So Mr Beast would be copyright stuck if France the country/government wanted to, but there is no monetary gain since Shorts are not monetized. BUT wouldn't MatPat also be subject to that since he is profiting off of a clip from a MR Beast short of the Eiffel Tower lights at night? Isn't MatPat's video also just as illegal? Or does he get protection by only "sourcing" the original?

The thing is:
France can only just "act angry" about the copyright violation.
They don't have any actual way to enforce it, as any judgement cannot actually be enforced.
For international enforcement it needs co-signing by a local judge, who will verify if the specific law would also apply in the US.
Otherwise while the judgement stands, it cannot actually be executed.
Matpat is the only guy who can make u forget the topic of the video yet u just keep getting too excited.

Because unlike Mr.Beast who conducted himself as a professional on-set director of a scene, MattPatt is using licensed stock footage as a product editor. The real issue is, TH-cam is actually on the hook as the prduction company and platform exhibitor. Sure, Mr.Beast made an illegal recording, but on a TH-cam account. In function, the cameraman nor the editor is not the production company, regardless if payment for work while under official terms of agreement was given or not?

Curiously enough, I was SHOCKED when I saw the Tower light show. The copyright laws covering that made the rounds on the internet a couple years ago. I was unsure as to what law may have been broken by such a stunt, but the moment I saw that lit up Tower I immediately knew. But it was fun to discover that baked goods can enter the USA without declaration.
The funny thing is that I knew exactly where Matpat was going with this thanks to one of his Game Theory videos that mention the fact that photos of the Eiffel Tower at night with lights is illegal.
As soon as I saw the night time Eiffel Tower, I knew exactly what the issue was. Still, it's such a wild concept that a photo of the lights of the tower, of all things, is illegal.

In Denmark there is also a statue that is copyrighted it known as "The Little Mermaid" , drawing, or other depictions of statue is copyrighted until 1. January 2030, however many tourists still upload pictures of it, as it isn't really enforced, only a few cases.
Still wild that a statue of The Little Mermaid a famous childrens story, sitting in public space is copyrighted.

If is not the tower itself, but the lights. The way the lights are set up is considered art on the eiffel tower. It is not a wild concept at all. An artist with the lights designed the look for the tower.

I think when they were brainstorming they came up with the first dozen or so video ideas and figured they would come up with a lot more theories to test as they went along, and we all see its been real lukewarm.

By professional they mean commercial use. The video made no money, like you mentioned, thus it is not an illegal short. Also TH-cam is a social media platform.

Fair use is a legal concept only in the United States of America. Britain and other Commonwealth countries have a concept called fair dealing, which is a lot more limited in scope than fair use allows.
As for EU members? They have neither. Copyright does have certain limits already in place but it's nowhere near as open as neither fair use or fair dealing allow.

I don't think this counts as an actionable claim as there is no money involved.
Most they can do is ask to take it down or cut that scene from video.
And after nearly half a billion people have seen it, i don't think it even matters if it is taken down.

Did everyone just forget about TeamSeas which the group is called Ocean Cleanup that is extremely CONTROVERSIAL within environmental circles because:
a. Cleaning plastic trash FROM THE OCEAN is like scooping a few drops of water from the ocean AKA an exercise in futility when stopping the trash from getting into oceans is a far more effective measure. AKA stopping corporates. Or simple cleaning up the rivers BEFORE THE TRASH GETS INTO THE OCEAN which plastic breaks down into MICROPLASTICS.
b. The TeamSeas "project" provided a greenwash marketing for polluting companies that donate a few million each but they are the ones who pollutes the environment in the 1st place. It's like providing a tissue to stop the bleeding, worse than a bandaid.
c. This is not going to be the last time that a TH-camr ignores rules like CryptoZoo, Established Titles, NFTs, AKA TH-camrs are not your friends. They are out to get money no matter where it came from (J.Donaldson does recieve various sponsorship money including from oil and plastic companies).
I've been watching this channel for over a year, and I just noticed the reference you put in to the most underrated show ever in the intro.

Technically the stranger didn't break the law. He wasn't the one recording the eiffel tower. So Technically it was the cameraman/Mr. Beast paying the cameraman
Australia is quite strict, when I was visiting my Aussie side of the family I was so nervous that I would get fined so I just declared everything in my suitcase. Thankfully I went with no fines and kept all of my belongings.

Literally just went through customs from Indonesia to Australia the border is strict af and serious as bringing a maccas meal to Australia with foot and mouth disease can lead to billions of dollars loss in the economy, crippling it.

The facts regarding Australia's ecosystem and import laws reminded me of a law in Iceland I heard about once:
If an Icelandic horse is exported from the country, it's not allowed to return. Ever. Nor are other horses allowed to be imported. It both preserves the breed and protects it from foreign diseases/parasites.
Always thought it was pretty cool, and it's cooler to know that such precautions exist in more than one place :)
