      Cases run for 30 to 40 years no judgement only dates and fees for lawyers your discussion is not for common man but for accused. Liberty for the accused is the priority not the victim. The more comfortable a criminal is with law the more liberal the country. Who is comfortable with courts the criminal or victim just find out .

    Dr Singhvi is right on dot saying ' Need. for Arrest' should be apply first and foremost over ' Power of Arrest ' : vendetta, curruption , extortion , cannot be ruled out in such a situation ...

    Top conversation about lawful course of action.Any revison of laws should be better and not worst than colonial laws.only change of English words to Hindi words is not improvement.Before any law is to be introduced,it must be discussed with Supreme Court Bar council and the team of Supreme Court Judges before tabling in parliament to pass.Unfortunately,you are discussing after it is passed in parliament and Supreme Court donot interfere and it is implemented. The jails are filled with accused without even trial for many years.Can you help these prisioners to get bail sothat only convicted persons to be kept in prison. Please do some thing for the poor prisoners who have no money to apply for bail and lawyer support.

      When new laws are made Supreme Court must study it and the common Man's freedom is cut then the law should be canceled.
      Now a days seeing that any person can be booked in PMLA case and dragging to jail even without any proof of guilty. Before dragging into jail even nothing is told about the persons guilty, this must be stopped. First give proof of guilty by the Police, ED, CBI, IT any Department to the persons alleged guilty, then take further action. The Court must punish the person/agency who is dragging people into custody without giving any proof and proving the allegations is only by who is dragging the people I.e. person/agency, the I think more than 70 to 75 percent case will come down. The responsibility of proving the allegations is only on the person/agency and not by the dragging innocent people.
      Look forward to a smooth Laws and the working of our agencies the Law makers and Courts for the vast interest of people of India and peaceful life.

    The new criminal laws coming into force w.e.f. 1/7/24 is that punishment will start immediately from the date of arrest of the person without proving it that arrested person is guilty or not then what is the role of the Court. If ultimately it is proved that person is not guilty then question is what about the person who has been kept in the jail for considerable period who is innocent? Secondly what is the situation when accused is kept in jail till the trial is concluded and if trial is concluded after 10 year that means accused has to stay in jail for such long period of Ten years?

      True the accused is most precious person and he should be protected. Who cares for the victim no money no power and no time to give to the court for 30 years.

    What you gentlemen are debating and discussing is absolutely justified but the big problem and stumbling block is that the Supreme Court seems like lacking the strong will to review the new laws before its being implemented. People have been observing that Supreme Court is losing it competency and credibility. People are losing faith in law and the judiciary. As the highest Court in the country the Supreme court should start keeping its house in order and keep a close eye on the lower courts. High time Supreme Court start wining people's faith and confidence by discharging its real responsibility and accountability for which it was sworn for. Maybe go a few extra mile.

      I agree with you... The entire system is in complete Chaos.... But what also would come up is the division of power. Yes, judicial review is fundamental but it can be excercised only after such a law which is unconstitutional is passed in the legislature. And such laws are scrutinized by the executive according to their favour and passed in legislature with utmost ease. The interpretation of such law, it's action by the time a court comes up with a radical solution would be ultimately too late and would've done the damage. I think there should be real scrutiny from the people so that the system has a scope to improve...

    Isn't it too late to discuss it. Such discussions should have started before these laws were scheduled to be brought in the Parliament.
    Those Colonial laws gave the citizens a lot of protection in the form of Criminal Procedure. All these protections are gone now.

    This discussion on law by famous jurists is very relevant and important.
    But I want to say here that ordinary people have been harmed by electoral bond, like test failed medicine companies to pay the electroal bond. And the drugs of those companies had to be bought unknowingly at high prices, which caused widespread damage to the common people!

    Laws have to be strict so that the worst of the crimes may be stopped. If they become too liberal attuned with the articles of the constitution, one would not be afraid to commit the crime, and offender may go unpunished making use of the loopholes or bypass the appropriate punishment.

    Its not difficult to understand what is to be done as by the SC. If it's not happening what can be done to bring change specifically in relation to the priority of cases? Is there a way out of the present situations where the process of the prosecution itself becomes the punishment! Unfortunately often times nothing gets proven after remaining in custody!

    Interesting discussion by the three eminent stalwarts on the implications of the new criminal laws ..I would like to add that Under the old CrPC of 1973 the detention of the accused in police custody cannot exceed 15 days in a whole.. However under the new criminal law BNSS under section 187 (2) the custody of the accused with the police may extend to 40 to 60 making it difficult to for the accused to obtain bail which is unfortunate

    Freedom under the Indian Constitution is more important than draconian powers and criminalising acts for the benefit of PM Modi. PM Modi needs to go to school and learn rather than rely on his fake degrees. There is no evidence against the opposition who have been imprisoned without any charges and for those criminals who have joined the BJP, the law enforcers cannot find evidence despite clear evidence.

