That wasn't the question before the court. The question was: if a state determines, rightly or wrongly, a candidate is an insurrectionist, can they constitutionally exclude that candidate from a ballot of a federal election?
Trump, his attorney, and the entire bench on the SCOTUS seem to agree: no, they cannot.
Don't worry, it's a good thing (you can tell because now the liberal media wants to drop this story ASAP, because it's a loser).
Trump’s attorney isn’t relying on that argument, because it leaves the question open to some such finding. I personally don’t believe his actions satisfy the legal definitions of incitement or insurrection, but there could still be attempts to make such a determination.
Trump has not been formally charged with insurrection. The DOJ is supposed to do that and has yet to do so. If they were to do that, and prosecute, the case would be tried in a regular federal court. It could conceivably be appealed up to the Supreme Court, but they are not obligated to hear the appeal. This is a constitutional case and is only eligible to be heard by SCOTUS because it is an appeal of a Colorado Supreme Court ruling.
Please Supreme Court let the people do the voting, not some Colorado liberal.

This case about is about an individual state's power to enforce an article of the constitution themselves when their decisions may effect a national election. Are they granted that power via the 14th Amendment insurrectionist provision? Colorado says yes. Trump says no. They are arguing it before the SCOTUS, which incidentally seems to unanimously agree with Trump.

I think you are thinking of two different cases. There is the federal criminal case about election tampering, and Trump has pre-trial filings arguing that he is immune from prosecution in that case. Then there's this case, where Colorado decided they have power to exclude Trump from the ballot.
About immunity... you'd definitely want to argue that first, because if you successfully prove immunity you don't have to go through a trial to get to "i didn't do it...."
Play Trump's speech and have them point out the part of the speech Trump told protestors to overthrow the government. While doing so count the number of times Trump says peace and peaceful. This is a waste of everyone's time. If Trump said its daylight at noon these people could debate his statement.

If the supreme Court allows Colorado to take Trump off the ballot in , then in future elections any candidate that is accused of insurrection , not prosecuted , it can go both ways for any party's. Opening up a can of worms in. future elections. Do you notice the lawyer s for Colorado kept using the word insurrection, Trump has never been tried for insurrection or convicted, and J6 prisoners have not been tried for insurrection. It's important to respect whatever the SCOTUS's decision to maintain order & stability. Failure to do so would lead to chaos & the rule of the jungle! While the rule of law implies that nobody is above the law & everyone is subject to it, the rule of law doesn't judge the fairness of the law itself; rather, it outlines the specific legal procedures that the legal framework must follow! However, due to the many complexities of interpreting the law, the legal system may not consistently deliver justice?! I think Mr. Trump systematically targeted! Viva Justice & God Bless America!

The office of president is the highest office in the land and taking the oath stated in the 14th amendment makes the president an officer.
