Piyush Sir, at the stage of statement of accused u/s 313 or CrPC, what exactly happens? Does the accused simply tell his story OR is the accused examined and cross-examined? Are the statements made by the accused u/s 313 recorded in the order passed by the Magistrate OR are these statements "off the record". Thank you for the explanatory video and sharing your knowledge.
Hello Pratik...under 313...question are put to the accused which have come in form of evidence and witnesses which proved his guilt....so accused need to put his defence and state what he wants to say about those evidences and witnesses....there is no cross examination...yes 313 is recorded in the order passed by magistrate...and these are not just off the record statement...its a very important stage in criminal trial thought it is not given that importance practically....Thanks for appreciation....good luck...god bless....

I have studied many cases of 498A or even other cases also &observed that mostly cases are false based only.
Sir just going through the cases ,even person like me ,coming to know...which case is correct and which case is false. So is in the case of the hon.Judge,being so experienced.
In such conditions,why the hon.Judge is not calling for the pakka evidences from the petitioner,ofcourse confidentiality,& at the same time if he finds it nearly to false,he MUST use his power,u/s IPC 209,...DISMISSED the case ,free the respondent,& take severe Actions of DISHONEST ,punishing the petitioner itself....thus saving the valuable time of the hon court & reduce the unnecessary burden upon the courts .

Hello Bhaialal....it is for the parties to give pakka evidence....judge decides whatever is given by parties....judges do dismiss 498a complaints....judges don't go further to take action against dishonest if that is done then in every other case they will be doing the same.....cause one party is always on the wrong side....so there is a legal process through which one has to pass for legal judgements and justice....good luck....god bless...
Fir and chartsheet court se lasakte hai kya
Once your 498A chargesheet is filed in the court by the police, you will receive a copy of the prosecution documents from the trial court. The set of prosecution documents includes the original complaint of the wife, the FIR, the chargesheet, the statements of all the prosecution witnesses and details of the general police case diary along with any evidences that the wife may have submitted to the police to build her case. As an accused, the trial court if bound to serve a copy of all these prosecution documents to you when it serves you the court summons in a 498A case.

मेरे पति एक सरकारी कर्मचारी है और शादी के समय उनकी पोस्टिंग बिलासपुर छत्तीसगढ़ में थी । शादी के अगले दिन ही मेरे पति ने मुझे बिना विदाई कराए बारात वापस लेकर चले गए जिस कारण मेरे पापा की सामाजिक प्रतिष्ठा को बहुत ही हानि पहुंची और नतीजा ये हुआ कि मेरा पापा को बहुत ही गहरा मानसिक आघात पहुंचा और उनका बीपी हाई होने की वजह से उनको तुरंत डॉक्टर की दिखाना पड़ा😔
बहुत दबाव देने के बाद मेरे पति गौना के लिए तैयार हुए और गौना के दिन भी मेरे पापा के ऊपर कुछ दबाव बनाया गया और इस बार भी मेरी विदाई के तुरंत बाद पापा को मानसिक आघात पहुंचा और ब्रेन हैमरेज के कंडीशन से किसी तरह से बचाया गया और पापा को डॉक्टर ने किसी भी तरह के मेंटल टेंशन न लेने को एडवाइस किया
फिर इन सब परिस्थितियों के बाद भी मेरे पापा ने मुझे इस रिश्ते को संभालने की बात कही

Hi Mintu, the burden of proof to prove you guilty beyond reasonable doubt is on the prosecution i.e. the IO and the de-facto complainant (wife). If they have not attached the evidence in the prosecution documents that you have received from court, then I would suggest that you minutely scan line-by-line the contents of your FIR and chargesheet that you have received from the court. Discuss this with your advocate and see if there is a probability for you to file a discharge petition u/s 239 of CrPC in your case. I am only suggesting this because it seems that in the absence of evidence, the prosecution side's case seems very weak. So, to avoid a long trial and multiple dates, if your case can get discharged, it would be great for you.

Good morning sir.i am a victim of 498a from 2015.till the date no chargesheet is produced by IO.l have appealed to dismiss the case.but IO is not produced in the court.what do you think about the case?will it be proven a false case?

Hello sushree....its not that there is no rule of arrest but now the supreme court has laid guideline that police have to follow while making arrest or before making arrest in 498a cases...normally in laws are not arrested or made accused...so main is now husband and police have to take permission of magistrate before arresting...so some guideline have been laid....but still arrests are made...thanks...good luck...god bless...

@@LegalGurukul sir, I am paying interim maintenance in 125 since 2018. Again interim maintenance was awarded in DV in 2019 which was stayed by Allahabad High Court. Stay was till 03.05.2021 but Court didn't sit on that day due to covid. Now there is no further date fixed for the file in High Court.
My doubt is - can the opposite party ask for maintenance in DV now in lower Court. What shall be the magistrate's approach on this condition.

Hi B Nikesh, as per the Supreme Court's order in Rajnesh vs Neha, for every maintenance case the wife files (CrPC 125, HMA 24 or DV) both, the wife and the husband are required to file their respective Income, Expenditures, Liabilities and Assets Affidavit. This is mandatory. Only on the basis of this, the trial court will decide on the maintenance that needs to be granted to the complainant (wife). Do note that in the I-E-L-A Affidavit, there is a section in which you are required to mention all the different pending and on-going litigations between the two parties. In this section, you may mention the details of your CrPC 125 and DV cases and the orders passed in these cases. That way, the magistrate will come to know that the wife is already drawing maintenance from you in a separate case and this fact will definitely be considered by the magistrate in calculating and deciding the maintenance in your current case. Hope this helps.

