You know, it really doesn't matter what kind of background or family you have. You can have the best family in the world and destroy your life. And you can have the crappiest family in the world and make your life a beautiful thing. It's a testament to your understanding, and to your willingness to do the hard work.

When I had to reappear in front of the Judge . The DA was asking for the max ( 2 years) but Then the Judge told the DA to sit down and shut up. She said that I was served in the Armed Forces and a little Cannabis in my system vs anything else was in her mind perfectly fine. Walk out a free man - no more PO visits 😊

@@d3et1roi3t the judge is looking for some remorse and maybe a confession that you screwed up and there's no one to blame but you and your poor judgment and you might get another chance. When it's everybody else's fault it looks bad in front of the judge. A lot of things about me make me feel responsible for helping others. I was at the Sturgis motorcycle rally. A nice young lady that lived in Sturgis had gotten Tangled up in the courts and made a bad judgment and Missed a probation meeting and thought she was going back to the joint. I said if she wanted I would write down what she wanted to say to the judge after we talked for a while and she could read it to the judge as her statement about this matter and see if she could maybe get another try. I put my name at the top of it and told the judge that this lady was not an author but she had something in her heart that she wanted to tell him and I helped her get it on this paper. It was a long four or five hundred words statement and I wrote that and I thought it would pull a tear out of a stone it was so moving. When she went to court the next day I was more worried about her then I would have been about myself. When she came back she was happy and the judge gave her another chance when she was sure she was screwed and I said you owe me big time you owe me a big favor she thought it was something kind of nasty that an old man might want from a pretty young girl but she got a big surprise. I said I want you to get up every morning and read that and live it because if you don't you will return to hell promise me you'll read that every day until it's part of you or you're off probation.

You only have to wait that long for non-disclosure on a felony. Non-disclosure in Texas allows any public/government entity to access those records, not just courts. (e.g. a public university, licensing agencies like medical board/state bar/etc., law enforcement). A completely "clean record" would be expungement, where the judge orders the clerk and all state agencies to delete all records associated with a case ( as well as sending a request to the NCIC to do the same, which they typically honor), the only trace left of the case is the order granting the expungement provided to the defendant. With non-disclosure those records are still there and rather the judge issues an order to the clerk directing he/her not to release them to the public). Expungement is not available for deferred-adjudication in Texas though. In both instances though you are legally permitted to state that you have never been charged with said case.

Damm.. I am in the same situation right now. I did a year in county jail and they give me Deferred Adjudication probation for 5 years for an aggravated robbery. I plead guilty and sign the PSI but got blessed with it since it's my first offense and i been out 11 months so far. Got myself a job that don't do background checks and been following everything my P.O said but ITS TO HARD. i don't earn enough money for payments and rent and food...And i don't like missing days just to see my P.O and do what she wants. I am good on staying sober for the sake of being free. BUT every time i think if i took the right decision taking the plea deal instead of just doing my time.....Also they count my 1 year of being inside jail county so now it's 4 years... But this is a big burden i am carrying everyday.....

Hopefully, his children catch the acrid rot wafting from his white trash foot steps and take off in another direction in life far away.
10 years is a long time to be lonely. Baby mama will move on to be with a better role model.

As a retired lawyer, who incidentally practiced in that same courthouse in the 1980's, i applaud the fact that you showed a probation revocation hearing both for the benefit of the general public and for kids who might think that because they are young, nothing can happen to them if they go to court. Probation is not a slap on the wrist because while you are on probation the maximum sentence you could receive for your crimes hangs over your head. Probation consists of rule after rule after rule governing what you must do, where you must go, where you cannot go, who you cannot see, and what time you are to be where. No alcohol, no drugs, no operating a car in some cases, pay restitution pay fines and court costs, pay probation fees, support your family, and no leaving the state or the county without court permission. You only have to violate one of the rules to be arrested and ordered to a probation hearing like this.
The main reason people end up in a probation revocation hearing is not because the rules are so hard, it's because the people are used to ignoring the rules and never followed then because no one caught them or cared when they did. Somtimes judges are lenient other times they drop the hammer and you never know what you will get. Or as they say in Texas, the ears or the horns.

