- Public money spent to send an HGV on a 24 hour round trip from Glasgow, with a load worth less than £500, when it could have been bought locally and delivered in a couple of hours. With this sort of carbon footprint, it's obvious that the environment and locals are the last thing on Network Rails minds. Maybe we should request the cost of this this through the FOI?

No one is above the law, even Network rail.
Put a fence around the entire boundary, a gate at the end of the drive and buy some sheep. Job done. And make sure the gate has a lock. No planning permission is needed for any of that. Then access is buy request with an access charge, perfectly legal as it covers time and damage / repairs to the property.
Problem with that is that there would appear to be a public right of way running through their property to the railway track.

Believe if it's a public right of way it has to be used by the public at least 2 times a year I remember reading a case were the land owner even put on a bit of a tea and biscuits once a year to the walkers has the public right of way went right through his garden. Your title appears to be CTH7726, ROS have mysteriously made the title plan not available... However, it was previously split from title CTH7265. Using the scale provided in this title plan it shows your boundary as being around 675cm heading east at 90 degrees from the long wall edge of the southern point of the southern outbuilding. This measurment shows beyond any reasonable doubt that the track in question is within your boundaries. Once you get to the courts I see little room for manouver by network rail - in fact I would very much doubt they will even try to contest this. Worth noting that ROS use the "outer edge" of the coloured boundary line on their mapping, this is an important point here. Good luck, I would consult with a specialist interdict solicitor on costs, however it looks likely that the gofundme already has enough in it to get the ball rolling with stage one, the interim interdict. I have had similar issues with a different scottish government agency in the past, funny enough the second we engaged solicitors to put an interdict in place they backed down instantly and accepted our title as correct

It might be worth contacting your surveyor, presuming you had a survey conducted prior to purchase. The boundary of their document will add to your evidence of your property boundary.

Sounds like he’s a QTS driver that no doubt from the same depot as the workmen stopping in digs.
He works for the same company and said the foreman text him so probably said they were going back to the digs

That load probably costs less than the delivery charge. Money wasted is unreal.
It would be best, if you are looking for support, to spell out EXACTLY the basis of the dispute. Surely your deed document spells out precisely what is your property, and what rights of access, if any, exist over it? If it doesn't, your conveyancer was negligent in not making sure that the document is watertight.
Don't under-estimate the longterm impact this kind of stress will have on you. I, through no falt of my own, was involved in a legal case of a worrying nature. Fifty years later, I still take medication for the effects of the stress at that time.
Be sure that this is a worthwhile fight, and not just an obsession!
Previous video explains the dispute between them, as network rail state they have legal access and nothing is mentioned on the Smiths deeds or land registration.

Please before you buy a property like this get a good solicitor to go through access with a fine tooth comb.
Railway access cannot be blocked if its in the deeds and right of access.
That's the issue, Network Rail do not have a legal right of access because they do not own the land. They need to permission to use the land to be able to access it. They also have no legal right to build on it when they do not own it! If they had a legal right of access then they surely would have gone to a civil court by now but because they know they do not have a legal leg to stand on they're using the corrupt BTP to help them try and steal the land.

The charge states Appleby, 46, deliberately endangered the lives of staff and passengers and interfered with the running of the network by standing on the track.
Appleby, of Station Cottage at Altnabreac, appeared before Sheriff Ian Cruickshank and made no plea to all accusations, including ignoring warning signs and trespassing on Network Rail land in dangerous proximity to the line.
He is also accused of, while acting with another, culpably and recklessly standing on the tracks in the path of the oncoming train to the risk of injury and danger of life to him, the passengers and staff on the train.
He also allegedly behaved in a threatening or abusive manner which was likely to cause a reasonable person fear and alarm by shouting, swearing and uttering abusive comments towards two police constables.
His partner, Elizabeth , 48, a former police officer, also appeared on similar charges, to which she made no plea.
They were trespassing in dangerous proximity to a Network Rail track, maliciously interfering with the running of the railway track by standing on it and bringing trains to a halt, obstructing British Transport Police officers in the execution of their duty and behaving in a threatening or abusive manner.
Both were committed for further examination and released on bail to appear again in court at a future date.