Hello ....firstly you will have to prove that he registered false case....cause he will register case only on basis of complaint....so its the complaint which is false....moreover you will have to have enough proof of bribe etc then you can take action against the IO in court....good luck...

On arresting issue they said accused is coming for investigation whereas supreme Court guidelines have been changed now accused party will seek regular bail in court. I don't know rest of if you can help to fill the gap in this issue. Regards
laws, such as 498a is biased . Women with wicked vengeance are aware of the lingering process of a honorable trial court in which a case is registered on face value without evidence, a charge sheet is submitted, and a trial court cognizance is taken solely on face value.
Now the inlaws will begin defaming the husband, the wife will not appear in the trial court, and the mental trauma for the husband will last for 4-5 years while the wife enjoys her life and the husband lives in ignominy.
The trial court is aware that the case is a forgery and that the husband has evidence; however, the wife is not appearing for prosecution evidence.
The trauma will continue because the trial court will only give a husband a chance to prove himself after 4-5 years, if he is lucky, where the trial court appears unwilling to grant bail or accept a discharge application.
The question is where is justice? , where is Article 21, which discusses the liberty and dignity of an Indian citizen?

Nope because the case is in a different state. When the Maha Chor woman was denied an FIR in two different states, she went to court begging for divorce crying cruelity. First I made her wait for 6 months then suddenly appeared and submitted all the rock solid proof of her theft and forgery to the judge. Now they are beating chest and I am laughing. My suggestion to ALL men here: Whether the relation is sweet as honey or bitter as gouard, record EVERY single conversation,text, transaction and receipt. Nobody knows the character of a woman. Not even Brhma. Defeated them alone.

Hello...Amandeep....challan present hone ke baad regular bail karwani padti hai uss cases main jaha anticipatory bail mili hui hai...jaise hi challan pesh hoga to anticipatory bail khatam...aur phir regular bail leni padti hai...formal process hai...but ndps cases main anticipatory bail kaha milti hai....waha to regular bail hi nahi milti...haan agar kisi ko anticipatory bail mil jati hai ndps main to challan ke baad regular bail leni padegi jaroor...but anticipatory bail is rare in ndps cases....thanks...good luck..god bless....

Domestic violence case mein hi Judge ne maintenance Decide kiya tha to ab jab Domestic Violence ka case dismissed ho chuka hai District or Session court se to kya hum Ab Maintenance case par Rokne ke liye Appeal laga sakte hai kuki koi Allegations proof nhi hue. Iss judgement ke basis par maintenance case par rok nahi lagegi but aap maintenance case main iss judgement ko use kar sakte hain benefit milega....

मेरी बीवी पिछले साल सप्टेंबर मे घर मे मेरे माता पिता के साथ झगडा कर के रात मे उसके पिता के साथ निकल गई....उसके बाद मेरे घर वाले ओर मेरे परिवार के लोगो ने उसको आजाने को बोला....पर वो नाही आई....जाते वक्त वो pregnant थी.... बादमे उसने वो बच्चा उसने ऑक्टोबर मे गिरा दिया....फीर भी हमने उसे आणेके लिये वकील के तरफ से notice भेजा....उसके बाद उसने हमारे उपर आरोप लागये की मैने उसे मार पिट किया है....और उसके वाजह से वो बच्चा उसे गिरांना पडा.... और हम लोगो पे अब 498 का केस दर्ज किया....

Hello....a guy do not have any right over girls property or money until and unless he has contributed money in that property...or if its joint...in case guy is threatening then she can file a criminal complaint in police station also she should file DV act case and take protection orders from court....if guy violates protection order then FIR can be registered against him.....thanks...good luck...

सर मेरा आपसे एक सवाल है मेरा उनसे सवाल है जिन्होंने कानून बनाए हैं महिलाओं की सुरक्षा के लिए सर जब एक महिला ससुराल द्वारा प्रताड़ित की जाती है महिला को शारीरिक मानसिक आर्थिक प्रताड़ना दी जाती है महिला ससुराल द्वारा निकाल दी जाती है महिला को न्याय पाने के लिए कोर्ट जाना पड़ता है पीड़ित महिला जो ससुराल द्वारा बाहर निकाल दी गई है उसको जो उसके माता-पिता से सामान मिलता है वह भी वहां रह गया है और माता-पिता की कंडीशन खराब हो गई हो ऐसे में वह कोर्ट तक न्याय पाने के लिए कैसे जाएगी जिसके पास खुद के भरण-पोषण के लिए पैसे ना हो क्योंकि सर कोर्ट तक आने जाने में बहुत पैसे खर्च होते हैं क्या वह पीड़ित महिला बिना न्याय के रह जाए या गरीब महिलाओं को न्याय का अधिकार नहीं है अगर कोई महिला कोर्ट चली भी जाती है न्याय पाने के लिए अपने अधिकार पाने के लिए तो उनका कोई समय नहीं है केस को 1 से 10 साल तक लग जाते हैं और कोई सहायता नहीं मिलती है गुजारा भत्ता महिलाओं के लिए बनाया गया है लेकिन उसका फायदा महिलाओं को नहीं मिलता उससे ज्यादा उनके पैसे खर्च हो जाते हैं इतने समय के बाद भरण पोषण मिले या ना भी मिले कोई जरूरी नहीं है ससुराल से निकाली गई महिला इतने समय तक अपना भरण-पोषण कैसे करें या उसको आत्महत्या कर लेनी चाहिए सर मैं आपसे हाथ जोड़कर क्षमा मांगती हूं अगर मैंने कोई शब्द गलत लिख दिए हैं उसके लिए मुझे क्षमा कीजिएगा सर मैं अपने सवालों के जवाब चाहती हूं कृपया करके मेरी मदद करें🙏🙏
