  • The plaintiff says he hired the defendant to tend bar at an event he was throwing, but she canceled on him and left him scrambling for a replacement. He’s suing for the amount he paid the new bartender. The defendant says the plaintiff was threatening and condescending before the party, so she told him she didn’t want the job. She says there’s no way she’s paying for his bartender.

      This is also a good lesson to not quit angry. Had she been less condescending (say actually ask why he is telling her how to make drinks, rather than call him incompetent) he would have been more likely to explain and let her keep the job.

    There’s no way she’s a high end bartender with how unprofessional she was. People ask for specialty drinks all the time. Sounds like she probably only has experience as a restaurant bartender

      I'm kind of with the bartender. He changed the scope of the service after it was signed and the judge didn't recognize that craft cocktails are more work than just tossing a drink in a glass like you normally do. Instead of just slinging drinks, he wanted a performance. Also he talked her down to a lower price so he went the cheap route. He should have been up front that this would be an event where the drinks rather than the guests were the stars of the night. He paid for a tavern wench and then told her she had to be the Wolfgang Puck of bartenders.

      I wonder if she is a bartender that took an online course 15 years ago and haven’t really worked very much. I’ve been to many parties sponsored by liquor companies, where certain “creative” drinks are served based on the company recipes. The defendant didn’t seem aware that such parties exist and, instead, she was talking about using rum? tequila? instead of the vodka the sponsor was providing.

      @@thebookwasbetter3650 I spent some time as a bartender and I see it the same way, though "tavern wench" is a very unnecessary slur. He shopped and negotiated for a typical party bartending gig. He waited too late to confirm her competency and comfort level in this kind of specialty presentation work. She balked and she at least gave as much notice as she could once she felt uncomfortable. He has not much experience hiring bartenders and he created this situation.

    I think the job was way over her head. She thought the job was going to be very simple but when she had to make speciality drinks, she had to make up an excuse to quit so she used him micromanaging her as the excuse.

      I remember my cousin's significant other talking about her experiences like this...
      She said that there are two kinds of bartenders she can get for a party: some that get their licence (and think "how hard can it be?") and those who know how to make a drink... Pros will normally share the recipe when asked
      I am wondering how she'd answer if he asked how she makes a rum and coke...

      He was telling her how the "spirit maker" wanted the drinks prepared. They gave the recipes to him (that I'm sure they'd tested many times) and he passed them on to her. This is how new drinks/recipes become popular; through the spirit-maker trying them in various recipes. I still have free cookbooks from various spirit-makers (Bacardi, Kahlua, Johnnie Walker...etc.) that have WONDERFUL cakes, pies, cookies, entrees and mixed drinks. I still make the Rum pound cake and Kahlua Bundt cake.

    I think this "bartender" might know how to serve beer and basic shots at some local dive where the regulars always order the same 5-6 types of easy drinks but real bartending is over her head... Pros don't get all butthurt when told how the drinks needed to be made as per the vodka/ bourbon maker. I guarantee if she had shown up it would have been a disaster because Miss "I Know What I'm Doing" would have screwed up the drinks. And if I'm wrong and she is great at her job, she's still an idiot for passing up a great networking opportunity and some killer tips.

    I just think she was intimidated by the way he wanted his drinks . She figured it would be someone way to picky , or someone who actually would be paying close attention to her drinks . She’s probably used to a bunch of house parties where the people really don’t care how good the bartender is . I think she realized that this job would be above her expertise, and just decided she really didn’t want to be managed at all , let alone micromanaged .. it’s almost like a bartender , bartending for another bartender , you know they’re going to judge you extra hard - because they know ..

    The defendant clearly didn't understand who the party was being thrown for (unnamed liquor executives) or allowed her ego to get the best of her. Either way, it didn't show her in a flattering light. If you're a professional-- ask questions if something seems off. She claims she didn't know that it was to promote the particular liquors, instead of taking offense-- why not inquire? This will haunt her forever.

      I don't think that's the issue. Yes she was insulted but most of all I don't think she was good or prepared enough to do all the little details for each drink. I attended bartender school and it's not an easy job to do, especially in busy environments where every second and detail of each drink matters. There's a lot riding on the bartender.

