O 39 rule 4 simply talked about that a injunction order can be set aside by aggrieved party on moving an application for set aside it's order, If the party in whose a favour the injunction order has been passesd, has taken by misrepresentation of fact or by misleading TGE court, then court may set aside the order. If the circumstances are changed in which court believe that it's necessary to change or varied it's order, then court may do that
Can appellant court execute a decree in a case where first instance court's jurisdiction is ceased by parliament and is not conferred to any other court??...which court execute the decree in such case??
Sir if any decree is transferred to any other court and decree holder makes a application to court by whom decree is passed. the court ( which passed decree ) have power of execution of decree or not?
Because clause (b) mentioned when court cease to exist and secondly when cease subject matter jurisdiction Explanation talk about when territorial jurisdiction ceased by court
The court which pass the decree. Decree holder may make an application in that court for execution or court may of its own motion can transfer decree to another court for execution of decree
