the charges, after General Body approval maintenance charges can increase?

      @@kclsocietyservices4997 So the management has increased the money stating in AGM that there was loss in budget and we use to recover at the end of month and now we are collecting prior to it.

    There seems to be different rules for different fools. Why are maintenance charges under Apartment Act all calculated psf and not divided by number of flats, whereas MCS Act says service charges? Let us accept the principle that if you have a larger flat then you can afford to may more. For eg a large 3BHK generates more garbage as it has more occupants than a 1BHK and hence should pay more. In large housing societies where there are a lot of different types of units with many different areas psf, a service charge system does not work

      You need to study Bye Law No 65 to 67 deeply, then you can understand why Services Charges should be charged equally.