It does boil my blood and cause me despair, seeing how a corporate bully is allowed to commit harassment just because "they have money".
How have we got to the point in which the "decent" thing to do is to trample on the law abiding little guys.
Here's an idea - Record every instance that Network rail have accessed your land & set a charge per instance, send them a bill, when they don't pay take them to court. If they don't turn up to defend themselves you will win by default so they will then have a court judgement against them which you can use to pursue the money owed in the judgement through a debt recovery company ( they will hunt them down for it adding interest to it as well). If by then Network Rail chose to appeal the judgement they will then have to prove in a court of law that THEY own the land not YOU.
Here's an idea........there is a "railways act of law" that allows the railway companies to access any bit of land that they need to. So, if access is required, the railway company can come across your land without your permission. I used to be a HGV driver for Network Rail and kept a copy of this law in the cab for when this situation arose.

Exactly. Copy their signs. Their T&Cs. I would suggest ULEZ plus levels of charges. You can use different charges for cars, for lorries.
You can make it clear they are responsible for the damages.

You will beat them if the Land Registry has the land recorded as yours and there is not a legal easement in place that permits Network Rail or their Contractors entering or crossing your land.

Put a sign at the bottom of the lane. It won’t stop if you keep enabling them. Then go to the police and report rail company to the police for harassment, and finally send a letter from your solicitor to the company. Once these steps are followed you can then sue them.

The sign should list a schedule of charges, and the dates the road can be used. I would suggest copying Network Rails Terms and Conditions from their car parks. They can hardly argue about the legality of yours.
This will be the government more than network rail for once. All public sector firms have to use a supplier framework to get the best “deals” very often these are not local or the best price if you were to buy outside of them.

Isn’t there an easement so they can go on your land? I owned a small farm and used to let the electric workers on to trim trees near the power lines, no problem at all, I made them a brew rather than be ridiculously confrontational

the reason they don’t buy local is the price local shops /suppliers prices are unreal .against what NWR can get them other places .in bulk buying . it would still workout cheaper even with delivery from Glasgow than buying local .QTS would have bought it NOT NWR .as they are the contractors to NWR .again they would get it cheaper than buying local .

I teach railway engineering and part of the curriculum is how to send a load of ballast by the cheapest and most sustainable way possible 😂😂.

Where was it purchased? Maybe the truck took equipment to say Inverness then went to say for example McGregor 's for the materials then headed north? Just a though from someone with a knowledge of haulage.

What I gather is they want to build a path with access to the tracks. Free of any hazards as people would need to use it without any hazards. I assume as per they will erect fence posts and a fence. Watching you both speak to visitors it comes over that your fighting this on principle as BR havnt recognised your claim to the land. Unless you call them out and get legal backing and go to court as threatened your going to lose. Husband keeps saying how much they will suffer and both of you have threatened to report criminal damage. But have not actually taken any means to report any crimes officially to main stream police. Public opinion and you tube isn't going to help you. By next week it will be old news.

If there is a railway that needs to be maintained why do you need to ‘beat’ them as so many people here say ? Why can’t you just co-operate with them to allow them to maintain a public service ? Who was here first , you or the railway line ? Serious question !
So correct the property is a former rail station . Nework rail do have the right of access for maintenance of the part of the station & surrounds. All they are doing is making a safe pedestrian path to this but also doing it in such a way that it does (when Completed ) not intrude on the station building being lived in. Once the work is done they will go away.
If it was my land here I would have dug a deep trench around most of it, it would be criminal damage if they filled it in.
This has been dragging on for so long now! Why don't you just get the professionals - solicitors, surveyors, etc. to sort it out in court. Then everyone gets to move on. There's no point in taking it out on the poor NR and BTP staff who come on site - they are just doing their job. This is boring now.....

You should be talking to network rail to get the QTS yard or similar made permanent and getting the sectional appendix updated to show it as the local line access point instead of your property. I think you are making mountains out of mole hills.

Your title deeds will tell you if it’s unrestricted access
Contact QTS and instruct them that from the quarry turn off to your property gate is a private driveway with standing or travelling charges if equipment or personal are on it, advise of cost per hour of charges!

Forgot to say, make paper work copy's of overhead photo of your private driveway lenth,then describe hourly/ daily rates, this will help when they state that you have just made this policy up adhoc, show you have this charging rates installed for some time before you act on the policy.

The issue may not be one of ownership..it may be more about rights of access to the railway....we have seen an ownership plan but this may not tell the full story if access rights were reserved through the land..

Start by getting a solicitor to send a cease and desist letter. If they don't, take them to court. You cannot fight it on your own but if you are in the right you can win.

I find one thing that puzzles me. Why use the smaller side gate to gain access to the lane when you can clearly just walk across the big gateway.
