First, you say that paying taxes is our way of 'donating to the government industry to build schools, hire teachers, etc., when, in fact, we are not DONATING ANYTHING. Taxes are being forcibly taken from us to build the schools, etc. Second, You are actually right about something. Government is an industry. It is the most corrupt industry in the history of this nation. Always know what is right of way and the jurisdiction. Ran into a situation in Clearwater, FL, where the abortion mill was just inside the Clearwater police jurisdiction. They have always been fair to us. Right across the street was Pinellas County Sheriff's jurisdiction. They have always been a pain to deal with. Well the mill called the Pinellas County Sheriff's dept. They show up with 5 patrol cars, and started to question me. I flatly told them, they don't have jurisdiction. They call a couple more sheriff cars in. After 25 minutes, one Clearwater cop shows up. The Pinellas County sheriff's looked pretty pissed, but they slowly began to leave. The Clearwater cop asked me, you not to block the driveway? I said, "Yes Sir" - he said OK, and left. LOL - always know the boundaries!

The Bill of Rights - and especially the First Amendment - protects against government interference in the right to spread whatever message a person may wish, even if that message is stupid and wrong. The issue in each of these cases is not YOUR right. The issue is MY right. If you can be denied the right to say what you are saying, that means I lose the right peacefully to disagree with what you are saying and point out how mistaken you are. Of course, if you are interfering with other people rights to use a public roadway or pathway, that negates a First Amendment right. As far as I can tell - and admitting that facts here are limited and unverified - while having a flyer thrust in your face is annoying, it does not amount to interference with use of the public way.

OK, consider this. Your group was there with a good message, you meant no harm to anyone, you did not intend to interfere with anyone's life. And in truth, I support what you were trying to do. BUT, society has changed in way that police and school authorities have to look at things differently. When you see groups and individuals shooting at kids on school property, you see groups like Black Lives Matter, the KKK, political activists, on and on, they have to err on the side of safety for the kids. It's becoming harder and harder to find a happy line between peoples rights to gather, protest speak publicly and the rights of those they wish to impose themselves on. Now you were NOT looking to do any of that I get it, you do have rights, guaranteed by law, but when standing for those rights, we also have to consider safety concerns others may have. Also, consider this, if they were to allow you to do this close to the school, they would then be obligated to give those rights to individuals and groups that had a different message and attitude. I would like to credit both your group and the police for how this was handled, EVERYONE explained their position respectfully, no one got mouthy and heavy handed, at least up to when the recording ended. I can only hope that this worked out as well as it to.

My biggest frustration is that all these videos where LE officers are caught practicing unconstitutional habits is that they are only uploaded on TH-cam to entertain the rest of us but not taken to the local media/news to expose them and have their families, friends, and other coworkers see what they really do when in uniform--violate peoples' rights. If that would take place, most officers pulling this kind of BS would start upholding their oath like they should be. Local news are always hungry for more stuff to share on TV, especially when there is real footage like this.
GODISMYJUDGE Schools are not really considered "public property" in the same way a park is because they are actually under the responsibility and ownership of the School District in which they are contained. Because of this, the school district can control hours of operation and when people are allowed on the property. It's true that you will usually not get in trouble for being on school property outside of their hours of operation, but that is not always the case. For example, a school that is constantly subject to vandalism can make it's policy that no one be on the school property, outside school hours, without consent from the school board. If the property is clearly marked this way you can be arrested for trespassing. Now if you guys were speaking on the sidewalk outside of the school, as in the paved area running parallel to the public road, then you are in fact okay to be there, but if it is the walkway leading from the school to the road, then that would be considered school district property and you can be asked to leave. Schools shouldn't be thought of as public property in the way a public park is, but more like a government agency like the DMV. You can be asked to leave from the DMV as well if you were to stand in line and yell or preach at people and it wouldn't be them kicking you off public property, even though that property is maintained and financed by tax dollars. If you guys were on the sidewalk off school property, then keep doing what you are doing, if you were on anything that is recognized as school property then there is nothing wrong with asking you to leave.
I would add that even being on the public right-of-way in front of the school isn't a guarantee that you won't be asked to leave if you're making such a racket that you're disturbing classes.
DynaCatlovesme Okay... Elementary schools usually are K-4? Middle is 5-8? Senior is 9-12? So, K is four to five years old, first grade is 6 years old. Yeah, I can see how a guy with a camera would be suspicious, depending on the subject matter they saw him taking pictures of, ya know? K-1 on the playground? not good, for example. Imagine if it was a private investigator searching for a kid who was kidnapped by a stranger, or even the other parent who lost parental rights in a divorce and the guardian moved to a new town without prior notice. Or, the guy could just be some perv seeking a new victim. Hard to tell, so err on the side of caution. But, the older the child is, the more likely that child has a phone with a camera. Come to think of it, this would be a good reason for teachers to have phones with cameras to be kept on them at all times. Take a picture and send to Admins and alert cops quickly? What do you think?

In today's world, I wouldn't want a group of adult strangers showing up at my son's school unsolicited to hand anything out. Especially when the strangers feel so entitled to approach children with their own personal agenda in mind. To me, that's abrassive and narcissistic behavior. No one has a right to compromise the safety of children by showing up to a school unannounced to hand out literature that has not been approved by that school's Parent Teacher Association prior to that day. A reasonable person would think that if a stranger would cross that kind of boundary; what's to prevent that person from doing some kind of harm to those kids? There is a right way and a wrong way to do everything. This time, the ones behind the cameras were in the wrong.

