  • Stuck at the entrance gate in their own community, that's what some first responders in Royal Palm Beach say they are dealing with when they come home in their patrol cars.

    Little does the HOA know, that in an emergency, the first responders can legally ram the gate and break through to get in. Then bill the HOA for the damage sustained by emergency vehicles trying to get in.

      @@bobleeswagger2290 Extra rights? Going home is an extra right? If they are a resident there then they should be able to use the gate for residents, not guests. One can only hope that one day you will need the assistance of a first responder and they are unable to get to you in time.

      Did you not hear a man saying he was trying to get home? Therefore he lives in this HOA community. If by some wild stretch of the imagination I loved in the situation community and had a fire or medical emergency at my residence and the ambulance or fire truck couldn’t get in there would be hell to pay. I would sue the HOA board collectively and each member of the board individually and when I won they would wish they had never been born.

      Couple of my family live in a HOA area. There’s a pothole on one of their roads and instead of fixing it they meet like once a month and put more gravel in it because no one wants to pay to fix it

      they can also replace the management company, but first service is one of the largest management companies in the country i bet they have the board in their back pocket.

      @@akui88 we had FSR three years ago and refused to extend their contract when it was up for renewal, and went with a local company. My wife and I were the first residents in a 55 plus community and the gate did not work when we came home one night. I called FSR and gave them my passcord and the moron on duty told me she "did not have the authority to let us in." I asked if the camera was operational, and she said it was. I then told her my wife was recording our conversation, I had high blood pressure, my medication was in my house on the other side of the gate, and to make sure to record me as I rammed the f*cking gate to get home. The gate opened immediately!

    Last November I had a heart attack. It took paramedics just 7 minutes to get here and only a few more before I was on the way to the hospital.
    Three minutes after reaching the hospital my heart stopped.
    I am only alive now because I had access to immediate care. If the ambulance had been delayed at all, I would have died.
    How the hell can you say "First responders are just like everyone else. They have to wait in line."?
    That has got to be the most stupid thing I have ever heard.

      HOA has ruined my life. Locked in a 6 year legal battle with HOA that takes every minute of my free time. Never buy in an HOA, but it's hard to avoid in FL. There are a lot of scams & crimes in Florida and HOAs top the list

One even got mad at a dude who put a fence around his pool so young children would fall into it and drown the HOA told him remove the fence. Or you know they try to force you to have you mail box a certain height. Hell one even forced homeowners to leave their garage open at all times. Hoa's are literally against the law and want to take your rights like biden.

    If somebody dies because first responders can't get in, then they need to be charged criminally. There also needs to be obstruction of justice charges every time a first responder needs to be let in and they have to wait while somethings going down.

      This isn't about first repsponders trying to get in on a call it's about first responder who live there coming home in work vehicles on night's they're on call form home. Anyone else who had to take a work vehicle home, that isn't registered as their primary vehicle, would be in the same boat.

    Having lived in an HOA complex myself, my advice is to sell and move. You don't need the aggravation. That is supposed to be YOUR home and the HOA treats people like renters instead of owners. You are paying HOA fees for them to make your life a living hell.

      Dispatch has the authority to block your number under certain circumstances. Usually it's excessive prank calls, but a chronic history of obstructing first responders will do it too.

      They exist to protect property values, becoming a pseudo-Ponzi scheme. People specifically buy into HOAs to sell at a profit a few years later. The buyer is likely looking to do the same thing, because of how much profit it gave the previous seller. And so on.
      The problem is that selling an HOA property is too lucrative for people to turn down as an investment. And if you know you're selling in a few years, what do you care about the long-term leadership? If it all collapses after you leave, it's not your problem.

      @@TheAttacker732 the thing there is - property values in HOA increase in value 'less' over time than non-HOA properties, then there's the fees on top of that, so overall they do the opposite of what they say they do. They'll often refer to "HOA properties are on-average higher value than non-HOA properties" which is true, but that's because HOA properties tend to be in affluent areas already. But the appreciation of the property value is less. Then on top of that, you're removing from the prospective buyers' list, everyone who actually wants to own the house they live in.

      Blaming people for owning property inn an HOA is dumb. In many areas nearly all new construction is in HOAs and basically everything for sale over a certain price. You don't get a ton of choice, especially if you need features that an older house won't have.