Probation is just a leash that gives people enough freedom to hang themselves. 50% of the time you don’t even have to do anything and still get probation violated. When I was 21 I was sentenced to 7 yrs in prison for cannabis manufacturing and distributing (Green leafy substance). As well as possession of a illegal fire arm (First felony, first offense) My time was suspended and I was allowed to serve one year in treatment and 7 years of probation (As long as a completed treatment) and probation. Which required weekly drug test, AA/NA meetings everyday and getting a job. You better believe I did EVERYTHING. I thought I was going to prison for a LONG time. When the judge said "Hey you went to rehab before court, you have been staying sober, as long as you can keep on the right path I see no reason to put you in prison. I WENT TO SCHOOLS and talked to kids about how horrible of a decision I made in life on my own time. Most of the schools I went to were secondary troubled youth type facilities. I had kids JUST LIKE HIM laugh at me, shake their heads, you name it. What people dont realize, is they DO give you chances (maybe not all the time) but they do try to give people a second chance. Its up to that person to do everything in their power to not go back. You cant be looking at serious time and pull this BS. Kid was dumb ass hell for this. They gave you GOLD and you laughed at it. I used to work as a drug and alcohol counselor for probationers and homeless. Take it from me, there are plenty of people who would rather be incarcerated instead of complying with probation. They know what to expect in prison. They know how to survive in prison. They know how to use drugs in prison. But they do _not_ know what to expect in normal life. They do _not_ know how to survive out in the real world. They do _not_ know how to stay clean long-term. Going to prison, in their view, is significantly easier than outpatient, comply with random drug testing, and working full-time.
I've had a handful of probationers over the years who told me, flat out, they'd rather be in jail than on probation. And of course, 100% of the guys who said this to me, they ended up back in jail and prison. Some of them, they had a good point. Some of those guys simply did not have the skills to survive normal life without breaking the law. They didn't have the skills to manage their finances, mange their schedule, manage their emotions without drugs, and work full time. Staying out is an uphill battle, going to jail is a downhill slide. But that doesn't mean it's impossible... it just means it's going to be a lot of work.

Still, he didn't give a f*ck despite the suspended 10-year sentence hanging over his head and 2 small kids to take care of. If he really gave a f*ck about his kids, he would have done whatever it took to make sure his ass made it to probation. After sitting in Rikers for 4 months I had a 7-year sentence hanging over my head and probation for 5 years, all for a non-violent felony (possession of a controlled substance) with absolutely no priors, not even a speeding ticket. My sentence was BS but instead of bitching about it I made every single visit no matter what, even when I had to walk to get my ass there. He deserved it. He did it to himself and blamed not showing up on everyone except himself.

It changed my life I got out June of 2014 and for the last decade I’ve been working and haven’t looked back. Hope this young man can get his priorities straight and can get out and raise those babies. It will be hard to repair that much damage

I'm a recovering heroin addict of 12 years and I didn't have a criminal record that involved a felony so I was tried in drug court . I was in the county jail for 2 weeks waiting for a bed in a rehab facility and being in a county jail were over population was terrible I slept on a mat on the floor . I said I will never go through this again so after I was released from rehab I put myself in a medical treatment aftercare facility and now 12 years sober my life has changed for the better . I don't understand how people keep going in and out of jail or prison I experienced just a few weeks and that wasn't the life I wanted I PRAY that people wake up and get their lives in order and be a better person even in these trying times we're facing Like we say in recovery LET GO AND LET GOD❗💯🌼😇

It's lack of housing, a job, partner, a future and you have an addiction to feed. With no choices you return to the one lifestyle that you know. That's how folk keep returning to jail.
I knew of a guy who was that pee'd off with homelessness & hunger that he walked in to a local butchers by his grandmother's where they knew him with a bloody syringe, he demanded £ and got about £180 and bought crack etc. He didn't run or try to evade, he had given up, he had a last binge before going to prison.

I was about to say I've seen this so much during my time in and out doing drug court 3 times. Ya man people sometimes just can't stop their addictions and get lost. Even if they break a little rule by accident you might as well break them all after that cause your going in no matter what. But ya some people get serious big boy charges and pay a lawyer to get them probation over a huge suspended sentence and they just can't stop going off the rails feeding that addiction.
