The point you seem to be missing is there is no test to tell if someone is driving high other than smell and bloodshot eyes, which the officer saw none of or he would have stated.

Eddie Duran when conducting a sobriety test you have to do 3 field sobriety tests if you fail two out three your done I'm sure he failed the pen test and he failed miserably the breathalyzer test so he is done

in australia its the breathalyzer straight up. and there is no way to refuse. if you refuse a checkpoint you are automatically considered high range drink driving and our breathalyzers are better than the US ones they are accurate to .01 compared to the court verified breathalyzers in stations

That wasn't a Breathalyzer. It was a PAS (Preliminary Alcohol Screener/Screening). The PAS is not scientifically calibrated. The PAS is generally an option and not required of the officer (unless their department's policy manual says otherwise, usually doesn't require it though). The results of a PAS is just as valuable or invaluable as the FSTs (Field Sobriety Tests aka HGN, WAT, OLS (Horizontal Gaze Nystagmus, Walk and Turn, One Leg Stand)). They are all pieces of Prima Facia Evidence. They aren't admissible in court but do speak to a "Totality of the Circumstances" evidentiary element (you can google "totality of the circumstances and I won't type two more paragraphs about this being a well-documented term used by SCOTUS in police criminal and civil cases as an acceptable rule/standard). In this case, the driver was almost certainly driven to a place that had a ACTUAL Breathalyzer test and was given an authentic breath test using a Breathalyzer 9000....which IS scientifically calibrated and IS admissible in court as more than Prima Facia evidence. (In my experience, a PAS is usually pretty close...within a percent or two of a legitimate Breath-Alcohol Test. Most cops don't use PAS systems because there's usually too few to go around, not a standard issue item, and I can make a determination of likelihood of drunkenness or sobriety without it pretty easily. I do admit that of what little they showed of the WAT test, he did a pretty good job. However, we only got to see like 15% of it and I have seen it done perfect before by folks. Had a guy with like a .21 or .22 do a PERFECT WAT. The HGN is more the "telltale" test that anything else since that cannot be altered or controlled. Scientific studies that were done and relied upon to make the WAT a standard phase of the FSTs has been shown that gymnasts or very athletic and flexible people are able to perform the WAT phase with little or no indicators of intoxication all while actually being intoxicated. . . . . . TOO LONG DIDN'T READ VERSION: 1. That little box is a PAS, not a Breathalyzer machine. 2. We only got to see like 15% of the WAT phase (and yes, of that 15%, he did a pretty good job). 3. It is well-documented that the WAT can be aced by intoxicated athletes. 4. DUI guy got an actual breath test after he was driven to the police station or jail.

The reason is because the breathalyzer isnt permissible through court.
Once you fail the breathalyzer you get placed under arrest and taken back for a blood test or more accurate breathalyzer.

I like this cop. Completely agree with him. This day and age with designated drivers and plenty of alternatives such as Uber, Lyft, there is absolutely no excuse for drivers to drive intoxicated.
