  • Marriage is said to be one of the cornerstones of our society. For each gender though, marriage comes with a set code of conduct and duties that they must follow. For women, this means taking reigns of the home front and tending to the needs of the family. Being conditioned to believe in these ideas and the mirage of happily ever afters, most Indian women walk into marriages without the realisation that a marriage can be an unhappy or a difficult one as well.
    Even today, we do not prepare our daughters or would-be brides on how to deal with a marital alliance that is traumatic. The stigma around words such as separation and divorce is proof of that. But times have changed, women are no longer dependant on their near ones, at least when it comes to gaining information.
    All women, married or soon to be, young or old, should know their legal rights. Women can penalise any oppression in marriage and claim freedom from the alliance and dignity if they are aware of their legal rights. As the government aims at revising the legal marital age of a woman, from 18 to 21, here are some legal rights that every married Indian woman is entitled to.

      Even if she would exercise her rights, judges at family courts are mostly biased towards guys. She would get in the vicious circle in appeals and petitions. Most of the time guys play on judicial cycle.

      There are many in maharashtra, dowry is long gone in most of the parts here.. 5 of my cousins.. when they got married.. they maintained a mandate in the invitation card that no gifts are allowed.. it was followed as well..
      Totally agreed with the law implementation though

    Streedhan also includes any gift given to the bride at the time of marriage and afterwards from the family and relatives of husband as well.

      @@Sippingteasince as per merriam Webster, dowry is something given to husband. As per prohibition of dowry act it is property or valuables given by one party (of marriage) to other party; or parents of one party to either party or any other person before, at the time or after marriage. By very nature of dowry, it’s demand by husband or his family, while gifts are voluntary in nature. Moreover streedhan doesn’t include anything which is given to husband (obviously not due to dowry) as gift. Engagement ring given to bride is included in streedhan while engagement ring given to groom is not streedhan. Furniture, car etc given to girl is streedhan.

      Maybe according to you and in ur area ,Streedhan is meant as a gift..But As the world is so big, Still in many places including my place,, parents are pressurised to give dowry..

    I don’t understand why only marital house is her right? Many times it’s only marital house where she is subjected to domestic violence. It should cover broader sense by providing the woman a right to decent place of accommodation and she should have right to not live with her in laws in case of domestic violence and other abuse due to dowry demands etc.

    Neat Explaination about rights girl's with brother's. What about sister and sister share with parental assets? Girls get super jealous and melodrama. There comes sibling rivalry also, especially after all girls in one home get married off, while some girls aren't well settled.

    Law 4 should be for both husband and wife.
    Wife cheats, then file divorce and BOOM 25% alimony.
    If wife is independent and have a decent job alimony should be denied by the law.

      @Unmesha Meher in general cases court tries to give custody to both.. else if the divorce is too messy then an investigation is done to find where the child gets more stability. There % of fathers getting child is less but not something court won't allow. This is done keeping in mind the interest of the child; it is believed a mother can still take the place of father but a father can't.. in case the child is not a minor they are given the choice to choose.

    Most of these laws are confined to dusty old law books .... the ground reality is that fighting for one's rights is a very costly and long drawn out process with many pitfalls on the way , especially when there are children involved !😢😢

      Yup. She won't get alimony if she earns enough to sustain herself and the kids born out of this marriage.
