The "planning to get a divorce" argument is weird. You wear a seatbelt, lock your doors, etc, to be secure, not because you PLAN to have a crash or get robbed.
If more people understood what a prenup did and didn't do, more people would want one... I'm a single lady in my 40's, and I wouldn't get married without one. I don't care if the guy is rich or not, I want to be sure what I have is protected. It's not that I'm rich, but I've worked very hard to have what I have in retirement accounts, get out of debt and and recently start making small investments. Plus, I believe in being fair and being upfront, so noone is stressing about what if's or feel like they need to hide things especially from their spouse.
why this double standard where the state's standard-prenup doesn't require any informed consent but any actual explicit contract has to pass a much higher bar for informed consent? Any explicit contract is more informed-consenty than the legal defaults.
This was a great episode! If you guys ever have Aaron back on the show. A question I have is how is "giving" handled on a prenup or if it's even included. Specifically giving to help family members and/or taking care of parents.
Keep in mind prenups also protect eachother in the case of a death! A prenup protects you from the state, from probate, and can help so much with survivorship.
Unfortunately, getting a spouse who does not want to do counseling into counseling accomplishes nothing. It's just leading a horse to water. If you could somehow contract on willingness to discuss things, far fewer divorces would happen.
! If you’re drafting a prenup, remember to do your research to tailor it to you Amendments/Considerations • Alimony in case of Joblessness or Disability, or Significant Differences in Income or Assets Confidentiality of the Prenup • Choice of Law: Validity Based on Jurisdiction • Survivorship: Home Ownership and Debt Protection in the Event of Death • Social Security Survivor Benefits Avoiding Probate • Sunset Clause and Amendment Provision
And why are you getting married in the first place? Prenups are a bandaid on what is likely a bigger problem. Expecting the state to enforce one contract over another, especially in Ma, is foolhardy at best. Rules change by the week and judges are completely unpredictable
Well marriage has legal provisions you can only get through marriage. This kind power of attorney, custody, etc. Beyond that, the religious and / or romantic commitment that comes with it is something to aspire to for most, man and woman included. It's just that modern society has bastardized the sanctity of marriage with all the commercialization and legalese of it, and these days marriage is typically a losing proposition for men especially.
The best thing that should be on every wise individual's list is investing into different streams of income that don't depend on government to bring in money especially
prenup is worthless for 3 reasons , she can claim i dont read it or i dont understand it or he forced me to sighn, good luck with her, there is only 1 solution and its 100% safe , DONT GET MARRIED
I'll double down on your comment and say that a prenup is dangerous. If you disclose all your assets to your future spouse and her parents, you could be be signing your death warrant, especially if you're a passport bro.
@@jcorey333 I don't think the consent part matters in a third world country. You tell me where all your assets are, their value and locations, and I'll sign the consent saying I won't touch them. 😂
Amazing conversation. My Fiance and I are 100 percent sold on getting a prenuptial agreement. Thank you for this amazing information.

👏
I haven't locked my front door in over a decade 😂 lol
That being said, I would NEVER marry a woman in this day and age.
Spot on 🎯

Yes I want Aaron Back in the show 🎉
Ditto!!!
I would think it comes out of the individual bucket
Your vehicle and estate a prenup protects also. Anything that you had before you even met them or got on your own is yours
Imagine you’re in love and he talks you out of getting married, only for him to get married years later 😂 I would be heated

It was so useful. Thank you for the video🙏🏻

Sure, but on the margin it can make a difference for a lot of spouses.

Confidentiality of the Prenup

How would a prenup affect one of you going into a rest home or needing long-term care and thus access to the others money?

Who is doing that ?
I’m 20 minutes into this f’n video and there’s been zero usefulness so far
So explain what you're looking for
Agree completely useless information, host is annoying af too
Yeah, but you should see minute 22!

That's why you want to have her represented by a good lawyer, and make sure that she explicitly says that she consents.
