    We are already paying maintenance other than that our towr has created a separate group and they do meetings & decide of asking contribution for lobby beautification & getting cctv installed & Ac installed!! How can they ask money separately!! Secondly not asking our consent as maxm people agrees to pay ... Per flat 400 they ask this evry another month...no body questions & few does they try to force them to pay !! After paying maintenance do we have to pay such things!?? How to refuse & what action needs to be taken!??

    Water Charges, lift electricity, watchmen & sweeper, gardenning should be equal to all errespetive to carpet

    Dear Sir, in our society in Maharashtra consist of Row houses, shops on ground floor and flates in building with lifts.
    Now question is Lift operation charges (electricity+amc+othere repair charges) to be shared equily with only members of Building flats or equal with Row house owners & shop owners.

    great Video Sir! I have residential property on rent ..
    I have two questions
    1> society is asking for 1.5 times maintenance meaning for 1000 rupees per month I pay 1500 maintenance. Is it valid for society to ask 1.5 times maintenance?
    2> Now society is saying also car parking is not allowed for tenant… I feel this is discrimination can society decide to not give parking to rent flat ?

    2. Kya society shoerack rakhne par charges laga sakti hai by law ke hisab se ?

    Sir we have 4 buildings have 4 floors & 7 row houses only 1 building has a lift and other 3 building doesn't have lift and society takes lift maintenance & electricity charges from all members can this allowed by laws and also having generator for that lift please suggest sir

    Sir, my society is facing a peculiar problem regarding maintenance amount.
    Society held 2 different voting (within a gap of 4-5 months, for the same financial year) for deciding which method to be used. Both voting gave different results.
    Now, flat owners have got divided.
    Matter is bit complicated but some opinion from your end would be of great help.

    Sir, Agar builder ne society hand over kar diya hai lekin kuch flats abhi v sale nahi hua hai or wo builder ke under me hai to kya uss flat ka maintenance builder ko dena chahiye ya nahi dena chahiye? Agar nahi to kitne din Tak Aisha chal sakta hai?

    Sir you mentioned that elevator lift maintenance cost should be paid by ground floor and first floor residence , but here I want to ask you if there is car lift which goes to the basement car parking lots and I was not allowed to park my car even inside open spaces on the ground floor for almost 11 years with the verbal reason given to me that you should have purchased from the builder.This is a redeveloped building. I want to ask you should I be paying maintenance . Here in my society bill they give maintenance bill amount and property tax amount breakup area wise.There is no break up of maintenance amount in bill like sinking fund , water charges, repair charge etc etc. Sir please clarify I am a senior citizen.

    lift maint,open area cleaning expenses,Security charges,electricity expenses to be recovered from members on the basis of equal or if on the basis of area how will you support?

    If there are high rise apartments and low rise villas, lifts are installed only for apartments and the maintenance of lifts cost is very high, hence the villas are charged these lift expenses more then the users of flats owing to chatged on sq feet the area of villa sq feet wise is four times then the flat sq feet having lifts. Please tell will the lift expenses be a common expense or not

    Nice video sir. I need some help from you. I am staying in a society in greater noida wherein 2/3/4/5bhk flats are available with multiple garazes in 4/5bhk. But when it comes to maintenance charges, commitee members have made it same for all flats irrespective of sizes. Further no development work and when it comes to road which has pot holes where no one can walk either, no one is ready to talk about the same. Kindly suggest.

    I am in Mumbai. My building society managing committee decided to add Rs.1000/- in October maintenance bill for giving Diwali bonus to 10 security and 5 house keeping staff. These security and house keeping staffs are on contract basis from one security agency. They are not permanent society employees. Please advise is it correct to collect in the maintenance bill. Where can I complaint if it is not correct to collect in maintenance bill. Thanks

    Sir, plz advise me how to decide maintenance costs, in my building have five 1 RK area of 215 sq. ft. each and Ten 2BHK areas of 750 sq. ft. each as both flats is having a huge difference in sq. ft. can we charge maintenance per sq. ft.? but 2bhk is in majority so they can oppose it.

    Agar builder ne flat booking ke time pe kaha he ki after possession first year builder maintenance dekhega aur buyer ko kuch bhi maintenance nahi pay karna he. After one year monthly buyer ko maintenance pay karna he. Aur fir jabhi actually me vo possession de raha he tabhi vo bole ki aapko in advance 3 years ka maintenance pay karna padhega varna hum possession ahi denge to kya ye sahi he ya galat? Agar galat he to Hume kya action lena chahiye?

    We have detailed breakup of the society maintenance charges. Which shows how much is to pay for empty flat as we share a common structure of the building. Fixed expenditure + variable expenditure +fund for future projects. Etc. It given clear idea to every flat owner how much to pay and why to pay?

    Sir mera society ka maintenance 750₹ per month he but mene 1year se pay nahi kiya tha fir mene 9000₹ full year ka pay kiya abhi to unhone abhi muje penalty bataya ki 1year late pay ka penalty 28550₹ hoga to kya itna bada penalty ho skta he ??

    For external painting of residential building CHS say after 8 yrs, in case the society funds fall short and are to be collected from flats, will the expense be equally divided amongst total number of apartments or is it basis saleable area of each flat?

