Can an extension be filed for submitting the equitable distribution affidavit? If so, what form would that be?

In North Carolina, it is possible to extend the time if good cause is shown. However, we'd recommend speaking with an attorney to know exactly how to go about doing so.

What if neither party wishes to sell or move out, and they have a son who is 16 and established in a local high school, but both parties hate each other?

What if each person had a credit card in their name and paid the bill out of their personal account, not a joint account?

What if one spouse inherited money and bought a house then put the other spouse on the deed ? What if the inheritance spouse put the other one on a joint account 3 years prior to marriage and kept it that way after marriage ?

Thanks for your comment, Elaine. That seems to be a very specific scenario and we'd encourage you to reach out to an attorney in your area. We wish you the best!

I wish I had found this video a few years ago. I was a good wife to a horrible man. He was in the Army and I took care of the farm and family. I did it all alone. I was served with divorce papers and we had never separated. I went to every court date with no attorney. He had the best/dirtiest attorney in Surry County. I believe after 3 court dates the judge finally demanded him to be in her court next court date if he wanted to divorce me. He moved home from St Thomas, with his fiancé, beat her up on the plane, made it on the Charlotte news, next court date he was in court. An attorney, I’m assuming he knew a little of what was going on, came up to me in court that morning and said, say this…You honor, I would like a continuance based on the grounds of equitable distribution” the Jude that had always been there and demanded his presence had a hard attack just before our court date. There was a stand in judge. I asked what I was told, his attorney objected, saying this had gone on long enough. Crazy part is we were waiting on my husband and what’s even crazier is on that date, we had never even been separated. The date I was served with the divorce was March 8, 2016. We were divorced January 17, 2017. Honestly, if you guys ever have time to look into my cases with this county and what this man has put me through….I welcome any attorney! All that above doesn’t begin to scratch the surface of the injustice. One day, there will be a book. My advice to anyone who may be facing a divorce, do whatever you have to to get an attorney.