    This was silly on all fronts. Plaintiff tried to turn a $75 case into a $1600 lawsuit. Defendant lost out on a gig plus possible industry referrals over her pride. Just silly.

    I worked as a bartender for a bit more than a decade. I did regular service at my full time bar gig, and special events in private spaces or other bars… any bartender who stays in the game long enough will have to learn special drink recipes at one point or another. And whatever they say is what you do as long as it is food safe and legal under your liquor license. Even the proper way to serve a Stella Artois (beer) involves very specific directions for how to wash the glass first. Sometimes you’ll even be told which hand you put a drink up with! And you know what? You do it. Because who cares. It’s how they want to present and market their product. I can get on board or get tf out 🤷‍♀️

      I'm curious, since u have bartending experience, is using 1 slice of fruit a sanitary issue. I myself, non experienced in bartending, would think it is but again I have no experience lol I understand she was definitely unprofessional and you do , within reason, whatever your customer or whoever hired you sskes, smile, say ok, and no matter how picky you suck it up and do your job u were hired 4.     Defendant was completely wrong! Plantiff had a specific type of event in which the alcohol was the star and for that the drinks had to be prepared a certain way and she didn't want to do! Her lost she could have gotten all times of opportunities by networking at that event! I don't even drink but have common sense enough to know the drinks/alcohol was the star of this event and as such needed to be prepared a certain way!

    Nah it wasn’t her ego, she was just lazy and was thinking it was gonna be a hole-in-the-wall bachelors party where she just fills beer into mugs. There’s no way she would deny such an event just because “I’m better than that”. If she was that confident and believed in herself that much: She would NEVER pass up on a job like that, as a private bartender, could show off her services at a credible tasting like that. WITH MULTIPLE INDUSTRY MAKERS! She was just lazy and probably missed out on the best opportunity in her chosen profession. Good job Karen 👍 👏

    When I used to be a wedding DJ, I had the following paragraph in my contracts:
    In the event the DJ (X) is unable to perform due to illness, accident, equipment failure or otherwise, DJ (X) shall use the best efforts to find a qualified replacement DJ, equipment or to otherwise perform hereunder. If DJ (X) is unable to locate a replacement DJ or replacement equipment, and therefore fails to perform hereunder, the Client shall receive a full refund of any amounts paid (including Retainer) within thirty (30) days after Event Date. The parties agree that refund of its payments made shall be Client's SOLE AND EXCLUSIVE remedy in either law or in equity for DJ (X)'s failure to perform hereunder.
    This covered my ass in case something happened to me.

    Sounds a lot like the defendant only wants to work for events where she can be the center of attention and show off her bartending "skills" to the attendees. In this case, she would have just been a faceless worker following orders, and she didn't like that. That's more likely why she quit. The plaintiff may have aimed high in what he sued for, but still got what he knew he deserved, so he was satisfied with the judgement. He had all his paperwork prepared and ready, as a good businessperson should. He knew the law regarding contracts and Judge Milian had no choice but to side with him from the get-go.

    The bartender lost me with the feminist crap. "I felt uncomfortable going at his house." First of all, it's a sleazy defense that she used after she was learning that the judge wasn't receptive to her first defense. Second of all, this is what you guys do, go into people's businesses and homes and do your work. Before that sleazy defense, I was with her. The guy should've been more transparent and said, "I'm throwing an event for corporate clients and they want their drinks done in this certain way...can you do it?" Instead, he said, "The drinks need to be done in this certain way," which would put most people off who've been doing the job for 15 years. Go to any professional whether an accountant or a CEO of a corporation for 15 years and tell them how to do something routine, they would look at you like you were crazy. She lost me at the "I felt uncomfortable" crap.

    She was wrong and deserved what she got, but why does a billion dollar company scrap the bottom of the barrel to get staff. If the night is so important why not employ 2 people and pay an appropriate wage. Or maybe hire a caterer who can provide all the staff, food, drinks and any equipment as a package.
