  • The plaintiff purchased a leather couch from the defendant’s store, but now but cushions are starting to peel. He says he took the cushion to an upholsterer, who told him it wasn’t actually leather. He’s suing for a refund. The defendant argues he special-ordered the couch for the plaintiff. Plus, the plaintiff bought it five years prior to the lawsuit. He doesn’t issue refunds, so he’s not giving the plaintiff one.

    Seriously, this dude showed up with a cushion from a couch he already threw out along with a recording of the sales staff blatantly lying. He earned that $750 back. Also, full grain leather couches can indeed last a lifetime if the leather is taken care of, even with kids, dogs, etc.

    Youre not getting a genuine leather couch for 2k. But they did 100% overcharge him for that garbage. Should have been $800.

      I bought a set for 2000, it's now being sold for 4500 by the same store, it was possible a few years ago. I bought this set in 2016.

    My current leather couch is now 15 years old. Been through 2 dogs, 2 kids and a cat. Not a single "crack", hole or tear in the leather. Even with the cat scratches. Wasn't custom either, just Ikea.

      My sister has had a red leather couch for over 20 years old and looks new.
      She has a flex steal sectional, before they stopped making good stuff and started making hideous garbage, that’s white and leather and it’s over 10 years old and looks new. I would buy that couch if I could it’s perfect in size, comfort and style, but I digress (I’m not bitter 😭)

    A typical sleazy furniture, sales man. If you ever buy from one of those little stores, this is exactly what you’re going to get 9/10 times. Trust me, been there done that. Crooks!

      The bigger box stores are worse usually their employees don't know anything about the product and they are waiting to get off or go to lunch and really don't want to be bothered. Plus the smallest print possible is presented to you saying after it is delivered and you accept it it is yours to keep. They tricky!

    The case was entertained because it helps consumers understand that false advertising is against the law and because of him watching another case on PC he was able to get the courage to sue. Different circumstances but this show is educational and he just proved it

    I'm the plaintiff. The store committed a fraud. I didnt know that it was not leather. I threw it away and for myself decided to see what this thing was made out. When i brought the cushion to upholstery place the guy didn't know what material it was. Then i tried to press charges but it was too late . Then i said let me get something back and decided to go to court. I should have gotten the whole amount back. I was dupped that the couch that was delivered is a real leather

    If I was the defendant, I would have offered a full refund upon return of the couch. As the couch was gone, case over.

    we have leather couches old around 23 years and two of them still look brand new, to be fair we don’t use them as much as the other two who have some signs of age but still if u take care of real leather properly it can last a lifetime. the defendant is crazy

    The defendant's salesperson was dishonest, and the defendant doesn't seem trustworthy either. But even a vinyl sofa wouldn't have that type of patterned damage in 5 years. It looks like a strong cleaning solution and rough scrubbing took the finish off.
    Fair enough verdict!

      I tell you why.i never owned a leather sofa b3fore and I thought that it only last that long. I decided for myself to check with upholstery place if that was a really leather and it was not..I even wanted to press charges but was too late

      @ even with fake leather, that amount of peeling to where it’s essentially just fabric is not normal wear and tear. Especially on a back pillow.

    Plaintiff is just as shady as the defendant. Ditched the couch after 5 years. And was too ignorant to realize it wasn’t leather when he picked it up from the store. No way that damage was from normal wear and tear. He doesn’t deserve a dime.

    For a lawyer she's asking stupid questions she's has a horrible interpretation of statues. If he recorded in secret it's a felony in Florida. He was in a place with no reasonable expectation of privacy, therefore no crime would ever be considered.

    It's quite the scam businesses like the defendant has going. Take a couch that's really just a cheaply made piece of garbage that should cost $499.- at best in a discount furniture store, but sell it as a 'custom' piece of furniture for $2,250.- Profit and repeat.

    I wish she would have noticed on the invoice there were numbers which would have been the model numbers and she could have looked it up and saw how the described what it was !! But the guy should have done his homework and would have known for that price it was not real leather !!! I would never have given him that much money back !!!

    The defendant is a snake oil salesman, IMO. I have a real leather set that's over 15 years old. I have had pets, children, grandchildren, parties, and occasional spills, and it still looks new and is in excellent condition. Too bad the store was not named; it looks like this is a regular practice. Buyer beware is accurate; however, being provided accurate information before purchase is critical.

    Genuine fullgrain leather does not crack unless its looked after. Genuine leather can last forever.

    BS Ruling! He should have gotten back more than half what he paid bc he paid for leather, didn't get leather, and didn't even get something that lasted as long as it should have. Colleges should use this show to teach what NOT to do!

      Well, in that case, they're both scammers. The defendant's salesman is blatantly lying to customers, convincing them they're purchasing genuine leather sofas. When in reality, they're buying garbage. The audio is the only reason the plaintiff got anything back. The defendant isn't an honest businessman.

    these so called independent furniture guys are like used car salesmen. Yes they can "special order" stuff right from the kid factory passing it off as very expensive furniture marking prices up a 1000 % or more like this case. That leatherette couch is maybe $200-300 at the most. That invoice was pathetic ... Ripped Off

    This case was frustrating to watch. Things just dragged on. But I don't know how the plaintiff won here because it's been 5 yrs. I thought the statutory time was no longer than 2yrs.
