Yes it is closed guard. Whenever someone is in between your hips and knees, he is in your closed guard. Closed guard doesn't necessarily mean that your ankles need to be closed.

I've heard it described as closed guard with their posture broken is slightly advantageous to you while closed guard without their posture broken is slightly advantageous to them. They are still "on top" and if there were strikes allowed it could still be super dangerous if they have posture.