They are trying to circumvent the proper method of educating children by having the cirriculum changed through the consensus of the community. They are risking the safety of all the children in the school by trying to intimidate the police & school faculty to not act upon the presence of unidentified adults loitering around school property and engaging with the students for purposes unrelated to the activities of the school grounds. Actually right of ways go by the width of the street. The street is the right of way. If the black top is 50ft wide but the right of way on record is 100ft wide that means you would have 25ft of public property on each side of that black top. It doesnt go from the persons property going towards the street.

The Bill of Rights - and especially the First Amendment - protects against government interference in the right to spread whatever message a person may wish, even if that message is stupid and wrong. The issue in each of these cases is not YOUR right. The issue is MY right. If you can be denied the right to say what you are saying, that means I lose the right peacefully to disagree with what you are saying and point out how mistaken you are.
Of course, if you are interfering with other people rights to use a public roadway or pathway, that negates a First Amendment right. As far as I can tell - and admitting that facts here are limited and unverified - while having a flyer thrust in your face is annoying, it does not amount to interference with use of the public way.

OK, consider this. Your group was there with a good message, you meant no harm to anyone, you did not intend to interfere with anyone's life. And in truth, I support what you were trying to do. BUT, society has changed in way that police and school authorities have to look at things differently. When you see groups and individuals shooting at kids on school property, you see groups like Black Lives Matter, the KKK, political activists, on and on, they have to err on the side of safety for the kids. It's becoming harder and harder to find a happy line between peoples rights to gather, protest speak publicly and the rights of those they wish to impose themselves on.
Now you were NOT looking to do any of that I get it, you do have rights, guaranteed by law, but when standing for those rights, we also have to consider safety concerns others may have. Also, consider this, if they were to allow you to do this close to the school, they would then be obligated to give those rights to individuals and groups that had a different message and attitude.
I would like to credit both your group and the police for how this was handled, EVERYONE explained their position respectfully, no one got mouthy and heavy handed, at least up to when the recording ended. I can only hope that this worked out as well as it to.

My biggest frustration is that all these videos where LE officers are caught practicing unconstitutional habits is that they are only uploaded on TH-cam to entertain the rest of us but not taken to the local media/news to expose them and have their families, friends, and other coworkers see what they really do when in uniform--violate peoples' rights. If that would take place, most officers pulling this kind of BS would start upholding their oath like they should be. Local news are always hungry for more stuff to share on TV, especially when there is real footage like this.

GODISMYJUDGE Schools are not really considered "public property" in the same way a park is because they are actually under the responsibility and ownership of the School District in which they are contained. Because of this, the school district can control hours of operation and when people are allowed on the property. It's true that you will usually not get in trouble for being on school property outside of their hours of operation, but that is not always the case. For example, a school that is constantly subject to vandalism can make it's policy that no one be on the school property, outside school hours, without consent from the school board. If the property is clearly marked this way you can be arrested for trespassing.
Now if you guys were speaking on the sidewalk outside of the school, as in the paved area running parallel to the public road, then you are in fact okay to be there, but if it is the walkway leading from the school to the road, then that would be considered school district property and you can be asked to leave.
Schools shouldn't be thought of as public property in the way a public park is, but more like a government agency like the DMV. You can be asked to leave from the DMV as well if you were to stand in line and yell or preach at people and it wouldn't be them kicking you off public property, even though that property is maintained and financed by tax dollars.
If you guys were on the sidewalk off school property, then keep doing what you are doing, if you were on anything that is recognized as school property then there is nothing wrong with asking you to leave.
I would add that even being on the public right-of-way in front of the school isn't a guarantee that you won't be asked to leave if you're making such a racket that you're disturbing classes.

Elementary schools usually are K-4? Middle is 5-8? Senior is 9-12? So, K is four to five years old, first grade is 6 years old.
Yeah, I can see how a guy with a camera would be suspicious, depending on the subject matter they saw him taking pictures of, ya know? K-1 on the playground? not good, for example.
Imagine if it was a private investigator searching for a kid who was kidnapped by a stranger, or even the other parent who lost parental rights in a divorce and the guardian moved to a new town without prior notice.

But, the older the child is, the more likely that child has a phone with a camera.

In today's world, I wouldn't want a group of adult strangers showing up at my son's school unsolicited to hand anything out. Especially when the strangers feel so entitled to approach children with their own personal agenda in mind. To me, that's abrassive and narcissistic behavior. No one has a right to compromise the safety of children by showing up to a school unannounced to hand out literature that has not been approved by that school's Parent Teacher Association prior to that day. A reasonable person would think that if a stranger would cross that kind of boundary; what's to prevent that person from doing some kind of harm to those kids? There is a right way and a wrong way to do everything. This time, the ones behind the cameras were in the wrong.

They are trying to circumvent the proper method of educating children by having the cirriculum changed through the consensus of the community. They are risking the safety of all the children in the school by trying to intimidate the police & school faculty to not act upon the presence of unidentified adults loitering around school property and engaging with the students for purposes unrelated to the activities of the school grounds. They believe that their rights are more imoortant than the rights of all other citizens and taxpayers within the community. And they do so because they incorrectly believe the Constitution guarantees them not just the right to speak, but to be heard, and because no children or parents are voluntarily soaking up their drivel, they'll go and force it upon children where they are most easily cornered (check yourself if you do not think adults univitingly approaching minors for their own agenda is not coercion).

Actually right of ways go by the width of the street. The street is the right of way. If the black top is 50ft wide but the right of way on record is 100ft wide that means you would have 25ft of public property on each side of that black top. It doesnt go from the persons property going towards the street.
