Students were doing their studies in the school in question and it was their grievance in the writ petition that even though they have been registered and appeared in the 2016 Board Examination conducted for the Secondary School Examination, their admission and examination has been cancelled and the writ was filed seeking declaration of their result. On an examination of the matter, the learned Writ Court found that the school in question for academic year, against a sanctioned strength of 120 students at the secondary level, permitted registration of 2057 students and sent their forms for appearing in the examination and as the Board after finding the School to have committed fraud and illegality in admission, cancelled the admission.
The learned Writ Court examined various aspects of the matter in detail and finally gave the following directions,while refusing to issue direction for publication of result of the petitioners.
1. The School is directed to pay a sum of Rs.20,000/- by way of compensation to each of the petitioners and all other similarly circumstanced persons (total 2,057 students),
2. If the amount is not paid within the aforesaid period of three months, the same shall earn interest at the rate of 12% per annum, compoundable half-yearly.
3. As far as the Institute in question is concerned it is their contention that as the Board itself, which is the sanctioning and authorizing authority, had permitted and accepted the form of 2057 candidates and had permitted to appear in the examination, the school cannot be held responsible for any illegality and, therefore, the direction issued by the learned Writ Court is unsustainable. The Division Bench rejected the prayer made by the Institute for declaration of the result of the 2057 candidates
BADDI university (Hp) has been collected development charges till the date of 2021 from student. 10,000 from each student, According to HP high court order from 2016(I guess date may be 2014,2015) Education institutions cannot collect any development charges from student, 💢 ab yai baat hamri shyaad beimaan sarkar or education minister k paas bhi phunch gyi, 💯 Education minister said student no need to pay 10,000 development charges, agr kesi university ne esa Kiya to us pr legal action hoga, 💯 After that a month later Baddi university of emerging sciences and technology has collected the development charges from student, 🌟 No legal action taken by HP Govt., Most corrupted government in history, ☀️ If it any government lawyer can case on the behalf of this on their basis, case is very clear. Every High court order can be found on Google, Every student has developed charges 10,000 receipt,

In the case of private school, the school principal has no power. He or she is all about to abide by the policy of the management or owner of the school.
The Principal is being incorrectly implicated just because the opposing party made him a party to the case. He did not collect the money, he cannot pay. Should he have considered whether he would be able to teach all these students? Probably, but he lacked the authority to not admit them. Or he may have been simply bad at his job. I don't think he should have to pay the amount. The management is trying to throw him under the bus.
At the end the judge correctly considered that he is simply an employee and asked him to submit an affidavit saying so and with the names of the managing committee.He would not have to pay the amount, the people who made the money would.
He is a smart judge, he deliberately let principal go as a paid employee, so that he can accuse the managing committee who are the real culprits

Don't know whether u r aware about BPSC paper leak or not but he has been found main culprit who was directly involved along with DSP of Bihar police.From his centre last yr BPSC paper were leaked and apart from that he used to do take money from students to ensure that they will clear the competition exam by sending the question pics to the candidates before the exam starts.

I can see people commenting over Hon. Judge's temperament. First they commit crime, then contempt of court's decision, and then argue for release. They played with future of 2000 students and now trying to get away with that. Judge should be thanked for saving the skin of Headmaster and taking into account the role of SMC.

Actually the Fraud School authority has sent an escape goat, a regular salaried guy while the school committee will come clean.. this is how corruption is done(the advocates are not letting the judge know the real issue & real owner of the school )
But the honorable judge is very strict against any fraud of such nature. Huge respect for taking interest in this case.
Now it's burden on poor principal to submit affidavit with all members names along with parents name and correspondence address....
I know the management people are going to be safe again. This is a know trick :D

Spend the remaining amount for teaching ur child life skills , good communication and oratory, self defence. Whether u admit the child in big shot private or govt schools . You will have to arrange for the tuition in most of the cases. So it's better to admit the child in govt school and make the child ready to face the world from very young age

My deepest and sincere heartfelt appreciation to the judge for giving justice to the needy students. There are many schools in this country where admissions are given as many as you wish only for sake of donation(greed) the management is least bothered about education.
The present govt.shpuld check for all the states especially professional courses,thousand of cases may comeout.The education minister ,principal,school mgmt commite,should be punished according to mature magnitude of the crime.

Great Hon'ble Judge. Normally schools receive some amount and bill less amount. The school admitted more than 2000 students in a single class , over and above the admission limit of 120 which prevented their studies because the Board cancelled their admission. So the anger of Judge is very much justified since the school played with the future of students and He ordered a lump sum return to each student Rs.20000 (total comes to four crores) keeping other proceedings for jail open. Advocate is worried about the 4 crore amount whereas it looks less money penalty for any outsider for the offence committed , and the Judge says to sell some property and pay the students for the school's illegal action. These people should be jailed and property confiscated.
School principal should keep the management Committee informed about everything what’s happening in school should take action independently. He is admission Authority, Academic incharge moreover should be responsible for everything what’s happening in school why he did not informed Management that in 2 acre of land he cannot take more than 200 students. He looks like dumb standing.

Usually the Management makes the paid emoloyees to do all the canvassing. If any infractions occur, it's the employee who's taken to task by the public & the authorities. Note how the defence lawyer did not give names of Management. They might have also told him to collect his professional fee ftom the poor Principal.