      I am a first responder, I was on a call where the first due engine for a structure fire couldn't get in due to a similar gate setup, they used a K12 saw and the Jaws Of Life to cut the gate into pieces and gain entry, HOA tried to sue, lost and had to pay all associated costs plus a new diamond blade for the k12 saw and new cutting edges for the jaws Of Life, after that they installed an Opticom system that used the pre-existing equipment on the trucks to open the gate automatically when the emitter is activated, another call I was on the first due engine was old and up for replacement so they rammed the gate, HOA paid for repairs which increased the resale value, that HOA didn't install an Opticom system, instead they just gave the fire department an access card

    I lived in an HOA when we moved to Florida. I'd never heard of an HOA, and didn't think it mattered. Man, what a mistake. Every home I owned after that, the first thing I told the realtors, "Don't even show us any homes with an HOA."

      There are some good and relaxed HOA’s. There should be a website that allows you to rate your HOA, so potential home buyers know to be weary or relaxed. I am concerned if I ever move because I have pit bull, and some HOA’s have a breed restriction.

      I was going to build a new house last year but EVERY builder was building HOA home communities. I ended up buying a fixer upper that was not in an HOA. And I'm thrilled with my choice!

      unfortunately for some people it's not an option to refuse living in an HOA. in my area, if you want to live within a reasonable commute of your job and you want to buy a house, majority of houses belong to an HOA. My partner and I are trying to purchase a house and practically everything is HOA, unless we want to live in the middle of bumfuck nowhere. I'm going back to college to change fields and get a higher income, where most of the jobs are remote so hopefully if we have to move out of state to afford a house, I can work from home and have a comfortable income.

      I have a small ranch and there is an HOA community next to me. I moved my hog pens near their fence and the smell wafts over in the breeze. when my geese start honking at 3 am and the rooster starts crowing at 4 am it can get quite noisy. But I am zoned for livestock and they built next to me and there is nothing that can do about it.

    I worked in gated communities security in this area back in 2001 and was told to stop ALL first responders (yes lights and sirens going) and not let them in unless the home owner says it ok, i left the next day.

      To be fair, that's a thing I do at work as security. It varies by the company I'm at, but for some, policy is that if you call 911, you also need to call me to let me know to let them in, or I'm required to stop them. It's less common these days thanks to mandatory dash-cams on police cars, but apparently it used to be a thing where emergency vehicles would use their lights and sirens to get access to restricted areas when there was no valid call, either to investigate without a warrant or simply to steal something.

      @@dragonstouch1042 In case of emergency, yes. The problem here was that first responders wanted to take their patrol cars to where they live when they were on call. Obviously this shouldn't be a problem, but it's not an emergency. So while it is absolutely frustrating and dumb from the HOA, it's still illegal to just bust down barriers. Unless it's an emergency, this is a civil matter.

      If you ever read the book, "The FBI" by David Kessler, there is a story about incident like that, where an HOA guard told two FBI agents they couldn't enter. While the driving agent was arguing with the guard, the passenger agent, an agent I knew, who we used to call Magilla Gorilla because he was so big, got out, broke the arm off the gate, got back in the car, said, "Drive'.

    If there's an emergency, seconds count, especially if it's life or death. If I have a loved who dies because first responders couldn't get to them in time do to this nonsense, than I'd be suing that HOA! They do not have to the right to endanger someone's life like that!

I didn't live under such rules after I became an adult and still lived with my parents for a few years.

    Wonder how many residents drive home a work vehicle and haven’t had issues? Seems like this HOA only has a problem with law enforcement. And just like a few people already stated: TF does being a resident with a card have to do with what you drive? I remember having his issue at a gated community in the fire truck once. Our engine and ambulance was trying to get in for an unconscious female that fell off a boat into the river. The gate card wouldn’t work and the HOA refused to open it. So I had my guys put a chain from the engine to the gate and we pulled it down. Gate and brick pillars came down. We had to fly the woman out because she has a severe head injury. We then had the HOA and the head of the HOA charged with obstructing emergency personnel from discharging their duties. (A felony in Virginia)

    I agree with Keaton. I have a friend who is Emergency responder for over 20 years and he said he lost count of how many gates and barricades hes taken out, he said never has he had to pay for any damage. It's in the guidelines.

    HoA cannot block an emergency vehicle from coming in for any reason.
    Those vehicles are exempt from all HOA rules.
    The HOA board members should be arrested for interfering with a police investigation.

