Compensated? memes don't exact make money nor did the guy who took the pic. He probably made $2 off of it then it was just stolen reposted millions of times by random people. Name a person who was a meme that's ever gotten money. Also she agreed to let him take photos of her and post them.

Where did you see me say that people make money off of memes being used? 🥴 Also they were dating and she thought that she was going to get something out of the photos she took. He probably convinced her that she would, otherwise she wouldn't be stating her shock about the outcome.

@@The_ZeroLine He means they're not viral anymore. The reason why there were is because Reddit used to have multiple meme subs on their front page and everyone else including 9gag would steal them. But then Reddit stopped making them a default sub sometime before the mid-2010s and their popularity fell off.

@@HomestarRunner20X6 yea, but selling photographic material of someone, without someone’s consent is not legal, unless she signed a contract. So she can definitely sue him. Especially since it became so big, and she has suffered from the picture.
@@Zzues yes, he’s allowed to use the photo, but not sell it without her consent. That’s definitely illegal. Something like that can only be done with a contract with the model.

I once co-wrote and recorded some songs with my boyfriend. When we broke up, he released them as an album without my knowledge or consent as his songs. So...yeah, I feel for this poor lady. You do things with your SO and you think they'll take care of you, and when they don't it's both really disappointing and pretty damn exploitative. Nothing makes you appreciate contracts like an experience such as this one.
You can sue him, you know.
@@GFINHK it’s true, but proving it is difficult, and lawyer fees are expensive, and as neither he nor I make our living with music, it is just the principle of the thing, and I’m too tired to waste my life on it. I have a lot of ideas and creativity to bring into the world. I’m just wiser now, and I understand the importance of contracts and fair payment.

There’s always a human story behind these memes. They’re a double-edged sword, and I wish her all the best.
That being said the first-world problem memes have always been my favourite lol. Whenever I catch myself complaining about something trivial, I think of the meme and laugh at myself for being petty. It’s a reminder that, all things considered, I’ve got it pretty good.
I'm so glad that man is her ex. Like, he basically exploited her for their entire relationship, didn't even have her sign waiver forms for the work she did, and then had the nerve to sell the rights of an image of HER face without her knowledge

Sounds like she mistakenly allowed her boyfriend at the time to make money using her, and now that it blew up, she regretted the decision and now wants a cut of the profits. Morally, she should get a cut. Legally, I doubt they can do anything.

She's been taken advantage of on all sides, oh the irony.

When I first saw this, it was as “white girl tears” meme.
In case you are wondering, the EX boyfriend 100% owns the rights to his own photos. As 'an artist,' he took the photos, he got a model who was willing to pose for free, and she did not ask for compensation before she agreed to shoot in contractual form. She also seemed to make it clear she knew he was selling her images for stock photography while they were dating, so she already knew prior to the meme he wasn't compensating her and it didn't seem like she asked for any compensation. So unfortunately for her, he absolutely has the rights to sell his own images. There are plenty of usually up and coming models who shoot for free, usually in exchange for exposure or the free photography which can run a model 100s to 1000s of dollars otherwise. There was nothing he did that was wrong in this case, but let that be a lesson to any other models out there that you might want to sign a legal contract rather than just shoot for exposure or free digital copies of your images.
You usually need a release to publish and sell people's pictures. This guys doesn't have one, so absolutely no right to use and sell that image.
@@dr.hollywood2460 Not if she agreed or consented to shoot for free and without compensation. The photographer is the copyright owner of all images he or she takes. Specifically if photos are taken in a public place, a photographer does not need consent of individuals there as there is no right to privacy. He can publish at will as long as commercial photography is allowed and it is not private property. He can publish those images without paying her if she consented to shoot for free and or if the above condition is met.
@@Banyo__ Not true. You can not go in a public space, take a picture of somebody and make money out of it, without the person's consent. If she signed a release, authorizing the photographer to use her image for commercial purpose, for free, it's another story, but that didn't happen.

So she worked for free. Maybe I missed it, did she ever sign a model release form? Seems she could sue for part of it or get rights reverted to her. But those model release forms are very loose, you usually give up everything in future use.
