- गृहनिर्माण संस्थेची जमीन आणि इमारत संस्थेच्या नावावर करण्याच्या दोन कार्यपद्धती कन्व्हेयन्स डीड (अभिहस्तांतरण ) आणि डीम कनव्हेयन्स (मानीव अभिहस्तांतरण) समजून घ्या.
कन्व्हेयन्स डीड (अभिहस्तांतरण ) आणि डीम कनव्हेयन्स (मानीव अभिहस्तांतरण) म्हणजे काय ?
कोणती कागदपत्र लागतात?
साधारण किती कालावधी लागतो?
कन्व्हेयन्स डिड करत असाल तर कृपया बिल्डर जो मसुदा (Draft) देईल त्यावर तज्ज्ञांकडून मार्गदर्शन घ्या. कारण बिल्डर त्यात अनावश्यक कलम टाकतात, भविष्यातील वाढीव FSI लिहून घेतात, सुधारित बांधकाम आराखडा मंजुरीचे अधिकार लिहून घेतात, विविध प्रकारे राखीव जागा संस्थेवर बंधनकारक करतात. त्यामुळे अशा प्रकारचा मसुदा असेल तर तुम्ही डीम कन्वेअन्स करून घ्या. डीम कन्वेअस मध्ये अशा कोणत्याही अटी शर्ती असत नाहीत.

नमस्कार सर,
आमची सोसायटी सोळा वर्षे जुनी असून OC व CC आहे. साधारण 4 वर्षांपूर्वी बिल्डरने कन्व्हेयन्स न केल्यामुळे सोसायटी तर्फे Deem Conveyance करण्याचा प्रयत्न केला होता. आमच्या सोसायटी च्या जागेमध्ये 2008 साली गार्डन साठी राखीव असलेल्या जागेवर एक तिराहित व्यक्तिमार्फत एक अनाधिकृत बंगला बांधण्यात आला. सोसायटी ने त्याबाबत महानगर पालिकेत तक्रार दाखल केली होती, कारवाईचे नाटक झाले, त्यांनी आत्महत्या करण्याचा प्रयत्न केल्याचे नाटक केले, व कारवाई थांबली, व आजही ती कारवाई प्रलंबित असल्याचे दिसते. प्रत्यक्षात मूळ मालक वेगळे असून आजही त्या मूळ मालकांचेच नाव 7/12 वर आहे. सोसायटी चे माजी सेक्रेटरी जे त्या अनाधिकृत बंगलेधारकांचा मोठा मुलगा असून त्यांनी Deem conveyance च्या वेळेस त्या बंगलेधारकांस पार्टी केले, व DDR कडे मिळणाऱ्या जागेबद्दल objection घेतले, DDR तर्फे त्यांना जागेच्या मालकी हक्कांबाबत पेपर सादर करण्यास सांगितले. परंतु ते मालकी हक्कांबाबत कुठलेही पेपर सादर करू शकले नाही. तरी देखील सदर प्रकरण DDR यांचे कडून फेटाळण्यात आले व पुन्हा नव्याने अर्ज करण्यास आदेश दिला.
नंतर नवीन कमिटी आली व त्यांनी पुन्हा डीम कन्व्हेयन्स बद्दल नव्याने अर्ज केला, मात्र त्यात फक्त मूळ मालक, बिल्डर/विकासक यांना पार्टी केले. जून/2019 साली DDR मार्फत ऑर्डर मिळाली व मे/2021 मध्ये adjudication देखील पूर्ण झाले.
त्याच काळात त्या अनाधिकृत बंगलेधारकांनी सदर बाबतीत highcourt तुन स्टे आणला, व आम्हाला पार्टी का केले नाही, अशी विचारणा केली आहे.
आमचा प्रश्न असा आहे की ह्या बाबतीत हायकोर्टामध्ये काय निकाल लागू शकतो, व आमचे डीम कन्व्हेयन्स चे काम पूर्ण होईल का ?

I am staying in.. housing society.. as tenant ownership... We have only share certificate. . only... What can we do to become owner
You are the owner of your flat. The Society is actual owner of the Building and the land on which the building is situated in true sense. But you have flat there and you are the Member of the society. So, you don't have to anything. If you have the share certificate then you are the owner.

सरकार ला लोकांच्या वैतयतिक मालमत्ते चा अधिकार कोणी दिलाय....
बिल्डर सोसायटी नोंद करत असताना जर एखाद्या रहिवासीची नोंद सोसायटी फार्मेशन मध्ये करायला तयार नसतो असे तो करू शकतो का? अश्या वेळी काय करावे?
आपल्यासारखाच प्रश्न बरेच ठिकाणी असतो .
संस्था नोंद करण्यासाठी ५१% सदनिकाधरकांची गरज असते. बिल्डरला संस्था नोंद करताना एखाद्या सदनिकाधरकला सभासद न होऊ देण्याचा अधिकार नसतो. त्यामुळे असे झाल्यास उपनिबंधकांना तक्रार केली जाऊ शकते. किंवा संस्था नोंद झाल्यावर संस्थेकडे सभासदत्व साठी अर्ज केला जाऊ शकतो.
सोसायटीचे कामकाज सहकार कायद्याप्रमाणे करण्यासाठी आम्ही सोसायटीला Legal Consultaion ची सुविधा पुरवतो.

Hi sir.
Currently i am planning to buy a flat in Mira Bhayandar which falls under thane district.
I just had a simple question regarding the conveyance deed.
We liked a flat and are planning to buy the same but the OC for the building is not received it is a 15 yer old building.. instead the society has got the conveyance deed so is it safe and legal to buy such property.
Just want to be sure that we will not face any issue the if we bought the property because OC Is not there.
Also whether will be able to get home loan or not...
