The guy committed a hit and run and deserved to go to jail. I don't exactly know the laws in Arizona, but here in Germany, you can only be fined for a crime when you were able to understand the consequences and decide against it. Looking at the kinetics of that accident, some sort of physical or at the very least psychic trauma is likely, preventing the suspect from being able to understand what he's doing. Obviously, if he were laying on the ground injured, you would not charge him for failing to render first aid either. I'm not saying this guy wasn't trying to run, but there are other good explainations for his weird behaviour. And as long is there is a reasonable doubt, he should at least be checked through and treated like a victim first.

The people defending the kid are saying that the cop should have played it on the safe side. He could just as easily arrested or charged him later once he was checked out and found not to be concussed or found to be on drugs. The guy was not co-operating with the police with the drug testing 2:55 I have been involved in 2 serious accidents-one of those was fatal- involving tractor-trailers and believe me I was FAR more disoriented due to the hits. Neither of those times did I leave the scene of the accident. I stayed and rendered whatever aid I could until the authorities arrived. Hardly anybody reads the drivers education handbook. Everybody thinks there a pro after leaving the DMV with a license until they lose control of their vehicle and reality hits them. Driving is an extremely delicate act and one mistake can end you. During a serious traffic accident you are disoriented and in a state of shock. You may end up doing things you wouldnt normally do or act in way you wouldnt normally act. Yes, that's what happens. They obtain a warrant to take his blood since they need to show a judge evidence that he could possibly be under the influence of something, if the judge approves, they would take his blood at the hospital or station.
Gerdss you’re partially correct. Technically a blood warrant could be executed at the hospital, but unfortunately a surprising number of nurses and doctors are uneducated when it comes to blood draw laws and how they apply to patients. In my experience, it’s always easier to take blood at the jail. Sometimes I just don’t feel like explaining to 3 different people what a blood warrant is and why I’m legally allowed to take his blood. Disclaimer, this is only from my personal experience in my state of Texas.

The proper description for this cop, is having lack of discretion. I’ve met alot of cops with discretion that make reasonable decisions whether a person should actually get arrested or not. This guy just arrests or cites everybody he see’s. Its kind of annoying to be honest.
He’s walking away most likely due to extreme shock. This isn’t unordinary and this cop seems like he’s completely oblivious to that fact.
Someone can be under some degree of influence AND have a severe concussion. Someone can have done some degree of wrong AND deserve to be treated with compassion and concern for their injuries, without that condoning possible but unknown wrongdoing.
That pig of an officer needs to be put behind bars. He's a danger to himself and the public.

Everyone acts differently when concussed, just because you couldnt speak properly does not mean someone else wouldnt. The people defending the kid are saying that the cop should have played it on the safe side. He could just as easily arrested or charged him later once he was checked out and found not to be concussed or found to be on drugs. When it comes to possible head injuries, play it safe, especially when his truck looks like that.

Well, he could easily have had a concussion and therefore could be confused. Why do think he made no efforts whatsoever to escape the cops? Don't be so quick to judge someone that obviously could have had a serious injury himself and could just be confused. At least try to use some logic

I have been involved in 2 serious accidents-one of those was fatal- involving tractor-trailers and believe me I was FAR more disoriented due to the hits. Neither of those times did I leave the scene of the accident. I stayed and rendered whatever aid I could until the authorities arrived.
Hardly anybody reads the drivers education handbook. Everybody thinks there a pro after leaving the DMV with a license until they lose control of their vehicle and reality hits them. Driving is an extremely delicate act and one mistake can end you.
If the dude has drugs in his system, he is going to have to live with the consequences of such acts.

It was reported as a hit and run - so the officer is treating it as it was reported. Witnesses said he took off from the scene. That’s a hit and run.

Saw n accident years ago; fifteen year old steals mom's car. She clipped a cop on a motorcycle, and then backed up over him, crushing him between a telephone pole and her car. She got out, and took off running. She was traumatized. This guy was on his phone. He wasn't traumatized
I've been hit twice in my vehicle from pot head drivers but seen many weed related accidents. Seen many alcohol related accidents too.

You're not completely conscious when you're concussed. You and I get into a wreck, you forget everything that happened and the only thing you know is that you're on a road. You must be homeless or something, so just keep on walking.

During a serious traffic accident you are disoriented and in a state of shock. You may end up doing things you wouldnt normally do or act in way you wouldnt normally act. This low IQ Cop doesn't know that, and automatically assumes the guy was "running" or "fleeing" when it would be reasonable to believe, given that he was just involved in a serious accident, that this may not have been the case. Just because he hasnt experienced it yet, doesnt mean that it doesnt happen!

Yes, that's what happens. They obtain a warrant to take his blood since they need to show a judge evidence that he could possibly be under the influence of something, if the judge approves, they would take his blood at the hospital or station.
Gerdss you’re partially correct.
Technically a blood warrant could be executed at the hospital, but unfortunately a surprising number of nurses and doctors are uneducated when it comes to blood draw laws and how they apply to patients. In my experience, it’s always easier to take blood at the jail. Sometimes I just don’t feel like explaining to 3 different people what a blood warrant is and why I’m legally allowed to take his blood.
Disclaimer, this is only from my personal experience in my state of Texas.

Not in Arizona. As the DPS officer said, a search warrant will be drawn up and an officer who's also a trained phlebotomist will arrive on scene and take a blood sample, no need to go to a hospital to do that.
They are probably checking him out too because he was in an accident.

Once I got into accident, I crashed to a motorcycle.The guy literraly flew from my car's windshield. He woke up and start to walk and said to me who are you? where am I ? etc etc... I mean that he could have a concussion and might be in a shock... False decision...
