How to switch from 10 year to 5 year route UK Visa

- If you are currently on a 10-year route, you can switch anytime provided that you comply and meet the Mandatory Requirements. If you meet those, you should reduce the time of becoming settled in the UK.

Please note that there is no specific form to switch to 5 year route. You must use the same form when renewing your LTR, and mention in your cover letter that you wish to be placed on the 5 year route. You will only be eligible to switch if you have been granted LTR under the Partner or Parent route, but not under Private Life.

Good day. I have a question for you. I came to the UK in 2003 as a 7 year old child with my adopted mum where I remained for 7 years on a ILR visa, due to family circumstances I returned to the Caribbean to be with my biological family in 2011 at age 14. Fast forward to 2021, I am now 25 and wish to return to the UK but I’m unsure as to wether my ILR can be renewed after 10 years or do I have to apply again and start from scratch? Hi, assuming I have just started the 10-year route because my UK partner earns £10,000/year gross and my visa application was in-country. In the first month of my 2.5-year Spouse Visa, I transfer £70,000 of my own savings from overseas into my own UK bank account and I’ll keep it there for 6 months untouched. On the 7th month of my 2.5-year Spouse Visa, I apply to switch to the 5-year route. Is this possible? If it is not, how else can I meet the financial requirement to change to the 5-year route, while my UK partner will continue earning a max of £10,000/year gross? Apparently after doing some digging, I found out that I was supposed to receive full british residency the year I came down but I was unaware of this as a 14 year old child. Will the home office consider all this towards making a decision concerning my case? Will they also consider the fact that me leaving for so long was involuntary as I was a child or is that none of their concern

There is no specific form. Write in your cover letter that you comply with all the requirements and therefore should be placed on the 5 year route.

Hi, when doing the application. Do you upload the cover letter asking to be considered for 5 year route with your other documents or separately? Is the form to complete the FLR (m)? Thank you
You upload it with your documents under Other Category. As for the form, follow the instructions online. There is no such thing as FLR (m) anymore because everything is online. The computer will ask you questions and you need to answer according to your circumstances.
I am at moments on ten years route and want to apply 5 year route
Hi I came to uk illegally 2007 and i done asylum seeker as different country and then 2013 I have partner unmarried which is Birtish citizen and I applied with my original country and my original passport for leave to remain under 10 years route and I have 2 kids which is birtish citizen too I already done (1)2.5 year from April 2016 and another (2) 2.5year from march 2019 and I applied for my (3) 2.5 in August 2021 and I am still waiting is any chance for the new immigration Rules on 15 March 2022 can I apply for ILR if I get married will that is make my circumstances change or switch my visa will my time I have spend will count so I can apply for ILR if yes can you please explain that and what I do should next .

When did you receive your decision? There is a concession where you would still be under 5 year if you can show that your income was above £18600 before March 2020. You may need to write to the Home Office to challenge the 10 year route. The problem with applying for ILR after 5 years is they might refuse it on the basis that you are no longer under the 5 year route. So best to get a confirmation from the Home Office first before submitting your ILR.

You can only apply for ILR after you have lived in the UK for 10 years with the visa.
I would like to know if I can get any type of UK residence or long term visa especially that my parents are British living in Gibraltar and I lived in Gibraltar too from 1984 to 1990 but my parents at that time did not have the british nationality though they had been living there for 10 years and my dad worked for MoD since 1993. I have granted a 10yr route even though I met all the financial and English mandatory requirements, how do I appeal this decision?
You cannot appeal against it, but write to the Home Office to explain why you have been placed the 10 year route. You might want to engage a lawyer to check that you did meet the mandatory requirements.

You can switch anytime, but just make sure that you do meet all the requirements. If you have just started earning £19k per year, you need to show that throughout the 12 months prior, your annual income is equivalent to £18600.

You should have challenged the fact that they placed you on the 10-year route. It is risky to apply for an ILR and assume that the Home office will grant it because they will look at their records and if they see that you are on a 10-year route, they will refuse it.

In order to get a spouse visa for my wife, I showed savings of over £60,000. I have sufficient savings but I am semi- retired so I am not sure our combined incomes are £18,500.
No, it is not necessary to have an income, as there are several ways to meet the financial requirement, such as savings of £60k. You need to make it clear in your cover letter what documents you are sending to show you meet the requirements because sometimes the caseworker might miss it as they are not used to receiving applications using savings. If you want to use your income jointly with wife, you both need to earn an income of £1,550 per month before tax to meet the income requirement of £18,600 gross pa.

Did you apply inside the UK? Did you overstay? If you overstayed, that would be the reason you are placed on the 10 year route.

Yes, if the initial grant and renewal grant confirm the 5 year route. After 5 years, he/she can apply for ILR.

@@vietcongboi10 In this case, application for ILR will fail because when you renewed you did not meet the mandatory requirements so the HO placed you on the 10-year route. You will need to renew again until you are resident in the UK for 10 years and then apply for the 10-year long residence settlement.
I was granted leave to remain in the UK in June 2019 on ten years partner route and my visa renewal is due in December 2021. My question is if i apply to switch ten years route to 5 years and my application gets approved, will homeoffice consider my stay in the UK since the day I lodged the application to switch ten year partner route to five years or they will consider my stay since June 2019?
The 5 year route will start from the date of the grant, so if you were granted on let's say Feb 2022, that will be the date the 5 years start.

Money making business of Home Office. They should learn from Canada how immigrants landed in Canada on PR(ILR) from day one and apply for Citizenship after 3 years. And their fee is also very nominal.

The solicitors may all be correct if you have adverse immigration history which will disqualify you from applying. Adverse immigration examples: criminal conviction, overstaying and other breach of immigration rules. If you have none of those, then you are free to switch to 5 year route anytime as long as you meet the Mandatory Requirements: English Test and income requirement of £18,600 but if you and your wife both require limited leave to remain, then the required amount increases to £22,600 per year before tax.

There is no category to apply to regularise your stay in the UK unless you have other reasons such as having a child or partner (but even with this is difficult). There is a category for Private Life 20 years residence.

am on family parent 10year route. started a new job six months ago with gross salary of over £19,000 meaning i have 6 month salary atm. also have english requirement. can i switch to 5 year route and also the application online does not allow you to select categories. whether 5 or 10 route.
You should continue to apply under the parent route and then address the switching in your cover letter and ask to be placed under the 5 yr route.

If you are already 5 years in your 10 year route, it wouldn't save you time and money by switching because you would need to be on the 5 year route for 5 years to be eligible to apply for ILR.

@@kingj8825 You can do the Life in the UK Test but wait on the English Test because it expires after 2 years. Only do the English Test when you are closer to applying for the ILR.

Yes, both sponsor and applicant's income can be combined to comply with the financial income requirement.

Switching only benefits if you were on 10 year route initially and then comply with requirements on second renewal. This will save you 2.5 years of time as well as money on fees. Hi i have applied for my second visa extension (10year route) if i want to switch my category from 10 year to 5 year route will i have to still wait for ilr till 60 month? My wife has almost finished 5 years of the 10 year route and due to submit next application for the third 2.5 visa, can I submit an application with these two requirements and it would mean that she has completed the 5 years and can directly apply for Indefinite Leave to Remain? She will need to complete the 5 years under the 5 year route. In her case, there won't be any benefit to switch now.
