  • The plaintiffs say the defendant is their very weird former landlord, who they allege spent their security deposit instead of holding it in escrow. They’re suing to have the money returned now that they’ve moved out. The defendant says the plaintiffs told him they had a family emergency and they had to move out early, so he claims he informed them he was keeping the deposit.

    From his email, something tells me he doesn't return deposits. He's clearly not someone that should be a landlord.

      I agree. All these people that rented from him that maybe should of gotten their deposits back and believed what he said. Every tenant needs to learn their rights.

      This landlord is Filipino, and maybe he isn’t familiar w/ how things work in the U.S. In the Philippines, landlords routinely keep security deposits w/o explanations-and they are rarely help accountable. The regulations there are a LOT more landlord-friendly than they are in the U.S.

      @@nondescriptnyc well, if he's going to do business in the states, especially the Burroughs, hell either learn quick or the city or a tenant will take his property. The New York DA can also charge him with racketeering and shut him down, just like they did some of the Trump properties. I have no sympathy for him, it's his duty to learn the laws of countries he's in.

    Super impressed with the plaintiff’s case. She was prepared and the defendant is a piece of crap who has no leg to stand on. The bills should be paid and he has no good excuses. You can’t be disorganized when you are a landlord.

    The defendant comes in with no copies of the lease. He didn’t have the money. When someone hands you thousands of dollars they’re not just going to look at it. He spent it then claims these provisions that don’t legally have grounds.

      And he was so late on the bills, their utilities were getting cut off. I thought their intro was silly and made up until things started going down. He definitely doesn’t have the money and expects tenants to just deal with it, yikes.

    I loved this olaintiff!! She was very direct and clear in her testimony. She was not all over the place giging unnecessary information. She didn’t repeat the same info over and over. She was a pleasure!! 😊😊😊

      All you need is good credit and an adequate deposit to finance a multi-unit property. Being able to manage said property is something completely different.

    The defendant shouldn't be a landlord if he's so disorganized. He even said when talking in the hallway that he thought it was a30 day notice was the law and he was trying to tell JM that it was 60 days notice in the lease somewhere. Somehow no days are required in Brooklyn!

    This defendant has no defense in this case at all. For him to not return their deposit is completely absurd. These kinds of landlords are a disgrace and shouldn't be able to rent out an appartment at all.

      He absolutely did have a case. If he was truly going to the impression that the law required a 30-day notice, which most states do, then he has a valid argument. Unfortunately, it's the laws of New York City that are ridiculous.
      If it's an honest mistake, it's an honest mistake, but he doesn't sound like a bad landlord. He just sounds disorganized, like the judge said.

      @@JeremiahLOsborne he sounds like a bad landlord. He claims he didn’t have the time to give them a new lease and that he didn’t have the time to pay the utilities bills. It takes 15 minutes to create a document that says the provisions of the previous lease carry over with a new set of dates and then pop that puppy up on Docusign. And to leave his tenants without utilities for several days is absurd. If he doesn’t have time to manage these very very basic responsibilities, imagine what else was falling through the cracks.

      I think we need to define what a "case" is. It's an argument. The landlord had a valid argument, even though the law disagreed with him. We're talking about what happens *before* the decision, not the consequences of the judgment.
      And no one has mentioned any kind of property issues. No repairs needed, no bugs, no bad tenanted neighbors, no police activity. Other than the inconveniences of the utilities, it doesn't sound like such a bad place to live. Too many tenants think landlords should be perfect, while they think they run the place. You can always tell who's never owned property and been a landlord.

      @@JeremiahLOsborne This landlord was mismanaging money. If they had no gas and electricity for 4 days, that's 4 days of no hot showers, not able to cook, losing perishable food items, and not being able to maintain the dwelling space. Plus no heat during the winter months. He asked for an advanced payment to cover the expenses of the utilities, which sounds scandalous to me. This wasn't an honest mistake. I personally don't think the landlord has the money to return to the plaintiff.

    I was a landlord for many years and where I live you are not allowed to ask for Security Deposit.
    It's first and last months rent only, so if there is any problem with damage you have to go to court!
    I am quite handy, so I would just repair the problem myself to avoid the hassle.

      That's a pretty big assumption from an 8 minute, edited Court case. Not even the judge said that. There was no malice disgust at all. She even commented how nice and cordial their email correspondence was.
      And you're just taking the tenants word for it, as well. You have no idea if it was one incident or multiple incidences. You have no idea how responsive he was when there was an issue with the property.

    Zero days notice to move out is kinda crazy. Where I live the renter needs to give 30 days notice, and the landlord needs to give 90.

    Those of us who live in Europe view every one of these Landlord-Tenant cases with shock and awe! How the citizens of the US can tolerate a state backed system of systemic housing exploitation and profiteering landlordism simply beggars belief!

    Seems like to me the defendant just didn't have the money to pay them back. Which is usually the case with most landlords. Especially the ones who want a nickel and dime and nitpick on Little things to say why a person's not getting their deposit back or only half of it. It really all comes down to did the landlord save the money or did they spend it and now they're broken and can't pay it back. Which and those situations they shouldn't make it the tenants problem. Especially when the tenant left the apartment in good condition.

    The Defendant is a horrible landlord.
    I’m a landlord and have had to evict a few tenants, but if I have good tenants, I’ll work with them.
    On occasions I’ve had tenants who have had to leave.
    In WA state I have to be given a 30 day notice.
    There have been times when service men / women have been deployed and couldn’t give me 30 days. I work with them and try to do what is best for all my tenants.
    I’ve had a Marine that has rented from me on 4 separate occasions. After returning home, he rents from me again. He has now been relocated to Florida. If he’s ever relocated to my area again, if I have an apartment or house available, I’ll rent to him again.

    Most landlords will always try to keep the deposit any way they can.even when nothing is wrong they invent something.ive had landlords who say heat and hot water is included and I wake up in the winter, guess what the landlord didn't bother to order oil so no heat or hot water.and he still tries to keep the deposit when I move because of no heat .

    The defendant hasn't a clue about being a landlord, nor about any laws that go along with being a landlord, in fact in spending their deposit he is breaking the law as it is supposed to be put into a special account and held, not spent.

    So if he put in the lease that 60 days notice was required would that be legally binding or wouldn't be void due to the law stating no notice required?
    In my part of the world the law must be adhered to and that stipulation could not be enforced I am wondering if it was the same in the US? Its also illegal for a landlord to hold a bond here too. We have an agency that they must present it to and have got take proper steps to access that money.

      I believe the 60 day notice would be enforceable in all states and municipalities, I've heard of some landlords requiring even longer notice. Some states require that the security deposit be held in an escrow account and if the tenant is entitled to their deposit they also get the interest it earned.

      I think in this case a signed contract is the precedent over state law. However when the contract ends, the requirements default to state law.