    I live in an independent senior living community here in Atlanta they solved that problem installing an emergency vehicle override so that APD and Atlanta Fire Rescue can respond without having to deal with that problem which is absolutely insane., BTW everybody uses the same exit and entrance residents, visitors delivery personnel First Responders no exceptions they have a separate system set up the same way the building next door which is part of the same community but the codes are different on purpose., but the emergency vehicle override is still used at that building as well. This was an attempt by that community's management to look all-powerful but instead they made themselves look stupid. I hope they find enough information on how many times people have had problems getting in so the sheriff's department and the county can haul them into court over this sometimes an HOA is nothing but ego masturbation

    I put in a SOS emergent system about 20 years ago in an apartment complex (Siren Operator System). Technology has got to be even better these days. Non-urgent situations I preferred they use the drive up front panel call system to have Maintenance let them in rather than set off sirens for 1 to 3 seconds in front of the community entrance at 2am but their sirens were so much faster Hahaha as long as they were in I was fine. We also had an emergency gate release system in the breaker box out front just behind the gate but as I told I Fire Chief, "We're insured, ram it down, save our Residents, charge us later."

    HOAs are a result of people buying "investments" instead of homes. If you consider your primary residence an investment, you are likely in favor of HOAs as well. I sold my first home due to the HOA and bought in a non-HOA neighborhood. Absolutely love it here.

    I live in a house within a community without an HOA and its freaking fantastic. Yes some of the homeowners aren't the greatest at upkeep. However you see creative homes like my across the street neighbor that painted his house a turquoise color to match his beautiful antique (well maintained) truck. That or the neighbor with the paper lanterns decorating their lawn. I ❤ it.

    As a retired fire Captain, we required all gated communities must have a Knox Box key box that activated the gate. The fire department had a key that would work ALL Knox boxes gates in our city.

    I don't know about anyone else but I would love to have a marked police car or EMT vehicle in my neighborhood.
    years ago, in Maryland, I had a detective and his brother , who was a patrol officer, living next door to me. One night I called 911 to alert them about suspicious activity across the street. I hung up and w/in 30 seconds my neighbor was at my door, pistol in hand. I learned that in an emergency (at least back then) the police assign the closest officer to the call; whether on duty or not. The detective's car was "unmarked" and the brother was also able to take his cruiser home. There was at least one police vehicle in that driveway 12 hours every day. No one I knew ever complained.

    A lot of places around California have a special keyed entry system for first responders. This keyed system overrides the gate and allows them entry. They also have what's called a Knox box. This box holds certain keys for various entry points to certain parts of the property. Not to mention that being a security officer, if I see police, fire, or an ambulance at one of the gates to a property I watch, you can bet I save them the trouble of getting out of the car and book it to the gate to let them in. Seconds count in certain situations. To make residents wait in the same line as guest is stupid. They paid for the house they live in, they pay the fees to continue to live there, so I'm sorry, to turn off there stickers because they are using their on call vehicles is the most ridiculous thing they could ever do.

    Hindering in an emergency situation. That is illegal. There should be a section where police, fire, and ambulance have another way in for emergencies. If not, they have the legal right to enter the gated community to help a resident of said community. Otherwise, the HOA is going to get a big fat lawsuit if a resident dies because the emergency responders can not get in.

      Actually there is nothing wrong with us! But place the blame on runaway hoa bullies on power trips. Most importantly, there are thousands of hoa run communities that are beautiful,quiet and pridefully owned places, where you can live without trash, unkept properties and run down properties ruining your values. If there is a problem? FIX IT! I’m in my first hoa run community and actually live in the first place with friendly neighbors, without worrying about “there’s always one neighbor “ that causes problems and hard feelings. In our first new home, there was a neighbor bordering our back yard, that was a constant problem, with crap all over their yard, with four cars that weren’t registered or road worthy. Not I have no worries about that!

    In our Fire District there is a gated community and more than once the gate code we were given didn't work and we busted right thru then they did key cards same thing didn't work and we busted thru the HOA couldn't say anything and had to buy new gates

    I used to do copy repair for an HOA office and I would laugh to myself all the complaints I used to hear. One guy was upset because he needed a permit to have more than 9 guests in in his own backyard. When I bought my house, I made sure I did not buy into a neighborhood where there was an HOA.

    If I'm not mistaken, all community gates are supposed to have the SOS system where they open with a siren. Easy enough, hit the yelp, tada. I've used it before to impress my Uber customers.

    When we used to live a gated community, the code for the gate was programmed with the zip code to open the gate so the first responders can open the gate.