    We have our own legislation not of Britain's as IPC,I e. Indian penal code, Indian evidence act,crpc 1974. So how the bjp has called Britishers law.
    Our all above laws have been amended from time to time.
    The only two reasons for making the new laws are 1/ making more stringent laws n procedures so that people may not speak against BJP government by making the police state 2/ modi may substitute ambedkar by calling him the first man who had legislated the Indian laws.Because overall no new law introduced except changing the number as 302:101 so on which will take hundred years to make an impact upon general public.
    With all that humility at my command,I will venture to submit that judiciary specially the lower use to act an clerk of police when they seek remand whether PCR or judicial.it has ruined the system.
    For your kind information the law of sk antil, given by sc after putting the longest time n energy,it's not being followed by lower courts (sessions court,) after some time.tiday is 19/6/24

    तीनों नए कानून एक जुलाई से लागू होना सौभाग्य की बात है :
    केन्द्र सरकार द्वारा लाए गए हमारे देश के तीनों नए कानून विधेयक बहुत ही सराहनीय कदम है। इसे 01 जुलाई : 2024 से लागू करने की पहल का हम स्वागत करते हैं।
    1) भारतीय न्याय संहिता (BNS) : 2023,
    2) भारतीय नागरिक सुरक्षा संहिता (BNSS) : 2023
    3) भारतीय साक्ष्य विधेयक (BSB) : 2023
    ये सभी दंड प्रक्रिया संहिता : 1973 और भारतीय साक्ष्य अधिनियम : 1872 की जगह लेते हैं। इन अपराधों के लिए एक अलग सुधारात्मक आपराधिक प्रक्रिया प्रदान करते हैं। कुछ पुराने नियमों को हटाया गया है तो कुछ नए नियमों को जोड़ा गया है। विदेशी आक्रांताओं (अंग्रेजों) द्वारा बनाए गए अधिकांश नियमों को हटा दिया गया है। उस स्थान पर कुछ नए आवश्यक नियमों को लाया गया है। जो केन्द्र सरकार का एक सराहनीय कदम कहा जा सकता है।
    हमें इन तीनों नए विधेयक जो 01 जुलाई, 2024 से लागू होने वाले हैं ; स्वागत करना चाहिए। इसके समुचित प्रयोग से न्यायालय और न्यायायिक प्रक्रिया में संतोषजनक उपलब्धि मिल सकती है। भ्रष्टाचार, देशद्रोह और आतंकवाद पर इन नए नियमों द्वारा अंकुश लगाया जा सकता है।

    Sir, CM Jharkhand got bail from Jharkhand High court only. High court didn't "pass the buck" at least for an ex-CM, this time as you people mentioned in your discussion. So, probably Delhi CM : Kejriwal will get the bail also. Now with development you can't grossly blame lower judiciary to supreme court for injustice happening with alledged offenders who occupy highest political chair, isn't it.
    All are great senior lawyers, Mr.Kapil Sibbal, Abhisek Manu Singhvi & Mukul Rastogi. Sir, all of you are asset of legal knowledge & experience. So well presented the matter of regular bail, usage of section 120B(conspiracy), Bail provision in PMLA act etc. Very enriching & eye opening. Please do raise such matter again as Kapil Sibbal said it's just tip of ice berg & all kindly agreed. Supreme Court must take ownus & strike down bad legislation with strong observation .

    One thing that makes my jaw drop and I think the justice system is not serious in this country is that we still don't have equal laws for all. It changes based on gender, religion and caste.
    For example, if a woman accuses a man of anything randomly, then that man can be put behind bars and he has to prove whether he is innocent or not; that woman's proof is, that she says so.

    Why Kapil Sibbal and Abhishek Manu Singhvi are worried about new laws? Our Courts sit twice on the very same Saturday evening, open at midnight at their instance or give bail even when not saught for‼️ We common public can't afford them, hence our cries get burried in long waits for Justice, many a times for generations or as our President M'am described, behind bars for petty crimes just because there is no one to apply/give guarantee even for the tiny amount of the bail😢😢😢
    Instead of such discussion, please tell us how our common man's children can get selected by the collegium and chair the process of Justice in this democracy - we please don't want dynasty ruling even judiciary at the cost of taxpayers - we are paying taxes for benefit of the nation as a whole, we are not paying jazia under which we won't have right to raise our voice against the use of our money just taken forcefully....... wondering why I am telling you all this when we don't have right to tell where and how our money paid in temples after paying all taxes should be used😡🤯
