      It only becomes aggravated trespass when one refuses to leave private land but the law around this area is so sketchy it often becomes futile.

    Couple of years back this auditor would have been arrested, beaten and charged unlawfully. Auditors have regained (some of) the ground which we lost to these pigs. If you don't know your rights, you got no rights.

      Kevin - I think you are completely RIGHT!!...Even just about 5 -10 years ago, cops would get away with what you say. Auditors (and their cameras) help a great deal to uphold public rights and the rights of citizens. More power to them, they do a good job for the most of us .!!

      Spot on, it really shows the lack of intelligence of the police that they think something could be gained from filming a private number plate. If someone did have dodgy intentions they could simply write it down or memorise it. It makes you wonder how any of these muppets ever solve a real crime.

      Its absurd ! People think they have "rights" over civic property because they once owned a small proportion of the money that funds it.
      The general public don't own police cars....thats just crazy. The "people" don't own police stations either.

      If you want to provoke and antagonize them by filming into vehicles then that's fine. But be aware that to ANYBODY with common sense, ( not just plod) it IS suspicious behaviour. It opens you up to being "suspected" of vehicle or other crime.

      The very fact that the photographer was not detained nor searched and the ‘trespass’ laws were mentioned is because the police now know this.
      The fact that trespass is a civil matter now needs to be taught.

      Section 33 CJA 1972 describes exactly where (in what type of places) certain public order offences can be applied. So it details that crimes under that and previous acts can be said to have been committed in a public place, IF it's with this definition:-
      “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”
      It means - any public road, pathway or any other place which is open, and allows the public in, even if they have to pay for entry.
      What happened, is some auditor, who never got past Rainbow Reading Book 4 at primary school, misunderstood it. I've never really been able to fathom "how" he interpreted it, but, he saw it as somehow giving him a right to access any property he wanted !!! All it does is define what a "public place" is, for the benefit of one act of legislation.....nothing more...
      However I squint at it, and however many times I read it, I still can't see where it says that it gives or grants ANY type of right or permission to enter ANY property or premises.
      Its NOT a magic pass for auditors to go anywhere. It's NOT a permit to bypass trespass law, and ignore the fact that private property owners can CHOOSE who enters or stays on their property.
      Anyway, it got shouted about a lot, people started to believe it, without actually bothering to read it for themselves. And that's where we are today. Those who are a bit weak on English grammar and syntax still think it's the holy grail of auditors. Those than CAN read with proficiency know its the legal equivalent of the tooth fairy !

It is clear to see in the video that there are no fences or signs preventing movement around these areas.

    Don’t forget that these officers are plugged in and programmed on how to act. They have to ask if they can help (meaning ‘what are you doing?’) And then their program instructs them to ask you for your private details. After that they malfunction!

    Just come across your channel and watched your audit of Otley nick. Must say you handled yourself extremely well. Police definitely don't like it when you question their alleged authority. I requested a FOI copy of the latest NPCC meeting report regarding auditors. It makes for some very interesting reading. A great shame that the valuable information that it contains regarding the treatment of Auditors by Police personnel, has not yet filtered down to everyone, especially as the report has a complete section on how to approach and handle auditors.

    A great audit by this person who know's his rights. The reason registration plates are visible is to recognise the owner driver and that includes the Police who are publically funded therefore are not exempt like these kind of costumed idiots seen in this video would like to be LAW.

    Every time they HAVE to give a FINAL INSTRUCTION!!! My reply every time they do that is, "I DON'T UNDERSTAND"; which always leads to them just fading away, and doing the walk of shame as THEY dismiss themselves with the version of brain they have going into REBOOT!!!     Just came across this! Brilliant!!! I fear there will be little sleep got as I am now off to watch them all in reverse as I do when I discover a new auditor I really like. I usually enjoy the journey of watching SOME grow in confidence and their skills improve but he already appears to have it nailed. I like that he is not aggressive also. Some fun viewing ahead I think 🤔

    Basic words that erode your rights. Key words to remember in any interaction-'should' 'shouldn't' 'may' ' might' 'could' 'do us a favour' 'I prefer' ' I would ask' - not backed up by any law/legislation. 'Must' ' - has law/legislation backing up the instruction.

    When I was a boy I,and most other boys , collected car numbers,we had books of them. No one cared. There is a problem though with private land that is a public place. Although there is an implied right of entry onto the land it is still privately owned. The implied right of entry can be removed by the land owner or his agent. If that happens you then become a trespasser and must leave when asked to do so. You can be removed from the Land if you don’t go.

      Trespassing is still a civil offense and the landowner or their agent can use minimal and reasonable force to eject you. Further resistance becomes aggravated trespass which in most circumstances is an arrestable offence.

    Film the police,identify every single officer with name ,number and station.Then maybe someone might recognise that officer and publish their home address which is the thing every policeman wants to get out of you...then maybe the harrasment will stop.
