Sir, in the 3 circumstances mentioned for appointment of adhoc DA, 3rd one seems to be incomplete. Even if DA is subordinate to AA, he can very much act as DA. For example, in case of ASO, Secretary, who being competent to impose any minor penalty is a DA, can start DP even though he is subordinate to the President (who is AA in this case)
Read Article 311. Uske according GS can't be removed/dismissed by authority subordinate to appointing authority. In the instant case, Normal DA i.e. DS/Dir canot remove GS as he was appointed by JS/SS
Withholding of increment is minor penalty irrespective of period and with cumulative effect. There is no mention of withholding of increment in major penalty. There is reduction in pay.
Can new evidence be relied upon in the disagreement note by the disciplinary authority after completion of Inquiry proceedings which was not adduced during IO/PO stage? The new evidence was never part and parcel of the Charge Sheet. You are requested to provide your valuable opinion citing rule and the Supreme Court Order that whether the Disciplinary Authority can use new evidence after conclusion of IO’s report.

But pension rule Lec 3 at 28:18 aapne bataya ki DP is instituted when charge sheet is issued i.e. end of contemplation period or start of pending period Please help

So in the example of Grp C you gave where both AA and DA is Dir/DS, going by same analogy, why can't DS/Dir initiate DP even though that Grp C person was appointed by JS/AS/Secy/Prez? Am I missing the concept? Kindly explain Sir.
Constitution says a person can be dismissed or removed by the same authority who appointed him. If Gr C employee appointed by JS, higher than the original AA, then that employee an be dismissed or removed by JS only