    In a sicietyif there're 6buildings with different heights floors all having lifts. Lift maint expenditures are different for each building. Then is total lift maint expenses to be equally sharedby all members of is it to shared buildingwise

    1. As per RERA maintenance - date of registration se start hota he ki date of posession se??
    2. I have paid me advance maintenance to builder. My date of registartion was April 2020 and Posession was May 2021 so my maintenance will count from date of registation or date of posession??
    My property is in Mumbai, Maharashtra. Plese help me with above pointers.

    Kindly enlighten whether structural repairs of columns/ beams in flats from inside who should do. Whether Society or individual member. Buy law 159 is ambitious.

    In our society there wing A wing doesn't have lift and B & C wing having lift, can A wing member liable to pay lift maintenance ??

    Sir my society is charging according to per flat ...butt can i take action to charge according to per square feet ???? Because every month i am paying additional 500 to 600 extra amount.....please do let me know....secondly whatever excess amount i have paid to society from last 7 to 8 years....if wil calculate 500 to 600 extra amount every month ....can i claim it .....wil they return or adjust the my bill ...kindly do let me knw ....your all the video's are veryyy informative 👍 👏 thanks

      As per bylaws per flat but so many petitions have been done and most of in favour of per sq feet in which separate wing having separate sq feet but not in favour if in same wing one floor having different sq ft . I have made more then 10 videos with all consideration .pl refer and if suitable then you can go for legal opinion. Thanks for watching my videos

    Hello Sir, My society is in Mumbai. From last 2 to 3 years I am paying maintenance charges with NEFT in advance and all my NEFT payments were reflected in society’s maintenance bill, suddenly now society’s Secretary is saying you will have to make payment by cheque only, if not then amount you pay with NEFT will not be reflected in society’s maintenance bill and you will be charged with late payment interest. Reason he is giving that cheque payment is for his accounting convenience and he says that it's difficult to identify who has paid the charges in NEFT, looking at passbook which I know it is not entirely true because it reflect members name almost all the time in societies bank passbook record. I want to know is it legal to force cheque only payment mode instead of online NEFT Payment when NEFT is RBI’s official payment system. What can be done in this case if society charges me late payment interest and it doesn’t acknowledge my NEFT payment in society’s maintenance bill.

      Thanks for watching my video. Your question is very interested and I m getting same problems from so many . You are absolutely right and payment mode is ok .Also on other way the society also having such problem and most off are facing now . So for Solution you needs arrange one meeting and get Solution what I have given to others and successful. Solution- Once you do NEFT then you have to write full details of NEFT in simple page / make common format to fill by all members who do NEFT and give details to chairman or what so collect the same so that they have easy for counting , After all it can be resolve by mutual understanding because they are doing free off cost service and as human tenancy of comfortable on all act . Hope you understand.

    Everyone has a vehicle in parking lot. only 2 parkings are sold to flat owners by builder. All are informed to pay monthly parking charges per 2/4 wheeler vehicle. Does this 2 flat owners who puchased parking lot has to pay monthly parking charges?

    50% rules galat he ... sabse pahli baat to yahi he ki jab flat khali pada he to kis bat ka maintances ... ye detail me bataye .. kyo dena chahiye .. na lite . pani .. lift .. na parking kuchh bhi use nahi karta .. to fir kis bat ka rules .. yah to cheating hua ....

Similar you have buy flat even not living but needs to pay maintenance as you are part of society. Pl identify any Society in which you have suggested rules .     Hamari 2 building ka housing society hai of 3 floors each. There is no parking. 1 building me only 2 bhk hai and 2nd building 4 flats 2 bhk hai and rest 12 flats 1 bhk hai still all are paying 800 maintenance equally.now they have increased 50% maintenance for everyone means 1200 there is no lift no parking and no camera. Is it valid. How can I take legal actions against this plz reply urgently. Because I have 1 bhk are 600s.f.

    I'm living in a private township and there is no written agreement for maintenance charges between me and developer.
    I have paid the electricity, sewerage and club house charges as per the agreement.
    Now developer is forming a RWA
    My question is
    Can choose to opt out of rwa society and don't pay any maintenance charges?
    If I join RWA how to confirm that developer is not having any interference and financial interest in the formed RWA?

    Is it true that maintenance starts only when a builder obtains OC for the particular tower? If yes then how can we check the date if builder refuses to share the same? And where to complaint he if still charges even though he doesn't have the OC?

      OC is primarily for the purpose of handover from builder to society members (read RERA). Ideally, your maintenance obligation starts from the day flat is sold to you, unless there is any prior agreement to the contrary, between you and the builder.

    Society monthly outgoing calculated as follows .
    Property tax, water, electricity , repair and painting buildings wise.
    Service charge equal to all members.
    NA TAX, LAND LEASE RENT, REPAIR & MAINTENANCE FUND, SINKING FUND
    area wise per square feet.
    Car parking, non occupancy,, transfers fee, shifting charges etc. AS DECIDED by Society resolutions.
    Lift MAINTENANCE buildings wise.

    Sir, our societys maintainance charges are rs 280/- per month. I have to pay maintainance for 2 years. Society is charging 21% simple intrest on late payment. So according to this what would be the amount in principal+intrest,i should pay to the society. Kindly reply 🙏

    Sir our society is not register so one of the flat owner is not staying in flat refuses to pay maintenance charges. So does he right or he has to pay maintenance.
