I was referring to the race entry he did get, which the video highlighted. Obviously, he didn't get a slot into the race that he DIDN'T get into as it already passed...and he didn't compete...I don't feel like that explanation was necessary in my initial comment, but I guess it was?

Whoever created the rejection letter should have known better than to place an image on it! Or if they did why not the image of the organizer of the event?!
Exactly. As someone who works in corporate communications, I had to do a double take on why they put him on a mass emailing. No model release signing or permission to use his image for publicity? They are lucky he is a forgiving, upbeat guy, he could have sued.
Usually in events there is a disclaimer and waiver when you sign up that says photos will be taken and can be used for publicity.
PR people are not about substance or reality

Boston and New York are so popular, you need to have run in other events first who are registered as 'boston/nyc qualifiers' and when you register for the run you need to include your official time in the application. they probably get over 100k applications but only have room for what? 50k?

I've gotten those emails before. NYC is VERY hard to get into.
Even as a NY'er if I want guaranteed entry I'd have to do the 9+1 which is a huge investment in time and money.

I love this story - because it ends with an apology and turning things around - this is so often possible if people just had the courage to own up to mistakes, but it is so, so rare in today's world, sadly.

How did they even get his pic? From a previous NYC marathon run?
If I was further along and I was a NY resident, I would: Become a NYRR member. Run 9 of their designated races practicing my half marathon pace or marathon pace (could be mentally challenging to enter a race and not ‘race’) and volunteer in 1, or if I’m fast enough, run a qualifying time for my respective age and gender and get a guaranteed race entry for the following year.

I believe it is illegal to include someone's image without their permission on such a widespread format. 😮
There was probably something in the contract/terms that said their marketing team can use any photos the company takes at the event

You agree to be photographed and have your photo used when you sign up to run the marathon.
If your in public, you dont own your own image. Like if your on a public sidewalk, and a photographer takes a photo of you, even if its of you... its their photo. They have rights to it and can use how they please outside of like defamation.
Its kinda weird to think of that you dont own or have rights to a picture of yourself, but its pretty common. Maybe im wrong, but having worked in a print center for a while this is the kinda stuff that got brought up in regard to copyright etc. People would ask me to make copies of some magazine, newspaper, or photgrapher or something and even if it was of them id have to say "Sorry but I need a print release from the owner before I can do that" and Id always get this dumbfounded look on their face cuz it was usually a photo of themselves or a loved one they wanted copies of...
I got rejected 10 times and finally got in this year! Happy to have missed out on this one.
